How to Complete and File a Surrogate’s Court Affidavit of Urgency

A Surrogate’s Court affidavit of urgency is a custom-drafted, sworn document you file in a New York estate proceeding to ask the judge to move your matter ahead of the regular queue. New York does not publish a fill-in-the-blank form for it. You draft the affidavit, attach proof of the emergency, e-file it through NYSCEF, and then email a copy to your county Surrogate’s Court urgency inbox so the case gets flagged for expedited review.

Grounds That Justify an Urgency Request

The court will only pull your case out of the regular line if waiting would cause real, measurable harm to the estate or its beneficiaries. Vague inconvenience will not move a Surrogate. The judge needs to see a concrete deadline or threat that makes the standard timeline unacceptable.

Situations that commonly support an urgency filing include:

  • A scheduled foreclosure sale on the decedent’s property, where no one currently has authority to negotiate for the estate.
  • Looming federal or New York estate tax deadlines. Form 706 is due nine months after the date of death, and the IRS charges interest and penalties on late payments; without an appointed fiduciary, no one can file or request an extension.1Internal Revenue Service. Frequently Asked Questions on Estate Taxes
  • Eviction of surviving family members living in property owned by the decedent.
  • Unpaid funeral or final medical expenses when the estate’s bank accounts have been frozen at death.
  • Utility shutoffs, lapsed insurance, or property deterioration that will erode estate value.

SCPA 901 authorizes the court to grant temporary administration whenever “for any cause delay occurs in the grant of letters on the estate of a decedent.”2New York State Senate. New York Code Surrogate’s Court Procedure Act SCP 901 – When Temporary Administration May Be Granted That language is deliberately broad. Your affidavit’s job is to show why the delay matters in your specific case.

What to Include in the Affidavit

Because there is no standard form, you build the document from scratch. Successful urgency affidavits share the same core elements even when the facts differ.

Caption and Case Identification

Begin with a caption naming the Surrogate’s Court, the county, the name of the estate, and the file number assigned when the underlying petition was filed. CPLR 2101(c) requires every court paper to open this way.3New York State Senate. New York Civil Practice Law and Rules Law R2101 – Form of Papers If you are filing the urgency affidavit alongside a brand-new petition and no file number has been assigned yet, note that in the caption.

Your Identity and Standing

State your full legal name, your relationship to the decedent, and your connection to the proceeding. If you are the petitioner for letters of administration, say so. If you are the nominated executor under the will, identify the will by date. An attorney filing on behalf of the petitioner must include the firm name, address, and phone number under CPLR 2101(d).3New York State Senate. The Narrative of Harm

This is the heart of the document. Describe in plain, factual language what will happen if the court does not act quickly. Be specific. Name the foreclosure sale date, the tax deadline, the dollar amount of the debt, the date of the scheduled eviction. Judges respond to concrete facts with real numbers attached, not to emotional pleas.

Explain, too, why the emergency is not something you caused by your own delay. If you waited six months after the decedent’s death to start probate while a tax lien grew, the Surrogate will want to know why. Courts are less sympathetic to urgency that timely action would have prevented.

The Specific Relief You Want

Do not leave the judge guessing. State exactly what you are asking for. Common requests are temporary letters of administration under SCPA 901, preliminary letters testamentary under SCPA 1412 when a will has been submitted for probate and process has been issued, or limited and restrictive letters under SCPA 702 that confine the fiduciary’s authority to a single task.4New York State Senate. New York Code Surrogate’s Court Procedure Act SCP 702 – Limited and Restrictive Letters You may also request an Order to Show Cause if the situation calls for an emergency hearing.

Supporting Documents

Attach everything that corroborates the urgency: a notice of foreclosure sale, a final utility disconnect warning, an IRS notice, a letter from a bank refusing account access, a landlord’s eviction notice. The court should be able to look at your exhibits and independently confirm that the threat you describe is real.

Formatting and Signing Rules

New York has specific rules on how court papers must look. CPLR 2101 requires white, durable paper measuring 8.5 by 11 inches, legible text in black ink, and a minimum type size of 10 points.3New York State Senate. New York Civil Practice Law and Rules Law R2101 – Form of Papers Court Rule 22 CRR-NY 202.5 adds double-spaced lines, one-inch minimum margins, and 12-point print (footnotes may drop to 10 points).5New York Codes, Rules and Regulations. 22 CRR-NY 202.5 – Papers Filed in Court Papers that violate these rules can be rejected by the clerk before a judge ever sees them.

Affidavit or Affirmation

You have two ways to swear to the truth of your statements. A traditional affidavit requires you to sign before a notary public. Alternatively, under CPLR 2106, any person may sign an affirmation, a written statement declared under the penalties of perjury under the laws of New York, and it carries the same legal weight as a notarized affidavit.6New York State Senate. New York Civil Practice Law and Rules Law R2106 – Affirmation of Truth of Statement The affirmation is faster and useful when a notary is not within easy reach. Either way, every factual statement you make carries perjury exposure if it is knowingly false.

How to File the Affidavit

E-File Through NYSCEF

Attorneys must file urgency applications through the New York State Courts Electronic Filing (NYSCEF) system. Unrepresented parties can also use NYSCEF, though some counties still allow them to file by mail or in person at the clerk’s office.7New York State Unified Court System. Queens Surrogate’s Court Emergency Applications Upload the affidavit or affirmation and every supporting exhibit as part of the filing.

Email the County Urgency Inbox

E-filing alone will not get you expedited treatment. After you file, email a copy of the affidavit, the NYSCEF confirmation notice, and proof of fee payment to your county Surrogate’s Court urgency inbox. That email is what actually flags your case. Queens County uses qnssurr-urgency@nycourts.gov.7New York State Unified Court System. Queens Surrogate’s Court Emergency Applications Kings County uses KingSurr-Urgency@nycourts.gov. For any other county, check its Surrogate’s Court page on nycourts.gov or call the clerk to confirm the correct address before you send. The wrong inbox, or no email at all, and your urgency request sits in the regular queue.

Filing Fees

The urgency affidavit itself has no separate fee, but the underlying petition it accompanies does. Under SCPA 2402, Surrogate’s Court fees scale with the value of the estate:

  • Under $10,000: $45
  • $10,000 to $19,999: $75
  • $20,000 to $49,999: $215
  • $50,000 to $99,999: $280
  • $100,000 to $249,999: $420
  • $250,000 to $499,999: $625
  • $500,000 and over: $1,250

If the estate’s value later turns out to be higher than what you first reported, you will owe the difference between the original fee and the correct one.8New York State Senate. New York Code Surrogate’s Court Procedure Act SCP 2402 – Fees of Surrogate’s Court Pay through NYSCEF at the time of filing and include the payment confirmation in the email to the urgency inbox.

What Relief You Can Ask the Court to Grant

The Surrogate has several options, and the one you request in the affidavit should match what the estate actually needs.

Temporary Letters of Administration

Under SCPA 901, the court can appoint a temporary administrator whenever there is delay in granting regular letters.2New York State Senate. New York Code Surrogate’s Court Procedure Act SCP 901 – When Temporary Administration May Be Granted A temporary administrator can collect assets, pay debts, and manage property while the full proceeding continues. This is the most common request when there is no will or the will has not yet been admitted to probate.

Preliminary Letters Testamentary

When a will has been submitted for probate and process has been issued, the named executor can request preliminary letters testamentary under SCPA 1412.9New York State Senate. Surrogate’s Court Procedure Act SCP 1412 – Preliminary Letters Testamentary These give the executor authority to act before probate is finalized. If the will names multiple executors, notice must go to the others before letters issue.

Limited and Restrictive Letters

Sometimes the estate needs someone authorized to do one specific thing: defend a lawsuit, complete a real estate transaction, manage a single bank account. SCPA 702 lets the court issue letters that confine the fiduciary’s powers to that narrow task.4New York State Senate. New York Code Surrogate’s Court Procedure Act SCP 702 – Limited and Restrictive Letters Section 702(10) is a catch-all that covers “any other purpose or act deemed by the court to be appropriate or necessary” for the estate’s protection. The court can also reduce or waive the bond requirement for limited letters, which itself can save time.

Order to Show Cause

Where the urgency involves contested issues, such as a dispute between potential administrators, the court may issue an Order to Show Cause rather than granting relief outright. That sets a short-fuse hearing where interested parties can appear and argue, and it can include temporary restraining provisions that freeze the status quo until the hearing.

After You File

Once your e-filing goes through and the urgency email lands, the Surrogate’s chambers or the court’s law department reviews the request. The court retains full discretion over whether to grant expedited treatment.7New York State Unified Court System. Queens Surrogate’s Court Emergency Applications Initial responses on genuine emergencies often come within a few business days, but the timeline depends on the county’s caseload and the strength of your showing.

If the court grants the request, it will either issue the letters you asked for or schedule an emergency hearing, and you will be notified through NYSCEF. If the court denies urgency, your case returns to the standard processing queue based on the original filing date. A denial of urgency is not a denial of the underlying petition.

Check your NYSCEF account daily. Courts communicate through the system, and a missed notification about a hearing or a request for additional documents can undo the expedited treatment you worked to get.
