If you lost work because of a major disaster, you have 60 days to apply for Disaster Unemployment Assistance. The deadline runs from the date of the presidential disaster declaration, or from the date Individual Assistance is designated for your area, whichever is later. The change aligned the DUA filing period with the 60-day deadline that already applied to FEMA’s Individuals and Households Program, so survivors applying to both programs now work from a single clock.3National Association of Counties. How the 60-Day Clock Works
The Department of Labor spelled out the operational details in Unemployment Insurance Program Letter 03-25, issued December 2, 2024. A few practical points matter if you are counting days:
- If the 60th day falls on a weekend or legal holiday, the deadline automatically rolls to the next business day.
- If FEMA extends the Individuals and Households Program registration deadline for your disaster, the DUA filing deadline is automatically extended to match.
- If your county is added to the disaster declaration after the initial 60-day period has started running, the state must request a separate extension for the newly designated area.

Filing Late With Good Cause
The law also created a formal path for late applications. The President may accept a DUA application filed after the 60-day deadline if the applicant shows good cause for the delay and files before the overall Disaster Assistance Period for that disaster ends.5Congress.gov. S.1858 – Full Text In practice, this means a late filing is possible but not automatic; you have to explain the delay, and your state agency will evaluate the claim.
Who Qualifies for DUA
DUA is a federally funded program authorized by the Stafford Act and run by state unemployment agencies under Department of Labor oversight in coordination with FEMA. It is meant to fill gaps left by regular unemployment insurance: workers who qualify for standard state UI benefits are not eligible for DUA. To qualify, you must have lived, worked, or been scheduled to work in the disaster area, and you must show the disaster directly caused your job loss or work interruption, whether by destroying your workplace, making it unreachable, or causing a disaster-related injury. Benefits are available for up to 26 weeks after the presidential declaration, with weekly amounts set by state law at no less than 50 percent of the state’s average weekly benefit.6U.S. Department of Labor. Because you must first file for regular state unemployment insurance and be found ineligible before DUA benefits are paid, do not wait to start that process. The 21-Day Documentation Deadline After You File
Filing on time is only the first deadline. Once you apply, you have 21 days to submit proof of employment and earnings. For self-employed workers, that can mean tax records, business documents, or contracts, and the burden is heavier when those records were themselves damaged or destroyed in the disaster.7National Employment Law Project. Which Disasters the New Deadline Covers
The 60-day window applies to disasters declared on or after March 23, 2024. It supersedes the old 30-day rule at 20 CFR 625.8(a) for those declarations.1U.S. Department of Labor.
