How Long Before Student Loans Garnish Your Wages?

For federal student loans, wages can be garnished no sooner than about 10 months after your first missed payment: 270 days of nonpayment before the loan enters default, then a mandatory 30-day written notice before any garnishment order goes to your employer. Administrative processing usually stretches the real timeline to 12 months or longer. For private student loans, the wait is typically longer still, because the lender has to file a lawsuit, win a judgment, and then obtain a separate garnishment order before anything comes out of your paycheck.

The 270-Day Clock on Federal Loans

A federal student loan becomes delinquent the day after you miss a payment. That delinquency runs for 270 days before the loan officially enters default. During those nine months, the servicer will contact you repeatedly, and you can stop the clock at any point by making a payment, entering an income-driven repayment plan, or requesting deferment or forbearance.1Federal Student Aid. Only after that 270-day period passes without any payment arrangement does the loan enter default and become eligible for involuntary collection. This matters in 2026 because the Department of Education resumed involuntary collection activities in mid-2025 after a multi-year pandemic pause, so these consequences are actively being enforced.2U.S. Department of Education. The 30-Day Notice Before Garnishment Starts

The government does not have to sue you to garnish wages on a defaulted federal loan. Under 20 U.S.C. ยง 1095a, the Department of Education or a guaranty agency can order your employer to withhold pay through a process called Administrative Wage Garnishment.3Office of the Law Revision Counsel. 20 USC 1095a Wage Garnishment Requirement

Before that order reaches your employer, you must receive written notice at least 30 days in advance. The notice is sent by first-class mail to your last known address and must state the amount owed, the intent to garnish, and your rights to inspect loan records, propose a repayment agreement, or request a hearing.4eCFR. 34 CFR Part 34 Administrative Wage Garnishment

If you request a hearing within 30 days of the notice date, the government cannot issue a garnishment order until that hearing is held and a decision is issued. Your request must be postmarked or received by the designated office within the 30-day window to be considered timely. A late request can still be filed, but the government is not required to hold off on garnishment while it’s processed.4eCFR. 34 CFR Part 34 Administrative Wage Garnishment

Add the 270-day default clock to the 30-day notice and you get the 10-month floor. In practice, servicer processing, transfers to collections, and time spent locating your employer often push the actual start of garnishment past a full year from your first missed payment.

Private Loans: A Court Judgment Comes First

Private student loans follow the terms of the promissory note you signed, not the Higher Education Act. Most private lenders define default as 90 days of missed payments, though some agreements trigger default after a single missed payment. Read your note, because that document controls the timeline.

Even after default, a private lender cannot touch your paycheck without going through court. The lender has to file a lawsuit, serve you with a summons, and win a judgment. You typically have 20 to 30 days to respond after being served. Ignore the lawsuit and the lender can obtain a default judgment for the full balance, interest, and legal fees. Only then can the lender apply for a separate garnishment order directing your employer to withhold pay.

The full sequence, from filing the complaint to the garnishment order landing on your employer’s desk, commonly takes several months to over a year, and contested cases run longer. Private student loan debt is also subject to a state statute of limitations, generally three to fifteen years, and if that deadline passes without a lawsuit, the lender loses the ability to collect through the courts. Federal loans carry no such time limit.

How Much Comes Out Once It Starts

Federal student loan garnishment is capped at 15% of your disposable pay per pay period.5Office of the Law Revision Counsel. 31 USC 3720D Garnishment Disposable pay means what remains after legally required deductions: federal income tax, state and local taxes, Social Security, and Medicare. Voluntary deductions like health premiums or retirement contributions are not subtracted first, so the 15% is calculated on a larger number than your take-home pay.3Office of the Law Revision Counsel. 20 USC 1095a Wage Garnishment Requirement

Private student loan garnishments fall under the Consumer Credit Protection Act, which limits withholding to the lesser of 25% of disposable earnings for the week, or the amount by which weekly disposable earnings exceed 30 times the federal minimum wage.6Office of the Law Revision Counsel. 15 USC 1673 Restriction on Garnishment With the federal minimum wage at $7.25 per hour in 2026, that floor is $217.50 per week. Some states set tighter limits.

You can also ask the hearing officer for a reduced garnishment based on financial hardship. If 15% of your disposable pay would prevent you and your dependents from covering basic living expenses, the Department of Education compares your documented expenses against the IRS National Standards for households of similar size and income and can lower the rate.4eCFR. 34 CFR Part 34 Administrative Wage Garnishment Gather pay stubs, utility bills, rent receipts, and medical costs before you file. The burden of proof is on you.

What You Can Do During the Window

Between the notice and the garnishment order, several routes can stop the process:

  • Negotiate a voluntary repayment agreement with the loan holder or the Default Resolution Group before the 30-day window closes. Agreeing to a plan in time keeps the order from being issued.3Office of the Law Revision Counsel. 20 USC 1095a Wage Garnishment Requirement
  • Enter loan rehabilitation, which requires a series of agreed monthly payments based on income. Completing the payments removes the default and ends garnishment. Rehabilitation is also the only resolution path that removes the default notation from your credit report.
  • Consolidate the defaulted loan into a new Direct Consolidation Loan and enroll in an income-driven plan. Once the consolidation is finalized, collection activity stops.1Federal Student Aid. Student Loan Default and Collections FAQs
  • Request a hearing within 30 days of the notice and, if applicable, claim financial hardship to reduce or eliminate the withheld amount.

Rehabilitation and voluntary repayment remain available even after garnishment has started, but the sooner you act, the less money leaves your paycheck, and you avoid the collection costs that get added to the balance during enforced garnishment.

Tax Refunds and Social Security Can Be Taken Sooner

Wage garnishment is not the only involuntary collection tool, and the others can hit before or independently of a paycheck. The Treasury Offset Program lets the Department of Education intercept federal payments, including your tax refund. The Department reactivated Treasury offsets on May 5, 2025.2U.S. Department of Education. U.S. Department of Education to Begin Federal Student Loan Collections

Social Security benefits can also be offset, capped at 15% of the monthly benefit, with the first $750 per month protected.7Consumer Financial Protection Bureau. Issue Spotlight: Social Security Offsets and Defaulted Student Loans Married borrowers filing jointly can have the entire refund intercepted, not just the portion tied to the borrower’s income, and can file an “injured spouse” claim with the IRS to protect the non-borrower’s share. These offsets can continue indefinitely until the debt is resolved.
