How Much Can You Gift Tax-Free? Limits, Exclusions, and Form 709

In 2026, you can give any individual up to $19,000 tax-free in a calendar year without owing gift tax or even filing a return, and you can repeat that gift to as many separate people as you like. Above that per-person amount, a $15 million lifetime exclusion absorbs the excess before any tax is actually due.1Internal Revenue Service. IRS Releases Tax Inflation Adjustments for Tax Year 2026 Certain transfers — tuition paid directly to a school, medical bills paid directly to a provider, gifts to a U.S.-citizen spouse, and gifts to charity — sit outside the system entirely, with no dollar cap at all.

The $19,000 Annual Per-Person Limit

Federal law lets you hand any one person up to $19,000 in 2026 without gift tax consequences and without filing anything.2Office of the Law Revision Counsel. 26 USC 2503 – Taxable Gifts The cap is per recipient, not per giver. Give $19,000 each to your four children and the full $76,000 stays outside the system. The window resets every January 1, so the same gifts can be repeated the next year.

Only the giver ever owes gift tax; the person on the receiving end does not report the money as income. A gift, for these purposes, is any transfer of money or property for less than its full value in return — cash, stock, real estate, and even canceling a debt someone owes you.3Internal Revenue Service. Doubling the Limit With a Spouse

Married couples can treat a gift as coming half from each spouse, which effectively doubles the annual exclusion. In 2026, you and your spouse can together give one person up to $38,000 with no gift tax, even if all of the money leaves one spouse’s account.3Internal Revenue Service. Frequently Asked Questions on Gift Taxes

The catch: electing to split gifts requires filing Form 709 even when no tax is owed, and both spouses have to consent on the return.4Internal Revenue Service. Instructions for Form 709 (2025) Skip that election and only the spouse whose money moved gets to use their $19,000.

The $15 Million Lifetime Cushion

Going over $19,000 to one person in a year does not automatically produce a tax bill. The excess is subtracted from a running lifetime total, and only after that lifetime cushion is used up does actual gift tax start. For 2026, the lifetime exclusion is $15 million per person, or $30 million for a couple using both spouses’ amounts.5Internal Revenue Service. What’s New — Estate and Gift Tax

Two things worth knowing about this cushion. First, it is shared with the estate tax: whatever you consume through lifetime gifts reduces what your estate can shield at death. Second, the IRS keeps score through the Form 709 returns you file over the years, which is why the paperwork matters even when nothing is owed. Almost nobody reaches the point where actual tax is due, but the running total is real.

Transfers That Never Count

Several categories of transfers sit entirely outside the gift tax and do not eat into either the $19,000 annual amount or the $15 million lifetime figure.

Tuition Paid Directly to the School

You can pay any amount of someone’s tuition, tax-free, if the check goes straight to the school.6Office of the Law Revision Counsel. 26 USC 2503 – Taxable Gifts The exclusion is narrow in two ways: the money cannot pass through the student’s hands first, and only tuition qualifies. Room, board, books, and supplies fall outside it.

Medical Bills Paid Directly to the Provider

The same rule covers medical expenses. Pay a hospital, doctor, or insurer directly and the amount is unlimited and tax-free. Reimburse the patient and it becomes an ordinary gift subject to the $19,000 cap.

Gifts to a Spouse

Transfers between spouses are unlimited when the receiving spouse is a U.S. citizen.7Office of the Law Revision Counsel. 26 USC 2523 – Gift to Spouse When the receiving spouse is not a U.S. citizen, an annual cap replaces the unlimited deduction — $194,000 in 2026, with anything above that pulling from your lifetime exclusion.1Internal Revenue Service. Charities and Political Organizations

Charitable gifts to qualified organizations are deductible in full from taxable gifts, so they do not consume any of your annual or lifetime amount.8Office of the Law Revision Counsel. 26 USC 2522 – Charitable and Similar Gifts Contributions to political organizations are excluded from the gift tax outright.3Internal Revenue Service. Front-Loading a 529 With Five Years at Once

529 education savings plans get a special rule. You can drop five years’ worth of annual exclusions into a 529 in one shot — $95,000 per beneficiary in 2026, or $190,000 if you split the gift with your spouse — and treat it as spread evenly across the current year and the next four for gift tax purposes.9IRS.gov. 2025 Instructions for Form 709 The election is made by checking a box on Schedule A of Form 709 in the year of the contribution. Contribute more than $95,000 to one beneficiary and the excess is treated as a gift in the year you made it.

When You Have to File Form 709

Form 709 is required whenever you give any one person more than $19,000 in a calendar year, whenever you and your spouse elect to split gifts, or when certain hard-to-value assets change hands.10Internal Revenue Service. About Form 709, United States Gift (and Generation-Skipping Transfer) Tax Return The deadline is April 15 of the year after the gift.11Internal Revenue Service. Filing Estate and Gift Tax Returns

You will need each recipient’s full name and Social Security number, a description of what was given, and its fair market value on the date of the transfer — the price a willing buyer would pay a willing seller when neither is under pressure.4Internal Revenue Service. Instructions for Form 709 (2025) Private business interests and real estate usually need a professional appraisal to support the number you report.

If April 15 is a problem, Form 8892 buys an automatic six-month extension for Form 709.12Internal Revenue Service. About Form 8892, Application for Automatic Extension of Time To File Form 709 An extension you already have on your income tax return through Form 4868 covers Form 709 too. Extensions push the filing date; any tax owed is still due April 15.

What the Recipient Inherits

The recipient owes no income tax on the gift itself, but they take over your cost basis in the property. Stock you bought for $5,000 and gave away when it was worth $25,000 still carries a $5,000 basis in the recipient’s hands, and they pay capital gains tax on the $20,000 spread when they sell.13Office of the Law Revision Counsel. 26 USC 1015 – Basis of Property Acquired by Gifts and Transfers in Trust If the property had lost value by the time you gave it, a separate rule uses fair market value as the basis for calculating a loss, which prevents shifting built-in losses to someone else.

What Happens If You File Late or Undervalue a Gift

A late Form 709 when tax is actually owed carries a failure-to-file penalty of 5% of the unpaid tax per month, capped at 25%, plus interest.14Internal Revenue Service. Failure to File Penalty When no tax is due because you are still inside your lifetime cushion, a late return generally does not produce a monetary penalty, but filing still matters for another reason.

Reporting a value that is 65% or less of the correct value can trigger a 20% accuracy penalty on the underpayment if the shortfall tops $5,000, and the penalty rises to 40% when the reported value is 40% or less of the true value.15Office of the Law Revision Counsel. 26 USC 6662 – Imposition of Accuracy-Related Penalty on Underpayments

The larger risk of not filing is open-ended exposure. A properly filed and adequately disclosed Form 709 gives the IRS three years to audit the gift. Skip the return, or fail to disclose the gift properly on one that is filed, and the IRS can come back and assess tax on that gift with no time limit at all.16Internal Revenue Service.
