If you’re on an H1B visa in the United States, you can apply for Canadian permanent residence through Express Entry without leaving your job or surrendering your status. Your H1B employment counts as qualifying skilled work experience, most applicants file under the Federal Skilled Worker Program, and the full process typically runs six to twelve months from creating a profile to landing in Canada. One step catches many H1B holders off guard: before you physically leave the U.S., you’ll need to obtain a tax clearance from the IRS.
The Program You’ll Most Likely Use
Express Entry manages applications for three federal economic immigration programs, but only one is realistic for an H1B holder who has never worked in Canada.1Government of Canada. Express Entry
The Federal Skilled Worker Program is the default pathway. It accepts foreign work experience, so your years on H1B in the U.S. qualify. You need at least one continuous year of full-time paid work (or the part-time equivalent of 1,560 hours) within the last ten years, in an occupation classified under NOC TEER 0, 1, 2, or 3.2Immigration, Refugees and Citizenship Canada. The Canadian Experience Class requires at least one year of skilled work performed inside Canada under valid temporary status.3Immigration, Refugees and Citizenship Canada. The Federal Skilled Trades Program applies to a specific set of trade occupations and rarely fits H1B professionals.
Why STEM Workers Have an Extra Path
Canada runs category-based Express Entry draws that invite candidates in targeted occupations, often at lower CRS cutoffs than general draws. STEM is one of the standing categories. You qualify if you have at least 12 months of full-time work (or the part-time equivalent) within the past three years in a designated STEM occupation.4Government of Canada. The eligible list includes cybersecurity specialists, civil engineers, mechanical engineers, electrical and electronics engineers, industrial and manufacturing engineers, and several engineering technologist occupations. IRCC can update the list through ministerial instructions before any round, so check the current list against your NOC code before you build your profile. If your occupation is on it, make sure your profile reflects the matching NOC exactly.
What You Need to Qualify
Language Test Results
You’ll take an approved English or French test. Accepted English tests are IELTS General Training, CELPIP General, and PTE Core.5Immigration, Refugees and Citizenship Canada. Educational Credential Assessment
If you were educated outside Canada, you need an ECA to confirm your degree is equivalent to a Canadian credential. Five designated organizations issue ECAs for immigration purposes, and World Education Services is the one most U.S.-based applicants use.6Government of Canada. Work Experience That Matches an NOC Code
Your H1B job description needs to align with the lead statement and main duties of the NOC code you claim. This is the single most common place applications go wrong. Your employer reference letter should state your title, dates of employment, hours per week, salary, and duties, and those duties should track the NOC description. Volunteer work and unpaid internships don’t count.
Settlement Funds
Federal Skilled Worker applicants must show liquid funds to support themselves and their family after arrival. You’re exempt if you have a valid Canadian job offer or are applying under the Canadian Experience Class.7Immigration, Refugees and Citizenship Canada. Cutoffs move draw to draw. General rounds in early 2026 have invited thousands per draw; category-based draws for French proficiency have gone as low as 393.10Government of Canada. Express Entry – Rounds of Invitations Check recent results to gauge your position.
If your score sits below likely cutoffs, the largest single lever is a provincial nomination, which adds 600 CRS points and effectively guarantees an invitation. Every province runs its own nominee program, many with streams linked directly to Express Entry, and several actively recruit tech and healthcare workers. Requirements vary, and provinces often look for a connection through a job offer, past work in the province, or an in-demand occupation. Research the streams you might qualify for early, because a nomination can take months on its own.
Smaller levers include retaking your language test for a higher band, adding a year of experience before submitting, or improving French if you have any foundation to build on. Your profile remains active in the pool for 12 months, and you can create a fresh profile if it expires without an invitation.
Documents to Start Gathering Now
Several documents take weeks or longer to arrive, and some have validity windows short enough that ordering too early is as bad as ordering too late.
FBI Identity History Summary. Canada requires police certificates from every country where you’ve lived for six consecutive months or more since age 18.11Immigration, Refugees and Citizenship Canada. Immigration medical exam. An IRCC-approved panel physician must conduct it. Results are valid for 12 months, so time it to your expected submission window.13Government of Canada. Medical Examination for Permanent Residence Applicants Costs typically run $200 to $450 depending on the clinic.
Employer reference letters. Get these from current and previous employers, with title, dates, hours per week, salary, and duties spelled out. The duties must match your claimed NOC.
Everything else. Your ECA report, language test results sent directly to IRCC, bank letters showing settlement funds, a valid passport (plus older ones showing travel history), birth and marriage certificates as applicable, and digital photos meeting IRCC specifications.
The Application Sequence
Create your Express Entry profile on the IRCC website with your personal information, education, language scores, and work history. Once you’re in the pool, your profile is scored and ranked. You can update it any time your circumstances change: new language results, another year of experience, a provincial nomination.
When a draw cutoff meets your score, you receive an Invitation to Apply, and a firm 60-day clock starts. Within those 60 days you must submit a complete electronic Application for Permanent Residence with every supporting document uploaded and fees paid.15Government of Canada. Check every entry in your application against your source documents. Mismatches between profile answers and supporting evidence are one of the most common triggers for refusal.
What It Costs
Government fees for a principal applicant include:
- Processing fee: $950 CAD

Total for a single applicant is $1,610 CAD before April 30, 2026, and $1,635 CAD after. A spouse or dependent adds their own processing fee and RPRF. Outside government fees, expect roughly $200 to $300 CAD for the ECA, $300 to $400 CAD for the language test, $18 USD for the FBI check, and $200 to $450 for the medical exam.
After Submission
IRCC will request biometrics at a designated collection point in the U.S. If you haven’t done your medical yet, they’ll send instructions. Officers may request additional documents during processing. On approval, IRCC mails you a Confirmation of Permanent Residence and, if applicable, a permanent resident visa. Check the COPR carefully. Handle U.S. Tax Clearance Before You Leave
Most Canadian immigration guides skip this. Before permanently departing the United States, most H1B holders must obtain a tax clearance document from the IRS, called a sailing permit (also known as a departure permit or certificate of compliance). You file either Form 2063 or Form 1040-C with your local IRS office. Form 2063 is the simpler option, available if you had no taxable income for the current year through your departure date and the preceding year, or if you did have taxable income but the IRS determines your departure won’t hinder tax collection. Apply at least two weeks before your planned departure and no earlier than 30 days before that date. IRS appointments fill up, so book early.20Internal Revenue Service. Skipping these steps can create serious complications if you ever need to return or have remaining financial obligations in the U.S.
Keeping Your Status After You Land
Landing as a permanent resident isn’t the finish line. To keep PR status, you must be physically present in Canada for at least 730 days in every five-year period. Those days need not be consecutive, but falling short can cost you your status.22Government of Canada.
