How TANF Transaction Restrictions Work at Prohibited Venues

If you receive TANF cash assistance, your EBT card cannot be used at three types of businesses under federal law: liquor stores, casinos or other gaming establishments, and adult entertainment venues where performers disrobe. The Three Types of Businesses You Can’t Use TANF EBT At

Each category is defined by the business’s primary purpose, not by whether it happens to sell a restricted product on the side.

  • Liquor stores: retail establishments that sell intoxicating liquor as their exclusive or primary product.
  • Casinos and gaming establishments: businesses whose principal purpose is offering games of chance or wagering.
  • Adult entertainment venues: retail establishments where performers disrobe or perform unclothed for entertainment.

Places That Look Prohibited but Aren’t

A grocery store that sells beer and wine is not a liquor store under the federal definition, even if the alcohol aisle is large. A restaurant with a handful of slot machines in the corner is not a gaming establishment if gambling is incidental to the main business. The carve-outs matter because many communities have limited retail options. Cutting off EBT access anywhere alcohol or gambling is present would shut recipients out of ordinary grocery shopping. The line is drawn at businesses that exist primarily to sell liquor, host gambling, or provide adult entertainment.

What Kinds of Transactions Are Blocked

The restriction covers every electronic interaction between a TANF card and a merchant’s payment hardware at a prohibited location. That means point-of-sale purchases, ATM cash withdrawals, and online systems used to process a payment or withdraw funds through a terminal at the venue.4Administration for Children and Families. The trigger is where the terminal sits, not what you plan to do with the money. An ATM in a casino lobby is off-limits even if you intend to walk out and spend the cash on groceries. States cannot carve out exceptions for ATMs or registers that happen to be inside a prohibited venue; the federal agency that administers TANF has said it will reject state plans that try.4Administration for Children and Families. One thing the rule does not do: restrict what you buy with cash once you’ve withdrawn it from a permitted ATM. TANF cash is not item-restricted the way SNAP is. Once the money is in your pocket, federal law does not dictate how you spend it.

The federal rule also does not reach the internet. The Department of Health and Human Services concluded that terms like “establishment,” “store,” and “located in a place” point to brick-and-mortar businesses, so the federal mandate does not require states to block online gambling sites, digital liquor delivery, or adult subscription services from taking EBT payments. Using Your Card Out of State

The restriction follows the cardholder, not the state line. If you receive TANF in one state, you still cannot use the card at a casino, liquor store, or adult venue in another. Enforcement across state lines is limited in practice because each state runs its own EBT blocking systems independently, and HHS considers it enough for a state to notify recipients that the rule extends out of state.5Federal Register. The gap in the technology does not make the transaction legal. A recipient who uses an out-of-state casino ATM because the system did not automatically reject it can still face consequences from their home state.

Why a Transaction Might Go Through Anyway

The blocking system is not airtight. Every merchant is assigned a merchant category code identifying its business type, and in theory the payment network can reject a TANF swipe at a coded prohibited business. A Government Accountability Office review found the system falls short in several ways. Many ATMs transmit a generic “financial institution” code rather than a code tied to the business hosting the machine. Third-party processors do not always verify the business type and location. States fill the gaps with a mix of methods: disabling EBT on specific identified terminals, using category codes where the data is trustworthy, and auditing transaction logs after the fact to catch violations that slipped through. Do not read a successful swipe as approval. A transaction that clears at a prohibited location can still be flagged later and reviewed.

What Happens If You Use Your Card at a Prohibited Venue

State responses vary. Some treat a prohibited-venue transaction as an overpayment and pursue repayment. Others impose temporary disqualification from the program. A few classify repeated violations as intentional program violations, which can bring longer disqualification periods.4Administration for Children and Families. When overpayment recovery is used, states generally either reduce your future monthly benefit until the debt clears or accept lump-sum or periodic cash repayment.4Administration for Children and Families. Q and A: TANF Requirements Related to EBT Transactions Whether a first offense triggers a warning or an immediate penalty depends entirely on your state’s rules, so the specific schedule to check is the one published by your state TANF agency.

Challenging a Violation You Think Is Wrong

If you have been penalized for a transaction you believe was legitimate, you can contest it. Federal rules require states to offer a fair hearing before benefits are reduced or terminated. Deadlines to request a hearing vary; 30 days from the date of the agency’s action is a common window.

Merchant category code errors are a realistic ground for challenge. The GAO found that merchant coding data is inconsistent, so a store that is not actually a liquor store or gaming establishment can end up flagged as one.6Government Accountability Office. System errors and transaction disputes usually start with the state’s EBT help desk or customer service line. If that route does not resolve the problem, you can request a formal fair hearing through the state agency. Keep receipts, and note the exact name and address of the business involved; that information is what makes a miscoding argument work.

TANF and SNAP Are Not the Same on the Card

Both benefits often load onto the same EBT card, and the rules are different. SNAP restricts what you can buy at the item level (no alcohol, no tobacco, no hot prepared foods) but does not restrict venues in the way TANF does, and SNAP funds cannot be pulled out as cash.7Food and Nutrition Service.
