Clinical Documentation

Your Summary Plan Description
Your employer’s Summary Plan Description describes the plan’s coverage rules, its formulary, and its appeal procedures. Section 2 is where you explain the appeal. Write in plain language why the denial was wrong. Focus on the medical reason the drug is necessary, the alternatives already tried that didn’t work, and the clinical evidence your doctor can point to. Keep it tight. If your physician has written a separate letter of medical necessity, summarize the key points and reference the attached letter.
A common mistake: entering your name or date of birth differently from the way they appear in Liviniti’s system. Use the exact spelling and format on your benefit card. Even a small mismatch can stall processing while the appeals team tries to match your submission to your file.
If Someone Else Is Filing for You

Fax is faster and gives you a transmission confirmation that serves as proof of delivery. If you mail the packet, use certified mail with return receipt so you have evidence of the date Liviniti received it. That date starts the clock on their review. Either way, keep copies of everything: the form, the denial letter, every page of clinical records, and your proof of delivery.
How Long You Have to File
Federal law gives you at least 180 days from the date you receive a denial notice to file an internal appeal.5U.S. Department of Labor. Clinical records are easier to gather while the denial is fresh, and you get your medication faster if the appeal succeeds.

What Happens After You Submit
Liviniti’s Prior Authorization Appeals Policy sets a first-level internal review in which a reviewing pharmacist evaluates the appeal and the supporting documentation. The pharmacist must decide — approval or denial — within three business days of receiving your appeal, excluding weekends and holidays, and then communicate the outcome to the filer.6Liviniti. If your situation is urgent, meaning a delay could seriously threaten your health or leave you in severe pain that cannot be managed without the medication, the timeline shortens to no more than 72 hours.7eCFR. 29 CFR 2560.503-1 – Claims Procedure Whether a claim qualifies as urgent is generally determined by a physician familiar with your condition. If your doctor believes the standard timeline would put you at risk, ask them to say so explicitly on the appeal or in the letter of medical necessity.
If Liviniti Denies the Appeal
If Liviniti upholds the original denial, or you don’t get a timely decision, you may be able to request an external review by an independent third party.1Liviniti. To qualify for external review, the denial generally has to involve one of these:
- A dispute over medical judgment — you or your doctor disagrees with Liviniti’s clinical reasoning.
- A denial on the grounds that the medication is experimental or investigational, when you believe the evidence supports its use.
- A cancellation of coverage based on a claim that you provided false or incomplete information when you enrolled.8HealthCare.gov. External Review
You must file a written request for external review within four months of the date you receive the final internal denial.8HealthCare.gov. External Review A standard external review produces a decision within 45 days. Expedited external review for urgent situations is decided within 72 hours or less. If your plan uses an independent review organization or a state external review process, you may be charged a fee, but it cannot exceed $25.
Coverage While the Appeal Is Pending
If the denial reduces or ends benefits for a treatment already underway — for example, Liviniti decides mid-course to stop covering a medication you have been taking — the plan must continue the benefit while the appeal is pending. One Boundary: Grandfathered Plans
