To file Form 709, you report each gift that exceeded the $19,000 annual exclusion on Schedule A, apply your lifetime exemption credit in Part II of page 1 so no tax comes due, attach appraisals for any hard-to-value property, and mail or e-file the return by April 15 of the year after the gift. For almost every filer, Form 709 is a disclosure return, not a tax bill: it documents that you used a slice of your $15 million lifetime exemption, and it starts the three-year clock the IRS has to challenge what you reported.1Internal Revenue Service. Instructions for Form 709 (2025)
When a Return Is Actually Required
The annual exclusion for 2026 is $19,000 per recipient. Give any one person more than that in a calendar year and you, the donor, must file Form 709 to report the excess.2Internal Revenue Service. What’s New — Estate and Gift Tax The recipient never files and owes nothing.1Internal Revenue Service. Instructions for Form 709 (2025)
A few transfers stay outside the system entirely and never need reporting, no matter the amount: tuition paid directly to a school, medical bills paid directly to a provider or insurer, gifts to a U.S.-citizen spouse, and gifts to qualifying charities or political organizations.3Office of the Law Revision Counsel. 26 USC 2503 – Taxable Gifts4eCFR. 26 CFR 25.2503-6 – Exclusion for Certain Qualified Transfer for Tuition or Medical Expenses Gifts to a non-citizen spouse have their own higher annual exclusion of $194,000 in 2026; only amounts above that need to be reported.5Internal Revenue Service. Frequently Asked Questions on Gift Taxes for Nonresidents Not Citizens of the United States If your only gifts fall into those buckets, you have no filing obligation.
What to Gather Before You Start
Form 709 asks for specifics, and chasing them down after you’ve started the return is where deadlines slip. Pull the following together first.
Your identification: name, address, Social Security number or ITIN, and citizenship status. If you plan to split gifts with your spouse, you also need their SSN.1Internal Revenue Service. Instructions for Form 709 (2025)
For each recipient: full legal name, mailing address, and their relationship to you.
For each gift: a clear description of the property, the date you made the transfer, your adjusted basis (generally what you paid plus improvements, minus depreciation), and the fair market value on the gift date.1Internal Revenue Service. Instructions for Form 709 (2025) Cash is easy. Publicly traded stock is easy. Real estate, closely held business interests, and artwork are not.
Appraisals and Adequate Disclosure
For any hard-to-value asset, get a qualified appraisal before filing. The appraiser must regularly perform appraisals, must be qualified for the type of property, and cannot be the donor, the recipient, or a family member of either. The report itself has to include the valuation date, the methodology, the financial data used, and enough analysis that another appraiser could replicate the conclusion.6Internal Revenue Service. TD 8845 – Adequate Disclosure of Gifts (Final Regulations)
This matters because of the statute of limitations. The IRS normally has three years from the filing date to challenge anything on a Form 709, but the clock only starts if the gift is “adequately disclosed.”7Office of the Law Revision Counsel. 26 USC 6501 – Limitations on Assessment and Collection A thin description or a weak appraisal leaves the return open to reassessment indefinitely. Filing carefully is the whole point.
Filling Out the Form
Most filers only touch page 1 and Schedule A. Here is what each part does.
Page 1: Donor Information and Tax Computation
The top of page 1 collects your identifying details and your spouse’s information if you are splitting gifts. Part II is the tax computation. You calculate the tentative tax on your cumulative lifetime taxable gifts, then apply the applicable credit, which is the dollar equivalent of your $15 million lifetime exemption in 2026.2Internal Revenue Service. What’s New — Estate and Gift Tax1Internal Revenue Service. Instructions for Form 709 (2025) The credit zeroes out the tax for the vast majority of filers. What the return actually accomplishes is recording how much of your lifetime exemption you have now used.
Schedule A: Each Reportable Gift
Schedule A is the heart of the return. For every reportable gift, enter the donee’s name and address, your relationship to them, a description of the property, your adjusted basis, the date of the gift, and the fair market value. The $19,000 annual exclusion is subtracted here, so only the excess flows into the tax computation on page 1.1Internal Revenue Service. Instructions for Form 709 (2025)
If you made multiple gifts to the same person during the year, list them together and total them; the $19,000 exclusion applies per recipient, not per transfer.
Schedule D: Generation-Skipping Transfers
If a gift went to someone two or more generations below you, typically a grandchild or great-grandchild, the generation-skipping transfer tax may apply, and you report the transfer on Schedule D. The GST exemption for 2026 is also $15 million and works the same way as the lifetime gift exemption: you allocate a portion of it to shelter the transfer.8Internal Revenue Service. Revenue Procedure 2025-321Internal Revenue Service. Instructions for Form 709 (2025) Gifts within the $19,000 annual exclusion and direct tuition or medical payments are generally not subject to the GST tax.
Gift Splitting for Married Couples
Married couples can elect to treat a gift made by one spouse as if each gave half. That doubles the annual exclusion to $38,000 per recipient before either spouse’s lifetime exemption gets touched.9Office of the Law Revision Counsel. 26 USC 2503 – Taxable Gifts
The mechanics: when you elect to split, both spouses must file Form 709 for that year, even if only one actually made the gift. Each spouse signs a consent on the other’s return to validate the election.1Internal Revenue Service. Instructions for Form 709 (2025) Any amount above the combined $38,000 exclusion gets divided evenly and reduces each spouse’s lifetime exemption by half, instead of draining one.
Deadline, Extensions, and Where to Send It
Form 709 is due April 15 of the year after the gift. A 2026 gift is reported by April 15, 2027.10Internal Revenue Service. Filing Estate and Gift Tax Returns
Need more time, often because an appraisal isn’t finished? Filing Form 4868 for your income tax return automatically extends Form 709 to October 15 as well. If you don’t need an income tax extension, file Form 8892 to extend just the gift tax return.1Internal Revenue Service. Instructions for Form 709 (2025) Either extension covers filing only. Any actual gift tax owed is still due April 15.
Paper returns are mailed to the Department of the Treasury, Internal Revenue Service Center, Kansas City, MO 64999.10Internal Revenue Service. Filing Estate and Gift Tax Returns The IRS also accepts Form 709 electronically through the Modernized e-File system; you can authorize a reporting agent to submit it or become an authorized e-file provider yourself.11Internal Revenue Service. Modernized e-File (MeF) for Gift Taxes In practice, most individuals e-file through a tax professional.
Keep a permanent copy of every 709 you file. The IRS sends no confirmation letter, and these returns are the running record of how much lifetime exemption you have used. Your estate will need them, and so will you every time you calculate remaining exemption on a future return.
What Happens If You File Late or Not at All
When no tax is due, there’s no dollar penalty for filing late, because the penalty is a percentage of unpaid tax. That is not the same as no consequence.
The consequence is the open statute of limitations. Never filing, or filing without adequate disclosure, means the IRS can reassess the gift’s value at any time, with no expiration.7Office of the Law Revision Counsel. 26 USC 6501 – Limitations on Assessment and Collection Transfers from decades earlier have been reopened for that reason. A complete, adequately disclosed return closes that door after three years.
If you do owe gift tax and file late, the failure-to-file penalty is 5% of the unpaid tax per month, up to 25%. Fraudulent failure to file is 15% per month, up to 75%.12Office of the Law Revision Counsel. 26 USC 6651 – Failure to File Tax Return or to Pay Tax
