To assume a mortgage, you contact the current loan’s servicer, submit an assumption application, pass the lender’s credit and income review, bring cash or secondary financing to cover the seller’s equity, and sign an assumption agreement at closing that transfers the loan — and ideally the liability — from the seller to you. Only certain loans allow this: FHA, VA, and USDA mortgages are generally assumable, while most conventional loans are not.
Confirm the Loan Can Actually Be Assumed
Before anything else, find out what kind of loan the seller has. Most conventional mortgages contain a due-on-sale clause that lets the lender demand the full balance when the property changes hands, and federal law backs the lender’s right to enforce it.1Office of the Law Revision Counsel. 12 USC 1701j-3 – Preemption of Due-on-Sale Prohibitions Narrow exceptions exist for transfers to a spouse, children, or an inheritor, but a standard third-party sale is not one of them.
Government-backed loans are the realistic candidates:
FHA Loans
All FHA-insured single-family forward mortgages are assumable.2U.S. Department of Housing and Urban Development. Are FHA-Insured Mortgages Assumable For loans closed on or after December 15, 1989, the lender must run a full credit review on you; skipping that review gives the lender grounds to accelerate the loan.3HUD. Chapter 7 – Assumptions The FHA mortgage insurance stays in force and transfers to you, and the seller gets no refund of premiums already paid.4HUD. FHA Homeowners Fact Sheet
VA Loans
Anyone can assume a VA loan, including a non-veteran, but you still have to qualify from a credit standpoint as if you were applying for a new VA-guaranteed loan in the amount of the unpaid balance.5Office of the Law Revision Counsel. 38 USC 3714 – Assumptions; Release From Liability The VA sets no minimum credit score, but most lenders look for at least 620.6Veterans Affairs. VA Home Loan Guaranty Buyers Guide A 0.5% funding fee on the loan balance applies to the assumption.7Veterans Affairs – VA.gov. VA Funding Fee and Loan Closing Costs If the seller is a veteran and you are not, their entitlement stays tied up in the property until the loan is paid off, which matters to them, not you — but it may affect whether they agree to proceed.8Veterans Affairs. VA Circular 26-23-10 – Assumption Types
USDA Loans
USDA Section 502 guaranteed loans can be assumed, but you have to meet all of the original program requirements, including income limits and the rural-area location rule.9eCFR. 7 CFR 3555.256 – Transfer and Assumptions The lender has to send USDA Rural Development a written request with the underwriting analysis and get the agency’s approval before the transfer closes. One warning for the seller: under USDA rules, the original borrower generally stays personally liable for the debt even after the assumption goes through.
Plan How You’ll Cover the Seller’s Equity
An assumption transfers the remaining loan balance, not the home’s full value. If the house is worth $350,000 and the loan balance is $200,000, you still owe the seller $150,000 for their equity. On a home where someone has been paying down a mortgage for a decade, that gap is often the real obstacle.
Three ways to bridge it:
- Pay cash at closing for the full equity amount.
- Take out a second mortgage. You then make two monthly payments, and the second loan will typically carry a higher rate than the one you assumed.
- Ask the seller to carry a note for part of the equity and accept payments over time.
If you’re assuming an FHA loan, any secondary financing has to have clearly defined repayment terms, and the lender will count that payment in its underwriting of whether you can afford the total obligation.3HUD. Chapter 7 – Assumptions A second loan doesn’t just add a payment; it changes whether you qualify.
Gather What the Lender Will Require
Expect the lender to look at you the way it would look at a brand-new borrower. Pull together:
- Recent pay stubs and proof of current income
- W-2s or tax returns for the last two years
- Bank statements showing liquid funds for closing costs and the equity payment
- A full list of your monthly debts
- Written authorization for a credit pull
Credit expectations depend on the loan. FHA assumptions can go through with scores as low as 580; VA and conventional-overlay thresholds generally start at 620.6Veterans Affairs. VA Home Loan Guaranty Buyers Guide On debt-to-income, FHA typically looks for 43% or lower (higher with compensating factors), USDA targets 41% or lower, and VA uses a residual-income analysis instead of a hard cap.
If the assumption stems from a divorce or legal separation, include a certified copy of the decree or settlement agreement. Employer verification forms are commonly required. A short written explanation of recent credit inquiries or unusual deposits can save back-and-forth with the underwriter.
Submit the Application to the Servicer
Call the loan servicer — the company the current borrower sends payments to — and request an assumption application package. You’ll need the property address and the existing loan number from a recent statement. Many servicers accept submissions by certified mail with return receipt; some have secure online portals.
Plan on paying a processing fee when you submit. FHA lenders can charge up to $1,800 for assumption processing.10HUD. FHA INFO 2024-30 – FHA Publishes Updates to Single Family Housing Policy Handbook VA assumptions carry the 0.5% funding fee on the remaining balance.7Veterans Affairs – VA.gov. VA Funding Fee and Loan Closing Costs
For FHA assumptions, the lender has to complete its creditworthiness review within 45 days of receiving all required documents.11HUD. Chapter 4 – Credit Underwriting VA and USDA timelines run longer when agency sign-off is in the chain. During review, the underwriter verifies employment, checks for undisclosed liens or judgments, and confirms the property’s taxes and insurance are current. If they need more from you, respond quickly; delays here can expire the file.
Close and Get the Seller Released From Liability
Once the lender approves, everyone signs the assumption agreement at closing. That document binds you to the original promissory note and mortgage. The single most important thing to confirm at this stage is that the seller gets a formal release of liability.
For FHA loans closed after December 15, 1989, the lender is required to prepare the release once you are found creditworthy and sign the assumption agreement; HUD Form 92210.1 is the document that formally releases the seller.3HUD. Chapter 7 – Assumptions For VA loans, the original borrower is relieved of liability to the VA once you are contractually obligated to the debt and have qualified from a credit standpoint, provided the loan is current at the time of transfer.5Office of the Law Revision Counsel. 38 USC 3714 – Assumptions; Release From Liability USDA guaranteed loans work differently; the original borrower generally stays personally liable after the transfer.9eCFR. 7 CFR 3555.256 – Transfer and Assumptions Without a release, the lender can still come after the seller if you default later. Sellers should refuse to close without one where the loan allows it.
Closing also involves signing and recording the deed with the county recorder’s office to put the ownership change on the public record. Recording fees vary by jurisdiction.
If the Lender Denies Your Application
Under the Equal Credit Opportunity Act, a denial must come with written notice that either states the specific reasons or discloses your right to request them within 60 days.12eCFR. 12 CFR Part 1002 – Equal Credit Opportunity Act, Regulation B Vague language about failing to meet “internal standards” doesn’t satisfy the rule. The lender has to identify the principal factors, such as insufficient income, excessive debt, or credit history.
For a VA loan, if the lender finds the loan is not current or that you don’t meet the credit requirements, you can appeal the decision to the Department of Veterans Affairs, which will conduct its own review.5Office of the Law Revision Counsel. 38 USC 3714 – Assumptions; Release From Liability
Tax Basis and the Interest Deduction
When you buy by assumption, your tax basis in the home equals the cash you paid plus the mortgage balance you took on. Pay $50,000 in cash and assume a $200,000 loan, and your basis is $250,000.13Internal Revenue Service. Publication 551 – Basis of Assets That number sets how much of the eventual sale price counts as taxable gain.
You can still deduct the mortgage interest you pay on the assumed loan, provided the mortgage is secured debt on a qualified home you own and occupy and you itemize deductions.14Internal Revenue Service. Publication 936 – Home Mortgage Interest Deduction Assuming the debt rather than originating a new loan doesn’t change the deduction. Transfer taxes at recording vary widely by state and locality; ask the title company for the figure in your jurisdiction before you sit down to close.
