How to Complete and Lodge Your NOIM in Australia

A Notice of Intended Marriage in Australia is the written notice every couple must give to their chosen authorized celebrant before they can legally marry. Under section 42 of the Marriage Act 1961, the celebrant has to receive it no earlier than 18 months and no later than one calendar month before the wedding date.1Federal Register of Legislation. Marriage Act 1961 The form is short. The timing and witnessing rules are where couples run into trouble.

The One-Month Minimum and 18-Month Maximum

Your celebrant must have the completed NOIM in hand at least one full calendar month before the ceremony. Lodge on 1 March and the earliest lawful wedding date is 1 April. The one-month floor exists to prevent rushed or coerced unions.1Federal Register of Legislation. Marriage Act 1961

Once lodged, the notice stays valid for 18 months from the date the celebrant received it. If you push the wedding back within that window, the same NOIM still covers you. Let 18 months pass without marrying and the notice expires; you lodge a fresh one and the month-long waiting period restarts.2Australian Marriage Celebrants. Documents Each Party Must Provide

Every party has to show evidence of their date and place of birth. A birth certificate, an official extract from a birth register, or a passport will do.1Federal Register of Legislation. Marriage Act 1961 If either of you was married before, you also need proof the earlier marriage has ended: a final divorce order or the former spouse’s death certificate.3NSW Government. The celebrant also needs to be satisfied you are who you say you are. Photo ID such as a passport, driver licence, or official identity card is the usual way to meet this.3NSW Government. Notice of Intended Marriage

Any document not in English must come with an approved translation. Inside Australia, the translator must be accredited by the National Accreditation Authority for Translators and Interpreters (NAATI). Translations done in the United States must come from a translator individually certified by the American Translators Association (ATA). Translations done elsewhere have to be stamped and certified by the nearest Australian embassy or consulate.4Australian Embassy USA. English Translation of Foreign Documents

Filling Out the Form

You can download the NOIM from the Attorney-General’s Department website or ask your celebrant for a copy.5Attorney-General’s Department. Notice of Intended Marriage Each party fills in their full legal name, occupation, usual place of residence, and their parents’ names. The details on the NOIM flow straight through to your official marriage certificate, so a typo or an inconsistent spelling now can hold up registration later.

Signing a NOIM you know contains a false statement is a criminal offence under section 104 of the Act. The penalty is up to six months’ imprisonment or five penalty units.

Who Can Witness Your Signatures

Both parties must sign the NOIM in the physical presence of an authorized witness. The list of people who can act as witness depends on where you sign.

Signing inside Australia, your witness can be any of the following:

  • An authorized marriage celebrant
  • A Commissioner for Declarations under the Statutory Declarations Act 1959
  • A Justice of the Peace
  • A barrister or solicitor
  • A legally qualified medical practitioner
  • A member of the Australian Federal Police or a state or territory police force

Signing outside Australia, a different set applies:

  • An Australian diplomatic officer
  • An Australian consular officer
  • A notary public
  • An authorized Commonwealth employee under the Consular Fees Act 1955

The two of you don’t have to sign at the same moment, in the same place, or before the same witness.1Federal Register of Legislation. Marriage Act 1961 That flexibility helps when one party is interstate or overseas in the run-up to the wedding. One boundary to note: a celebrant cannot witness a NOIM remotely for a couple located outside Australia.5Attorney-General’s Department. Notice of Intended Marriage

Lodging With Your Celebrant

Once the form is completed and properly witnessed, you give it to your chosen authorized marriage celebrant. The celebrant then works through your documents: verifying identity, confirming any earlier marriage has been dissolved, and checking the witness signatures come from an authorized person. Do this early enough that the one-month clock will run in your favour.

Shortening the One-Month Period

In limited circumstances, a “prescribed authority” can authorize a shorter notice period under section 42(5). In capital cities the prescribed authority usually sits inside the Registry of Births, Deaths and Marriages. The Marriage Regulations 2017 set out five grounds:

  • Employment-related travel commitments that require a party or someone involved in the wedding to leave the area for an extended time.
  • Binding wedding arrangements already in place, such as venue bookings, catering, or religious requirements.
  • Serious medical reasons affecting a party or someone involved in the wedding.
  • Legal proceedings that make delay impractical.
  • Celebrant error, where notice wasn’t given correctly because of a mistake by the celebrant and wedding arrangements are already in place.

Applications are not rubber-stamped. You need to show your situation genuinely fits one of these grounds. Simply leaving the paperwork too late, on its own, will not qualify.

If Something Is Wrong With the NOIM

Section 48(2) of the Act says a marriage is not invalid merely because notice wasn’t given as required, a statement in the notice was false, required documents weren’t produced, or some other requirement of section 42 wasn’t met.1Federal Register of Legislation. Marriage Act 1961 A defective NOIM will not retroactively unwind a marriage that has already taken place.

That’s not a licence for sloppiness. A celebrant who solemnizes a marriage without a valid notice puts their registration at risk, and anyone who knowingly signs a false notice can be prosecuted. Other things still void a marriage outright, including bigamy, a prohibited relationship, lack of real consent, or a party being underage without the necessary judicial authorization.1Federal Register of Legislation. Marriage Act 1961 A paperwork error on the NOIM alone is not on that list.
