How to Complete and Submit the Kaiser Privacy Breach Settlement Claim Form

If you were a Kaiser Permanente member who logged into Kaiser’s websites or mobile apps between November 2017 and May 2024 while living in one of nine states or the District of Columbia, you can file the Kaiser privacy breach settlement claim form online or by mail by March 12, 2026 to receive an estimated $20 to $40 payment. The $46 million class action settlement resolves allegations that tracking pixels on Kaiser’s authenticated pages shared member data with companies including Google, Microsoft, and Adobe without consent.

Who Can File a Claim

The settlement class covers Kaiser Permanente members in California, Colorado, Georgia, Hawaii, Maryland, Oregon, Virginia, Washington, and the District of Columbia. You qualify if you accessed the logged-in portions of Kaiser’s websites or mobile apps at any point from November 2017 through May 2024 while residing in one of those locations.1Kaiser Privacy Breach Settlement. Most eligible members received a mailed or emailed notice with a Settlement Class Member Unique ID. You need that ID to submit the form, and the settlement site does not offer an online lookup. If you never received a notice or lost it, contact the settlement administrator at 1-855-783-3816 or info@KaiserPrivacySettlement.com to confirm eligibility and retrieve your ID before starting the form.1Kaiser Privacy Breach Settlement. Filling Out the Claim Form

Payment Election

Choose how you want to be paid:2Kaiser Privacy Breach Settlement. Kaiser Privacy Breach Settlement Claim Form

  • Electronic payment. When distribution begins, you pick from electronic Mastercard, Amazon gift card, Target gift card, Venmo, PayPal, or ACH direct deposit. The payment link goes to the email address you gave in the first section.
  • Physical check mailed to the address you listed.

Electronic payment arrives faster and avoids the risk of a check going astray if you move before distribution.

How Much You Can Expect

The settlement website estimates individual payments between $20 and $40. The total fund is $46 million, with a possible increase to $47.5 million under a confidential supplemental agreement. After the court authorizes deductions for attorney fees (capped at 33% plus up to $900,000 in costs), administration costs (estimated at $1.7 to $2.4 million), and service awards for the named plaintiffs, what remains is divided equally among all valid claimants on a pro rata basis. Fewer claims filed means a larger share per person.1Kaiser Privacy Breach Settlement. Kaiser Privacy Breach Settlement

No money is distributed until after the Fairness Hearing on May 7, 2026, when the judge decides whether to grant final approval. Appeals, if any, delay payment further. Once the settlement becomes effective, you receive payment by whichever method you chose on the form.1Kaiser Privacy Breach Settlement. Kaiser Privacy Breach Settlement

Opting Out or Objecting Instead

Filing a claim is not the only option. You can also opt out or object, and both must be done in writing by March 12, 2026.1Kaiser Privacy Breach Settlement. Kaiser Privacy Breach Settlement

Opting out means requesting exclusion in writing, mailed to the settlement administrator. You get no payment and are not bound by the court’s judgment, so you keep the right to sue Kaiser separately over the tracking-pixel issue.

Objecting means filing a written objection to terms you consider unfair, such as the payment size or the attorney fees. The judge considers objections at the May 7 hearing. An objection does not remove you from the settlement; you can still file a claim and collect a payment even if the objection is overruled.

You cannot do both. Exclusion gives up your share; objection tries to change the deal for everyone.

Taxes on the Payment

Privacy settlement payments like this one are generally taxable as ordinary income. The claim involves unauthorized data sharing rather than a physical injury, so it does not qualify for the IRC Section 104(a)(2) exclusion that applies to personal physical injury damages. The IRS treats the payment based on what it replaces, which here is compensation for a non-physical harm.3Internal Revenue Service. Tax Implications of Settlements and Judgments

At $20 to $40, the tax impact is small, and whether the settlement administrator issues a 1099 depends on the final amount and IRS reporting thresholds. Keep your confirmation and payment records with your tax documents for the year the payment arrives.
