You have to be 18 to legally buy a vape in the UK. The Nicotine Inhaling Products (Age of Sale and Proxy Purchasing) Regulations 2015 make it a criminal offence to sell nicotine-containing vapes to anyone under that age,1legislation.gov.uk. The Nicotine Inhaling Products (Age of Sale and Proxy Purchasing) Regulations 2015 – Explanatory Memorandum and the Tobacco and Vapes Bill will extend that restriction to all vaping products regardless of nicotine content.2UK Parliament. Tobacco and Vapes Bill One important caveat sits alongside the age rule: single-use disposable vapes have been banned outright across the UK since 1 June 2025, so no shop can legally sell them to anyone of any age.3GOV.UK. Which Vapes the 18 Rule Applies To
The 2015 Regulations define “nicotine inhaling products” broadly, covering disposable and rechargeable e-cigarettes, refill cartridges, and nicotine-containing e-liquids.1legislation.gov.uk. There is a gap in the current law. The 2015 rules specifically target nicotine products, so nicotine-free vapes and 0mg e-liquids were not clearly caught. The government announced a review to close that loophole,5GOV.UK. No More Free Vapes for Kids and the Tobacco and Vapes Bill does so by making it an offence to sell any “vaping product or nicotine product” to someone under 18.2UK Parliament. Disposable Vapes Are Banned for Everyone
Since 1 June 2025, it has been illegal to sell, supply, or stock single-use vapes anywhere in the UK.3GOV.UK. Single-Use Vapes Banned From 1 June 2025 The ban applies in all four nations. England enacted it through the Environmental Protection (Single-use Vapes) Regulations 2024,6legislation.gov.uk. The Environmental Protection (Single-use Vapes) (England) Regulations 2024 and Scotland, Wales, and Northern Ireland introduced matching legislation under their own environmental powers.7Scottish Government. Single Use Vape Ban Comes Into Force
If you are 18 or over and want to keep vaping legally, you need a reusable device: refillable or with a replaceable pod, and rechargeable rather than throwaway. Anything designed to be used once and binned is off the market.
Proving Your Age at the Till
Most vape retailers operate a “Challenge 25” policy, meaning staff will ask for proof of age from any customer who looks under 25. Three forms of ID are widely accepted: a passport, a photocard driving licence, and a proof-of-age card carrying the PASS (Proof of Age Standards Scheme) hologram. Expect to be asked, even if you are well over 18, because staff who fail to challenge young-looking customers risk enforcement action against the shop.
Online purchases follow the same 18 rule. Reputable online vape retailers use third-party age verification services at checkout and require an adult signature on delivery. The Tobacco and Vapes Bill has not yet set out a specific online verification method, and the detailed requirements are expected in secondary legislation.8GOV.UK. If You Are Under 18
UK vaping law puts the legal burden on sellers and adult proxy buyers, not on the young person using the product. It is not a criminal offence for someone under 18 to possess or use a vape. A teenager found with one will not be prosecuted or fined. Schools and parents deal with it through their own rules, which tend to bite harder in practice anyway.
Police retain longstanding powers under the Children and Young Persons Act 1933 to seize tobacco from anyone under 16 smoking in a public place.9legislation.gov.uk. Children and Young Persons Act 1933 – Section 7 Those powers were written for tobacco and cigarette papers, not vapes, and only apply to under-16s. Whether they extend to confiscating a vape is not settled, though officers may still take a device in practice.
Buying a Vape for Someone Under 18
Even if you are legally allowed to buy vapes yourself, doing so on behalf of a minor is a separate offence. It is illegal for an adult to buy, or attempt to buy, a nicotine vape for someone under 18. The offence targets the adult making the purchase, not the retailer, who has no way of knowing where the product will end up. The rule was modelled on the equivalent proxy purchasing offence for tobacco.10UK Parliament. Nicotine Inhaling Products (Age of Sale and Proxy Purchasing) Regulations 2015
An adult caught proxy purchasing can be issued a fixed penalty notice of £90, reduced to £60 if paid within 15 days. If the notice goes unpaid, the case can go to court, where the maximum fine is £2,500.1legislation.gov.uk.
