To check your injured spouse refund status, start with the IRS “Where’s My Refund” tool at irs.gov/refunds, which tracks the joint return your Form 8379 is attached to. For details the online tool doesn’t display, call the IRS at 800-829-1040. Processing typically runs 8 to 14 weeks depending on how you filed, and the clock on Form 8379 doesn’t start until the joint return itself finishes processing.
Information to Have Ready
Every lookup method asks for the same three items from your original joint return:
- The Social Security number or ITIN of the primary taxpayer listed on the joint return, not the injured spouse’s number unless they are the same person.
- Filing status, which will be Married Filing Jointly.
- The exact whole-dollar refund amount shown on the return, not the amount you actually received after any offset.
If you filed Form 8379 by itself after your return had already been processed, keep copies of all W-2s, W-2Gs, and any 1099s showing federal income tax withholding for both spouses within reach. The IRS uses those to verify how income and withholding split between you, and missing documents are one of the most common reasons a claim stalls.1Internal Revenue Service. Using Where’s My Refund
The IRS “Where’s My Refund” tool is the first place to check. You can reach it at irs.gov/refunds or through the IRS2Go mobile app, which pulls the same data.2Internal Revenue Service. IRS2GoApp Enter the primary taxpayer’s SSN, your filing status, and the exact refund amount. The tool shows your return moving through three phases: Return Received, Refund Approved, and Refund Sent.3Internal Revenue Service. Here is what the tool won’t do. It tracks the joint return, not the Form 8379 allocation, so you won’t see a separate status line for the injured spouse claim. What it can tell you is whether the return has cleared initial processing. If the tool shows Refund Approved or Refund Sent but the deposit is smaller than expected, an offset has occurred and the IRS is now working the allocation as a separate step. The IRS lists injured spouse claims as a known cause of longer refund delays, so extra time at the Return Received stage is normal.4Internal Revenue Service. Refunds
Checking by Phone
When the online tool isn’t enough, two IRS numbers cover most needs. Call 800-829-1954 for the automated refund line, or 800-829-1040 to reach a representative who can look up Form 8379 processing details the website doesn’t show.5Internal Revenue Service. Refund Inquiries Have your SSN, filing status, and refund amount ready for identity verification.
A different agency handles the offset itself. If you have already received an offset notice and your questions are about the debt or which agency collected the money, call the Bureau of the Fiscal Service Treasury Offset Program at 800-304-3107 (TTY/TDD 800-877-8339), available Monday through Friday, 7:30 a.m. to 5:00 p.m. CST.6Internal Revenue Service. Reduced Refund BFS handles the offset; the IRS handles the injured spouse allocation. Calling the right one saves time.
If you never received the offset notice at all, the BFS TOP line is also where you request the details. That notice includes the original refund amount, the amount offset, the agency that received the payment, and how to contact that agency.6Internal Revenue Service. Reduced Refund
How Long Processing Takes
The IRS processes Form 8379 as a separate step after the joint return, so the injured spouse timeline runs on top of normal refund processing. How long depends on how you filed:
- E-filed with the joint return: about 11 weeks from the date the IRS accepts the return.
- Paper-filed with the joint return: about 14 weeks.
- Filed on its own after the return was already processed: about 8 weeks.1Internal Revenue Service. Instructions for Form 8379
The standalone route is actually the fastest, which matters if you only learned about the offset after your refund was reduced. The IRS confirms the 8-week timeframe for those filings.7Internal Revenue Service. Injured Spouse Relief Attach copies of all W-2s and 1099s for both spouses when you send it, or the wait grows.
When the Wait Runs Long
If you are past the expected timeframe, call 800-829-1040 and ask for a specific status update on the allocation. Representatives can see processing detail the online tool cannot display. Ask whether all required documents were received, since missing W-2s or 1099s are a frequent cause of stalls.
For delays that create real financial hardship, the Taxpayer Advocate Service may be able to move things along. TAS is an independent organization within the IRS that takes cases when normal channels aren’t working. You may qualify for help if you are experiencing economic harm, if your issue has been unresolved for more than 30 days, or if the IRS missed a promised resolution date.8Internal Revenue Service. Who May Use the Taxpayer Advocate Service Contact TAS when you are facing consequences like an inability to cover rent or utilities, not for routine waiting.
Make Sure You Filed the Right Form
Two kinds of spousal relief sound alike and solve different problems. Injured spouse relief on Form 8379 recovers your share of a joint refund seized to pay your spouse’s separate debt. Innocent spouse relief on Form 8857 relieves you from paying additional tax caused by your spouse filing an incorrect joint return.9Internal Revenue Service. Tax Relief for Spouses
If you have been tracking a Form 8379 and none of the timelines fit your situation, confirm you filed the form your case actually calls for. A refund reduced because of your spouse’s child support or defaulted student loan is a Form 8379 case. A notice saying you owe additional tax because your spouse underreported income or claimed false deductions is a Form 8857 case. The IRS will not redirect a misfiled form to the right department on its own.
