To add your spouse to your VA benefits, file VA Form 21-686c, the Application Request to Add and/or Remove Dependents, along with your marriage certificate and any records of prior marriages. If your combined disability rating is 30% or higher, approval increases your monthly compensation and can open the door to health coverage and education assistance for your spouse. Straightforward online filings are sometimes decided within 48 hours.
Who Qualifies
Two things have to be true: you receive disability compensation at a combined rating of 30% or more, and you are legally married. Below 30%, the VA does not pay additional compensation for dependents at all.1Veterans Affairs. Current Disability Compensation Rates
The VA recognizes any marriage that was valid under the law of the place where you or your spouse lived at the time of the ceremony, including same-sex marriages regardless of where you now live. Common-law marriages count only if the state where you reside recognizes them and you meet that state’s requirements.2U.S. Department of Veterans Affairs. Important Information on Marriage
There is also a narrower provision for marriages that had a legal impediment, such as a prior divorce that was never properly finalized. If your spouse entered the marriage in good faith without knowing about the problem, and the two of you lived together continuously, the VA may treat the marriage as valid.3eCFR. 38 CFR 3.52 – Marriages Deemed Valid
How Much Your Payment Increases
The bump depends on your rating. These are the 2026 figures (effective December 1, 2025) for a veteran adding a spouse with no other dependents:4U.S. Department of Veterans Affairs. Current Veterans Disability Compensation Rates
- 30% rating: $65.00 more per month ($617.47 total)
- 50% rating: $109.00 more per month ($1,241.90 total)
- 70% rating: $153.00 more per month ($1,961.45 total)
- 100% rating: $219.59 more per month ($4,158.17 total)
The amounts go higher if you also have dependent children or dependent parents. The VA publishes a full rate table covering every combination.
Documents to Gather Before You File
For yourself, you will list your full name, date of birth, Social Security number, and VA file number. For your spouse, you will provide the same personal details plus the date and location of your marriage.5Veterans Affairs. About VA Form 21-686c
If either of you was married before, have divorce decrees or death certificates on hand along with the former spouse’s name and the dates the prior marriage began and ended. You will also need your current marriage certificate.
Common-law marriages need extra proof because there is no certificate. The VA uses Form 21-4170, the Statement of Marital Relationship, to evaluate these claims.6Veterans Benefits Administration. VA Form 21-4170 – Statement of Marital Relationship Supporting evidence includes joint leases, shared bank statements, jointly filed tax returns, insurance forms listing your spouse, and utility bills showing a shared address. More documents showing you have held yourselves out as married means a stronger claim.
How to File Form 21-686c
You have three ways to submit the form:
- Online through VA.gov, using a verified Login.gov or ID.me account. This is the fastest route and the one most likely to be decided quickly.7Veterans Affairs. Signing In to VA.gov
- By mail to the Department of Veterans Affairs, Evidence Intake Center, PO Box 4444, Janesville, WI 53547-4444.8Department of Veterans Affairs. VA Form 21-686c
- In person at a VA regional office, where staff can help you review the packet before submitting.
Whichever way you file, keep copies of the completed form and everything you send. If the VA follows up months later, your own records make the difference.
What Happens After You File
The VA reviews your application to verify eligibility and confirm the marriage. Clean online cases (clear marriage certificate, no prior marriages complicating things) are sometimes processed in as little as 48 hours.9Department of Veterans Affairs. Filing an Online Dependency Claim Frequently Asked Questions More complex ones take longer. VA disability-related claims averaged 76.6 days in early 2026, though dependency-only claims tend to move faster than initial disability claims.10Veterans Affairs. The VA Claim Process After You File Your Claim
Delays usually trace back to one of three problems: missing information on the application, inconsistencies in the documents, or a request for more evidence (common with common-law claims). If the VA asks for more information, respond quickly. Waiting adds weeks or months.
Retroactive Pay and the One-Year Deadline
File within one year of your marriage and the VA may pay you back to the actual marriage date, provided you already had a 30% or higher rating then. You also need to respond within a year to any VA request for additional evidence. Miss that window and the VA typically pays back only to the date it received your claim, or in some cases up to a year before that date.11Veterans Affairs. Manage Dependents for Disability, Pension, or DIC Benefits A veteran rated 100% who waits 14 months after marrying loses roughly $219 per month of retroactive pay for every month beyond the deadline.
If Your Claim Is Denied
A denial letter explains the reason and lists your review options: a Supplemental Claim (submit new evidence), a Higher-Level Review (a senior reviewer looks at the same file, no new evidence allowed), or a Board Appeal before a Veterans Law Judge.12Veterans Affairs. Choosing a Decision Review Option For a dependency denial, a Supplemental Claim with an added affidavit or missing document is usually the practical first move.
Health Care for Your Spouse
Adding your spouse for compensation purposes does not enroll them in VA health coverage. That is a separate application. If you are rated permanently and totally disabled from a service-connected condition, your spouse may qualify for CHAMPVA, the Civilian Health and Medical Program of the Department of Veterans Affairs.13Veterans Affairs. CHAMPVA Guidebook The word “permanently” matters. A 100% rating the VA considers temporary does not qualify.
Your spouse also cannot be eligible for TRICARE and qualify for CHAMPVA at the same time. To apply for CHAMPVA, file VA Form 10-10d, which can be completed online or on paper.14Veterans Affairs. About VA Form 10-10d
Education Benefits for Your Spouse
Two programs may be available, each with its own rules.
Survivors’ and Dependents’ Educational Assistance (Chapter 35 DEA)
If you are permanently and totally disabled from a service-connected condition, your spouse can use DEA benefits for degree programs, certificate courses, apprenticeships, and on-the-job training. Divorce ends the eligibility. If you die and your spouse remarries, DEA benefits generally end, with limited exceptions for remarriages after age 57 or remarriages that later end.15Veterans Affairs. Survivors’ and Dependents’ Educational Assistance
Post-9/11 GI Bill Transfer
If you are still serving, you can transfer unused Post-9/11 GI Bill benefits to your spouse. You must have completed at least six years of service when your transfer request is approved, and you commit to four more. Purple Heart recipients are exempt from the service requirement but must request the transfer while still on active duty.16Veterans Affairs. Transfer Your Post-9/11 GI Bill Benefits
Report Changes Right Away
Once your spouse is on your benefits, you are responsible for reporting anything that changes their eligibility, and divorce is the big one. The VA recommends reporting a divorce as soon as possible. Continuing to collect at the dependent rate after a marriage ends creates an overpayment, and the consequences build fast.9Department of Veterans Affairs. Filing an Online Dependency Claim Frequently Asked Questions
The VA first offsets the debt against future payments, shrinking your monthly check until it is recovered. If you do not resolve the debt or request help in time, the VA can report it to credit agencies, add interest, and refer it to the U.S. Treasury, which can then garnish tax refunds, Social Security, and federal salary or retirement payments.17Veterans Affairs. Free Help From a VSO
An accredited Veterans Service Organization representative can walk you through the process or file the claim for you at no cost.18Veterans Affairs. Get Help From a VA Accredited Representative or VSO Use the VA’s online search tool to find one near you, then complete VA Form 21-22 to formally appoint them. VSOs are especially useful for common-law marriage documentation and for claims involving prior marriages, where a single missing record can stall the file for months.
