How to Change Your Name With the IRS After Marriage

To change your name with the IRS after marriage, you don’t file anything with the IRS at all. You update your name with the Social Security Administration, and the SSA sends the change to the IRS through an automated data exchange. The name on your next tax return has to match what the SSA has on file, so the practical work is finishing the SSA update before you file.

Why the Change Happens at the SSA, Not the IRS

The IRS does not keep its own database of legal names. It pulls identity information from the Social Security Administration, and every return you file gets matched against SSA records.1Internal Revenue Service. Name Changes and Social Security Number Matching Issues Once the SSA has your new name, the IRS gets it automatically. If the name and Social Security number on your Form 1040 don’t line up with SSA records, the return can be rejected or your refund held up.2Internal Revenue Service. The Form and Documents You’ll Need

The name change runs on Form SS-5, the Application for a Social Security Card. You’ll enter your new legal name, your birth name, and your Social Security number. The form asks for parent names and Social Security numbers, but those fields are only required when applying for an original card for a child under 18; adults changing a name after marriage can mark the parent SSN fields “unknown” if needed.3Social Security Administration. Along with the form, the SSA needs two things:

The SSA accepts originals or certified copies from the issuing agency and returns your originals by mail. There is no fee for a corrected card.5Social Security Administration. Replace Social Security Card

How to Submit It

You have three options depending on where you live. Some states allow the entire name change to be completed online through a personal my Social Security account.6Social Security Administration. How Do I Change or Correct My Name on My Social Security Number Card? If your state isn’t covered online, you can visit a local Social Security office in person or mail the application and your original documents to the nearest office. The office locator on ssa.gov will find yours.

How Long the Update Takes

Once the SSA has everything it needs, the new card usually goes out within 7 to 10 business days. Mail-in applications can run longer on the front end, closer to 2 to 4 weeks in total.7Social Security Administration. How Long Will It Take to Get a Social Security Card? The internal database update happens before the card arrives, and the exchange with the IRS takes a bit of additional time after that. If tax season is close, start early.

If You Need to File Before the SSA Change Is Done

This is the part most newlyweds get wrong. If you married late in the year and the SSA hasn’t finished processing the change by the time you file, use the name that currently matches your Social Security card. The IRS is direct about it: the name and SSN on your return have to agree with what the SSA has on file at the moment you file.8Internal Revenue Service. Name Changes and Social Security Number Matching Issues Filing under a new married name before the SSA has processed the change is one of the most common reasons e-filed returns get rejected.

If a name mismatch does bounce your e-filed return, you can correct the name and resubmit electronically. If the rejection can’t be fixed by re-filing, you’ll need to file on paper. A paper return filed after an e-file rejection has to be postmarked by the later of the original due date or 10 calendar days after the IRS notified you of the rejection.9Internal Revenue Service. For a joint return, both names have to match their own SSA records. If one spouse has finished the name change and the other hasn’t, each person uses whichever name currently matches their card.

What a Name Mismatch Actually Costs You

A name-SSN mismatch does more than slow a refund. It can cause the IRS to deny tax credits. The Earned Income Tax Credit is especially sensitive: the SSN and name must match the Social Security card exactly for every person on the return, and a mismatch can lead to a partial or full denial of the credit, longer processing, or an audit.10Internal Revenue Service. Common Errors for the Earned Income Tax Credit (EITC) The same matching rule applies to other credits tied to specific SSNs. Getting the card updated before you file avoids all of it.

If Your Marriage Certificate Is From Another Country

A marriage certificate in a foreign language needs a translation before the SSA will process the name change, and the agency uses its own authorized translators to prepare or verify those translations.11Social Security Administration. Extract Translations Take the original foreign-language certificate to a local Social Security office rather than mailing it; translation questions are easier to sort out in person. The identity documents are the same as for any other name change: a valid U.S. passport, driver’s license, or other government-issued ID.
