To change your name on Social Security after a divorce, you need a certified copy of your divorce decree that specifically restores your former name, a completed Form SS-5, and an unexpired identity document. There’s no fee. Submit everything at a local Social Security office (by appointment) or by mail, and a new card with the same Social Security number arrives in about one to two weeks.
Your Divorce Decree Has to Say the Name Is Restored
This is the requirement that trips people up. The Social Security Administration will only process a divorce-based name change if the final decree specifically states your restored name.1Social Security Administration. The document needs language along the lines of “Wife’s former name of Jane Smith is hereby restored.”
If your decree is already final and doesn’t include that language, you have two ways forward. You can return to the court that handled the divorce and file a post-judgment motion to amend the decree, or you can file a separate name change petition, which is its own legal proceeding with its own filing fee. Either produces a court order the SSA will accept. Procedures and costs vary, so call the clerk of court where the divorce was filed to find out what your county requires.
What to Bring
Get everything together before you start. You need three things: proof of the name change, proof of identity, and, in some cases, proof of citizenship.
Proof of the Name Change
A certified copy of your divorce decree with a raised seal or court stamp. Regular photocopies are rejected. If you didn’t get one when the divorce was finalized, order a certified copy from the court clerk; there’s usually a small fee.
Proof of Identity
A current, unexpired document showing your name and either your date of birth, your photograph, or a physical description. Proof of U.S. Citizenship (Only If Not Already on File)
Most people born in the U.S. who got a Social Security number at birth have already established citizenship with the SSA and don’t need to prove it again. Filling Out Form SS-5
Form SS-5 is the Application for a Social Security Card. Download it at ssa.gov or pick one up at a local office.4Social Security Administration. The form also asks for your current Social Security number and your parents’ names and Social Security numbers, which the agency uses to match you to your existing record.5Social Security Administration. There is no fee for the card. The SSA has always issued cards at no charge, and third-party services that offer to handle the process for a fee provide no advantage.6Social Security Administration. How to Submit Your Application
In Person
This is the fastest and safest option. A representative reviews your documents on the spot, scans what’s needed, and hands your originals back before you leave. The SSA generally requires an appointment rather than a walk-in.7Social Security Administration. By Mail
If you can’t get to an office, mail your completed Form SS-5 and original documents to your local field office. The SSA does return originals after processing, but you’re still putting your identity documents in the mail. Use a trackable method, and keep copies of everything you send.
Online
The SSA offers a limited online start. You can answer screening questions at ssa.gov, but for most divorce-related name changes you’ll still submit original documents in person or by mail.7Social Security Administration. When the Card Arrives
Allow 7 to 14 days for a new card to arrive by mail.5Social Security Administration. Your Social Security number stays the same. Only the name changes. Check the spelling against the decree the moment the card arrives, and contact your local office if there’s a typo. Once you’ve confirmed it’s correct, destroy the old card. A name change card doesn’t count toward the three-per-year or ten-per-lifetime replacement card limits.9Social Security Administration. Update Everything Else in the Right Order
Do Social Security first. Every other institution wants to see either the new card or a document that already reflects the SSA change, so working out of order creates mismatches.
Employer and W-2
Give your employer a copy of the new card so payroll updates. Wages reported under the wrong name cause IRS mismatches and, over time, could leave earnings unrecorded in your Social Security record.10Social Security Administration. IRS and Tax Returns
The IRS pulls names and SSNs straight from the SSA. File a return under a name the SSA hasn’t yet recorded and the IRS will bounce it. The IRS says to confirm that both your name and SSN match your Social Security card before filing.11Internal Revenue Service. Driver’s License or State ID
The DMV is usually next. Most states want the new Social Security card plus a certified copy of the decree. Some states handle it by mail; others require an in-person visit and a new photo. Fees typically run $5 to $30. The name on your new license must match your Social Security card exactly, so don’t try the DMV before the SSA is done.
U.S. Passport
Which form you use depends on when your current passport was issued. If it was issued less than a year ago, Form DS-5504 gets you a corrected passport at no charge.12U.S. Department of State. Banks and Financial Accounts
Each bank, card issuer, and investment firm has its own procedure, but the pattern is consistent: bring a government-issued photo ID and the certified decree. Many require an in-person visit. Joint accounts from the marriage may need both account holders present. Call ahead so you don’t make a wasted trip.
Everything Else
Insurance policies, retirement accounts, mortgage and lease documents, voter registration, and professional licenses all tie back to your legal name. Voter registration can often be updated when you renew your license. Professional licenses usually take a written request with a copy of the court order. Working through these after the SSA card and driver’s license are done prevents mismatches from surfacing months later.
