Funding on a refinance usually takes four to seven calendar days after you sign closing documents if the loan is on your primary residence, because federal law requires a three-business-day waiting period before any money can move. On an investment property or vacation home, there is no waiting period, and funds can disburse the same day or the next. So how long funding takes after closing a refinance depends mostly on three things: what kind of property it is, what day of the week you sign, and whether a federal holiday falls inside the window.
Why Primary-Residence Refinances Have a Three-Day Wait
Regulation Z gives you three business days after closing to cancel a refinance on your primary home with no penalty. During that window, the lender cannot record the new mortgage or release any funds.1eCFR. 12 CFR 1026.23 – Right of Rescission This cooling-off period is the single biggest reason refinance funding feels slow.
The clock does not start the moment you sign. It starts after all three of these have happened: you’ve signed the loan agreement, the lender has given you the final Truth in Lending disclosure, and you’ve received two copies of the notice explaining your right to cancel.2Consumer Financial Protection Bureau. 1026.23 Right of Rescission The countdown begins the day after whichever of those happens last. If the lender hands you everything at the signing table on Thursday, day one is Friday. If a corrected disclosure gets delivered two days later, the countdown resets from that date.
How to Count the Three Business Days
The definition of “business day” here is not the one most people assume. For rescission, Regulation Z counts every calendar day except Sundays and federal public holidays.3eCFR. 12 CFR 1026.2 – Definitions and Rules of Construction Saturdays count. Your branch may be dark, but the day is still day two.
A typical example: you close on a Thursday and receive all required documents that day. Friday is day one, Saturday is day two, Monday is day three. Your right to cancel expires at midnight Monday, and the lender can release funds on Tuesday.4Consumer Financial Protection Bureau. How Long Do I Have to Rescind? When Does the Right of Rescission Start?
A federal holiday inside the window simply does not count, so each one pushes funding back by a day. For 2026, these are the holidays that pause the clock:
- New Year’s Day: Thursday, January 1
- Martin Luther King Jr. Day: Monday, January 19
- Presidents Day: Monday, February 16
- Memorial Day: Monday, May 25
- Juneteenth: Friday, June 19
- Independence Day: Saturday, July 4 (observed Friday, July 3)
- Labor Day: Monday, September 7
- Columbus Day: Monday, October 12
- Veterans Day: Wednesday, November 11
- Thanksgiving: Thursday, November 26
- Christmas: Friday, December 25
Signing right before a Monday holiday is the worst timing for speed. Sign on Thursday before a Monday federal holiday and the three business days become Friday, Saturday, and Tuesday, which pushes funding to Wednesday at the earliest. Tuesday and Wednesday closings give you the shortest path to funding in an ordinary week.
When the Waiting Period Does Not Apply
The rescission requirement covers primary residences only. If you’re refinancing an investment property or a vacation home, there is no mandatory three-day wait, and the lender can fund as soon as the settlement agent confirms the signed documents are complete.1eCFR. 12 CFR 1026.23 – Right of Rescission Bridge loans and other temporary financing arrangements also fall outside the rescission rules and often fund the same day signatures are notarized.
Waiving the Wait in a Genuine Emergency
You can waive the three-day period on a primary residence if you face a bona fide personal financial emergency. The requirements are strict. You must write a dated statement in your own words describing the emergency and explicitly waiving your rescission right, and every borrower on the loan must sign it. The lender cannot hand you a pre-printed form.1eCFR. 12 CFR 1026.23 – Right of Rescission Most lenders are reluctant to accept these waivers because of the legal exposure if the emergency is later challenged, so plan around the three days rather than counting on a waiver.
Add a Day or Two in Dry Funding States
How fast money moves after the rescission period ends depends partly on where the property sits. In a wet funding state, the lender wires money to the settlement agent on the closing date or within a day or two, and funds tend to disburse the first business day after rescission ends. Most states work this way.
Dry funding states add a buffer. The settlement agent collects signed documents at closing, but funds are not released until the paperwork has been separately reviewed and approved. The dry funding states are Alaska, Arizona, California, Hawaii, Idaho, Nevada, New Mexico, Oregon, and Washington. If you’re refinancing in one of them, expect an extra day or two on top of the rescission wait before money reaches any account.
What Happens on Funding Day
Once the rescission period expires, the lender issues a funding authorization to the settlement or escrow agent. The agent then pays off your existing mortgage first, because the new lender needs the primary claim against the property title.5Fannie Mae. Satisfying the Mortgage Loan and Releasing the Lien Third-party costs come next: title insurance, recording fees, and any outstanding taxes or association dues that were conditions of approval. Anything left is your cash-out, if your refinance included one.
Most settlement agents send cash-out by wire, which typically arrives in your bank account within a few hours. Timing within the day matters. The Federal Reserve’s Fedwire system closes at 7:00 p.m. Eastern Time on business days,6Federal Register. If You Decide to Cancel
If you change your mind during the rescission window, send written notice to the lender before midnight on the third business day. You don’t need the lender’s cancellation form; a letter, email, or fax works as long as it goes to the address the lender designated for cancellation notices.7Consumer Financial Protection Bureau. Comment for 1026.23 – Right of Rescission If no address was designated, sending it to the address where you make loan payments counts as valid delivery.
After the lender receives your cancellation, it has 20 calendar days to return any money or property connected to the transaction and release the security interest on your home.1eCFR. 12 CFR 1026.23 – Right of Rescission Your old mortgage stays in place as if the refinance never happened, and any fees you paid at closing must be refunded.
