How Soon Can You Refinance a VA Loan: The 210-Day, Six-Payment Rule

You can refinance a VA loan into another VA loan once two conditions are both met: at least 210 days have passed since your first monthly payment on the existing loan, and you have made at least six monthly payments. Closing happens on whichever of those dates falls later. If your current mortgage is not a VA loan and you want to refinance it into a VA cash-out loan, that waiting period does not apply, and how soon you can refinance a VA loan comes down to the lender’s underwriting timeline rather than a federal seasoning rule.

The 210-Day, Six-Payment Rule

Federal regulations set a mandatory wait before the VA will guarantee a refinance that pays off an existing VA-guaranteed mortgage. The rule applies to both VA refinance products when the loan being replaced is itself a VA loan.1eCFR. 38 CFR 36.4306 – Refinancing of Mortgage or Other Lien Indebtedness

Two clocks run at once. The first starts on the date of your first monthly payment and has to reach day 210. The second counts actual payments and has to reach six. You close on whichever milestone arrives second.

Say you make your sixth payment on day 180. You still cannot close until day 211. Flip it: if your sixth payment lands on day 220, that later date controls, even though 210 days have already come and gone. The regulation uses the phrase “the date on which the sixth monthly payment is made,” so the payments have to actually be made, not merely due.1eCFR. 38 CFR 36.4306 – Refinancing of Mortgage or Other Lien Indebtedness Missed or deferred payments push the earliest closing date back.

The point of the rule is to block loan churning, the practice of pushing veterans into back-to-back refinances that produce fees without producing savings.

When the Waiting Period Does Not Apply

If your current mortgage is conventional, FHA, or USDA and you want to refinance it into a VA cash-out loan, the 210-day and six-payment requirements are off the table. The VA’s cash-out refinance user guide limits the seasoning certification to VA-to-VA refinances.2Veterans Benefits Administration. Cash-Out Refinance User Guide The regulation says the same thing: for a cash-out loan where the new amount exceeds the payoff, the waiting period “applies only when the loan being refinanced is a VA-guaranteed or insured loan.”1eCFR. 38 CFR 36.4306 – Refinancing of Mortgage or Other Lien Indebtedness

You still have to clear a full credit review, an appraisal, and the net tangible benefit test. But nothing in the federal rules holds you to a minimum age on the loan you’re paying off.

Which VA Refinance You’re Using

The deadline hits both VA refinance products the same way, but the products themselves differ, and that matters once you start timing an application.

The Interest Rate Reduction Refinance Loan, or IRRRL, is sometimes called a streamline. It replaces one VA loan with another to lower the rate or convert an adjustable-rate loan to a fixed rate. It only works VA-to-VA. Because it is a rate-and-term swap, the VA waives the appraisal and the paperwork load is lighter.3Veterans Benefits Administration. Appraisal Assignment Waterfall

The VA cash-out refinance lets you borrow more than the payoff balance and take the difference in cash, up to 100% of the appraised value. It can refinance a VA loan or a non-VA loan into a new VA-guaranteed mortgage. A full appraisal, income verification, and credit review are required.4Veterans Benefits Administration. Other Rules That Can Push the Date Back

Clearing the 210 days and six payments gets you to the earliest possible closing. Several other requirements can delay it further.

Net Tangible Benefit and Recoupment

The VA requires proof the refinance actually helps you. For an IRRRL, every fee, cost, and expense rolled into the new loan has to be recouped through monthly payment savings within 36 months. The lender divides total costs by the monthly payment reduction. If the break-even point sits beyond three years, the loan does not qualify.

Minimum Rate Reduction

Refinancing one fixed-rate loan into another through an IRRRL requires the new rate to be at least 50 basis points below the old rate. Going from a fixed rate to an adjustable rate requires at least 200 basis points.5Federal Register. Loan Guaranty: Revisions to VA-Guaranteed or Insured Interest Rate Reduction Refinancing Loans If rates have not moved far enough, the refinance will not clear the test no matter how long you have waited.

The rate-reduction requirement is waived when you move from an adjustable-rate mortgage to a fixed-rate loan. The new rate can be higher. The lender still has to show that the fixed rate serves your financial interests over the life of the loan.6Veterans Benefits Administration. Refinancing Loans

Occupancy

A cash-out refinance requires that you currently occupy the home as your primary residence.7Veterans Benefits Administration. VA Loan Purposes, Types, and Refinance Comparison An IRRRL only requires that you previously occupied the home, so veterans who have since moved can still use it on the old property.8United States Department of Veterans Affairs. Second Mortgage Subordination

If you have a second mortgage or a HELOC, that lender has to agree to subordinate so the new VA loan sits in first-lien position. Credit, Income, and Appraisal

The VA does not set a minimum credit score, but most lenders impose one, typically around 620.9Veterans Benefits Administration. You will also need a Certificate of Eligibility confirming your remaining entitlement. You can download it through eBenefits or have the lender pull it electronically.11Veterans Affairs. How to Request a VA Home Loan Certificate of Eligibility (COE)

The Three-Day Wait After Closing

Closing the loan is not the moment the money moves. The Truth in Lending Act gives you a right to cancel a refinance on your primary residence until midnight of the third business day after closing, delivery of the rescission notice, or delivery of all material disclosures, whichever happens last.12Consumer Financial Protection Bureau. 1026.23 Right of Rescission No funds are disbursed until that window closes. If you refinance with the same lender you already have, rescission applies only to any new money borrowed above the existing balance, so it covers the cash-out portion but not the balance transfer. Plan on a few extra days before any cash-out proceeds reach you.

Putting the Timeline Together

If you have a VA loan now and want to refinance it, count forward from your first payment and from the sixth payment, then take the later date. That is the earliest the loan can close, assuming the rate math, occupancy, and credit all line up. If you have a conventional, FHA, or USDA loan and want to move into a VA cash-out, the seasoning rule drops out and your timeline is set by underwriting, appraisal, and any second-lien subordination you have to arrange.
