If you signed a Wyndham timeshare contract in 2018 and want out, the legal cooling-off period expired years ago, so canceling now means working one of four realistic exits: Wyndham’s own Certified Exit program, resale on the secondary market, negotiation through an attorney, or walking away and accepting the credit damage. Which route fits depends on whether your loan is paid off, whether your maintenance fees are current, and how much you’re willing to spend to be done with it. Here is how to cancel a 2018 Wyndham timeshare, path by path.
Why Rescission Is No Longer an Option
Every state gives timeshare buyers a short cooling-off period after signing, during which they can cancel for any reason and get a full refund. Depending on the state of purchase, that window runs from as few as three calendar days to as many as fifteen. For a 2018 contract, the deadline passed long ago.
One narrow exception is worth checking. State laws required the developer to hand you a public offering statement and clearly disclose your cancellation rights at closing. In some states, if the developer never provided that statement or failed to explain the rescission window, the cancellation deadline may not have started running. A few states give buyers up to a full year from the date they eventually receive the required disclosures. If your 2018 purchase file doesn’t include a signed acknowledgment that you received those documents, that gap could give you leverage. It’s rare, but it’s worth having an attorney review your original paperwork before you assume the window is closed.
Wyndham’s Certified Exit Program
The most direct route out is Wyndham’s own exit program. Certified Exit, which sits under the broader Wyndham Cares umbrella, connects owners with a dedicated exit specialist who walks through the available options at no cost for the consultation itself.1Wyndham Destinations. What’s available to you depends heavily on your loan status.
- If your loan is paid in full, you can return your ownership to Wyndham with no further obligation in as few as 90 days. You can also sell your interest on the secondary market with Wyndham’s support, or transfer ownership to an immediate family member for free.1Wyndham Destinations. Certified Exit Backed By Wyndham
- If a loan balance remains, you can list your property with a reseller and use the proceeds to pay off the loan. If you’re facing financial hardship from a personal tragedy, you can apply for a hardship exception. You can also ask about reducing your points or credits if you no longer need them all.1Wyndham Destinations. Certified Exit Backed By Wyndham

What to Have in Front of You Before Calling
Pull your original 2018 purchase documents first. The single most important piece of information is your contract number, which Wyndham uses as the primary reference for your account. Also confirm the exact purchase date, the home resort or points trust tied to your membership, whether you own a fixed week or points, and the exact names on the deed or contract. Mismatches between what you say on the phone and what’s in Wyndham’s records can stall the process.
Make sure your maintenance fees are paid through the current billing cycle, and have your most recent statement nearby. If you owe back fees, be ready to resolve them or discuss a payment plan with the specialist. If paperwork is mailed rather than handled by phone, send it certified mail with return receipt requested, and screenshot every confirmation screen if you use an online portal. When the transfer is complete, you should receive a final confirmation letter stating that the contract is terminated and all future financial obligations have ended.
Selling on the Secondary Market
If Wyndham’s deed-back isn’t offered to you, or you’d rather recoup something, resale is the alternative. The reality is sobering: Wyndham points routinely sell for a fraction of the original purchase price. Resale listings for major brands commonly appear at 50% to 70% below retail, and some sell for even less depending on the resort, season, and current maintenance fees.
Platforms like the Timeshare Users Group (TUG) marketplace, SellMyTimeshareNow, and RedWeek let owners list directly. Wyndham’s Certified Exit program can also connect you with a featured reseller.1Wyndham Destinations. Certified Exit Backed By Wyndham Price your listing against what comparable interests are actually selling for, not what you paid in 2018. Overpricing is the fastest way to guarantee the listing sits for months.
If a loan balance remains, the sale proceeds have to cover it at closing. If the resale price falls short, you’ll pay the difference out of pocket to clear the title. A licensed closing company typically handles the transfer paperwork and ensures the deed is properly recorded.
Hiring an Attorney
An attorney makes sense when the standard channels aren’t working, when you believe the developer violated consumer protection laws during the 2018 sale, or when a loan balance is complicating things and you need someone to negotiate for you. A timeshare attorney reviews the contract language, identifies disclosure failures or misrepresentations from the original sales presentation, and deals directly with Wyndham’s legal department.
Granting power of attorney shifts all communication to a professional channel and stops Wyndham from contacting you directly, which helps if customer service has been giving you the runaround. A successful negotiation ends in a formal settlement that terminates the 2018 contract and releases you from future liabilities.
Legal fees typically run from a few thousand dollars into the low five figures, depending on complexity and whether the matter requires litigation. Before you hire anyone, verify the bar license, check for disciplinary actions, and ask for references from former timeshare clients. This field is full of companies that call themselves “legal teams” without licensed attorneys actually handling the work.
What Happens If You Just Stop Paying
Frustrated owners sometimes consider walking away. This is where most people underestimate the fallout. Stopping payments does not make the obligation disappear. It triggers a cascade.
Missed maintenance fees or loan payments start the clock on late fees, interest, and internal collections. If delinquency continues, the account is referred to a third-party collection agency, and the collection appears on your credit report, where it can remain for up to seven years from the date of the original delinquency.3Office of the Law Revision Counsel. 15 USC 1681c – Requirements Relating to Information Contained in Consumer Reports A completed foreclosure may also be reported and typically drops a credit score by 100 points or more.
If the resort or lender forecloses and the sale doesn’t cover what you owe, you may face a deficiency balance. Whether the lender pursues a deficiency judgment depends on your contract and state law, but the possibility is real. Unpaid timeshare obligations can also affect your ability to get a mortgage, refinance, or qualify for favorable interest rates for years afterward. If you genuinely can’t afford the payments, Wyndham’s hardship exception is a better starting point, and at minimum you should talk to an attorney before you stop paying.
Avoiding Timeshare Exit Scams
The exit industry attracts an extraordinary number of scammers, and owners of older contracts are a prime target. The Federal Trade Commission has warned that many companies “guarantee” they can get you out of your timeshare, and these promises are often fraudulent. Some charge fees ranging from $5,000 to $80,000 and rarely deliver results.4Federal Trade Commission. Want to Get Rid of Your Timeshare? Read This Before You Hire Someone to Help
Watch for a few patterns. No legitimate company can guarantee a cancellation; the outcome depends on your contract, your state’s laws, and the developer’s willingness to negotiate. Scam operators demand thousands of dollars upfront before doing any work, while legitimate attorneys use clear retainer agreements that spell out what you’re paying for. Some outfits run high-pressure in-person presentations designed to make people sign on the spot.4Federal Trade Commission. Want to Get Rid of Your Timeshare? Before hiring anyone, search the company name along with “scam” or “complaint,” get every promise in writing, and ask about your right to cancel the exit company’s own contract. The FTC’s own advice is to start by contacting the timeshare company directly, since some have exit programs that let owners leave for a modest fee.4Federal Trade Commission. Tax Consequences You May Not Expect
Getting out of a timeshare can create a tax bill. Two issues come up most often.
Forgiven Debt Can Count as Income
If Wyndham or a lender forgives any portion of what you owe during the exit, the IRS generally treats the forgiven amount as taxable income. A lender canceling $600 or more of debt is required to send a Form 1099-C reporting the discharged amount.5Internal Revenue Service. Publication 4681 – Canceled Debts, Foreclosures, Repossessions, and Abandonments You’ll report it on your return for the year the cancellation occurs.
There’s an important exception. If your total liabilities exceeded the fair market value of all your assets immediately before the cancellation, you may qualify for the insolvency exclusion, which lets you exclude canceled debt from income up to the amount you were insolvent. You claim it by filing Form 982 with your federal return.6Office of the Law Revision Counsel. 26 USC 108 – Income From Discharge of Indebtedness A tax professional’s help is worth the cost here.
You Probably Can’t Deduct the Loss
If you surrender the timeshare for nothing or sell it for far less than you paid, you might assume the loss is deductible. In almost all cases, it isn’t. The IRS treats a loss on the sale of personal-use property as a nondeductible personal loss.7Internal Revenue Service. Capital Gains, Losses, and Sale of Home Since most timeshares are vacation properties, the loss doesn’t qualify. The exceptions involve timeshares used exclusively as rental property or for business, both of which require meeting IRS thresholds most vacation owners can’t satisfy.
If You Inherited the 2018 Contract Instead of Buying It
Some people trying to cancel a 2018 Wyndham timeshare didn’t sign it. They inherited it. If the original owner has died and you’re the heir, you have an option the buyer never had: refuse it outright.
Through a legal process called a disclaimer of interest, you formally decline the inherited timeshare and its obligations, typically by filing with the probate court handling the estate. The critical deadline in most states is nine months from the date of the original owner’s death. Miss that window and some states may treat your silence as acceptance.
One catch: you cannot use the timeshare at all before disclaiming. Don’t book a stay, don’t let a family member use it, don’t accept any benefit from the ownership. Once you’ve taken any benefit, courts generally treat the chance to disclaim as forfeited. Every person named as an heir or beneficiary who wants to refuse the timeshare has to file a separate disclaimer.
Many timeshare contracts include perpetuity clauses designed to pass obligations to the next generation. Those clauses can be alarming, but they don’t override your legal right to refuse an inheritance. If the disclaimer window has already closed, the standard exit options above apply to you as the new owner, and a probate attorney is worth consulting if the estate is complicated.
