Start With the Prevailing Wage Determination
Before any recruitment, the employer files Form ETA-9141 with the National Prevailing Wage Center. This step controls everything downstream. Recruitment ads cannot list a salary below the prevailing wage. The job description on Form ETA-9089 must match the description submitted in the wage request. And the employer must be able to pay at least the prevailing wage from the date the foreign worker starts. Inconsistencies between the wage request, the ads, and the final form surface during audits and almost always trigger denials.
Run the Required Recruitment

Every PERM case requires a job order with the State Workforce Agency and two Sunday newspaper advertisements in a paper of general circulation in the area of employment. The two Sundays do not have to be consecutive, though running them back-to-back is common. Three More Steps for Professional Positions
Professional occupations require three additional recruitment methods from a list of ten in the regulations. The options include job fairs, the employer’s own website, third-party job search websites, on-campus recruiting, trade or professional organization publications, private employment firms, employee referral programs with incentives, campus placement offices, local and ethnic newspapers, and radio or television advertisements. Only one of the three chosen steps may consist entirely of activity that happened within 30 days of filing, and none can be more than 180 days old at filing.3eCFR. 20 CFR 656.17 – Basic Labor Certification Process
What the Ads Must Say
Every newspaper or journal ad must name the employer, direct applicants to respond to the employer, and describe the vacancy specifically enough that a U.S. worker can tell what the job is. Each ad must indicate the geographic area of employment. Notice of Filing
Separately from the ads, the employer must post a Notice of Filing at the worksite for at least 10 consecutive business days, and those days must fall inside the same 30-to-180-day recruitment window.5U.S. Department of Labor. The 30-Day Quiet Period and the Recruitment Report
After all recruitment concludes, a 30-day quiet period runs before the employer can file the application. During that time, the employer reviews every response, interviews any candidate who appears to meet the minimum qualifications, and documents the outcome for each applicant. Any U.S. worker who meets the minimum requirements can be rejected only for lawful, job-related reasons. Confirm the Job Requirements Are Defensible
The requirements on Form ETA-9089 cannot exceed what is normally expected for the occupation unless the employer can prove business necessity. That applies to education levels, years of experience, special skills, and unusual combinations of duties. Foreign language requirements get especially close scrutiny. One is defensible only if the occupation itself demands the language (a translator, for instance), or if a large majority of the employer’s customers, contractors, or employees cannot communicate effectively in English and the position requires frequent contact with them. Experience the foreign worker gained with the sponsoring employer generally cannot count toward meeting the requirements. The narrow exception applies when the sponsored position’s duties are at least 50 percent different from the position where the worker gained the experience. Getting the job descriptions wrong in this corner is a common denial ground.
Recent layoffs also affect the application. If the employer laid off workers in the same or a related occupation within six months of filing, in the same area of intended employment, the employer must document that it notified every potentially qualified laid-off worker about the opening and considered them for it.3eCFR. 20 CFR 656.17 – Basic Labor Certification Process The DOL does not limit this to formal layoffs; any workforce reduction in a related classification in the area can trigger the requirement.
Complete Form ETA-9089 in the FLAG System
The application is filed electronically through the Foreign Labor Application Gateway (FLAG).8U.S. Department of Labor. Have the Federal Employer Identification Number, worksite addresses, and the prevailing wage determination on hand before opening a session.
The form collects information about the employer, the job opportunity, and the foreign worker. The employer section covers organizational details and worksite locations. The job opportunity section requires a precise description of duties, minimum education, training, experience, and any special skills or certifications. Every detail must match what was submitted in the prevailing wage request and what ran in the recruitment advertisements. Inconsistencies between these documents are one of the most common audit triggers.
Information about the foreign worker goes primarily into Appendix A, which covers education (institution name and degree awarded), training, and complete employment history. Each prior position must include employer name, dates of employment, and a summary of duties.9U.S. Department of Labor. Confirm that the job title and SOC code assigned by the National Prevailing Wage Center appear exactly as issued. FLAG’s built-in validations will catch blank fields and dates outside the regulatory windows, but they will not catch substantive mismatches between documents.
File and Lock in the Priority Date
After every field is complete, the employer’s authorized representative electronically signs the application, certifying that all statements are true. The priority date determines the worker’s place in line for a green card. For applicants from countries with heavy demand, the gap between the priority date and visa availability can stretch years. Losing a priority date to a preventable error means starting the entire process over, which is why employers push to file as soon as the recruitment window allows.
The DOL does not charge a filing fee for Form ETA-9089, but prevailing wage requests, newspaper advertising, recruitment logistics, and attorney fees add up. Federal regulations prohibit the employer from seeking or receiving payment of any kind from the foreign worker for activities related to obtaining labor certification, including reimbursement of attorney fees, wage concessions, salary deductions, kickbacks, and free labor.10eCFR. 20 CFR 656.12 – Improper Commerce and Payment The foreign worker may pay for separate legal representation, but when a single attorney represents both the worker and the employer, the employer must bear all costs.
Processing, Audits, and Supervised Recruitment
As of March 2026, the DOL’s average processing time is 501 calendar days for standard analyst review and 343 calendar days for cases that go through audit review.11Office of Foreign Labor Certification. Processing Times Those figures move with caseloads and staffing, and individual cases run longer with complexity.
Some applications are audited because of their content, others by random selection for quality control. When an application is audited, the Certifying Officer sends an audit letter specifying which documents the employer must produce. The employer has 30 days from the date of the letter to respond, and the Certifying Officer has discretion to grant a single 30-day extension.12eCFR. 20 CFR 656.20 – Audit Procedures Missing the deadline is treated as a refusal to exhaust administrative remedies, which forfeits the right to appeal the resulting denial.
In more serious cases, the Certifying Officer may order supervised recruitment, either during an audit or on its own. Under supervised recruitment, the DOL takes direct control: the Certifying Officer approves the advertisement before publication, directs where it runs, and requires all applicants to send resumes to the DOL rather than the employer. The employer receives resumes by referral and must submit a detailed recruitment report explaining with specificity why each U.S. applicant was not hired.13eCFR. 20 CFR 656.21 – Supervised Recruitment
After Certification: The 180-Day I-140 Deadline
Once the DOL certifies Form ETA-9089, the employer has exactly 180 calendar days to file Form I-140, Immigrant Petition for Alien Workers, with USCIS.14U.S. Citizenship and Immigration Services. Missing the deadline voids the certification entirely, and the employer must start a new PERM case from scratch, including a fresh prevailing wage determination and a full round of recruitment.
USCIS reviews the I-140 to verify that it includes a valid, properly signed labor certification approval. If the Application Is Denied
A denial arrives as a Final Determination stating the specific reasons. The employer has two options, each subject to a 30-day deadline from the date of the denial. The first is a request for reconsideration from the Certifying Officer, limited to documentation either already submitted or that existed at the time of filing and was maintained in compliance with record-keeping requirements. The second option is a request for review by the Board of Alien Labor Certification Appeals. Failing to request review within 30 days makes the denial final and waives all administrative remedies. While a review request is pending, the employer cannot file a new application for the same worker in the same occupation. If the employer decides not to appeal, a new application can be filed at any time.
Records to Keep for Five Years
