In a Chapter 7 case, most people receive their discharge order roughly 60 to 90 days after the Meeting of Creditors, once the objection window closes and the court processes the paperwork. In a Chapter 13 case, how long after filing bankruptcy until discharge is a much longer question: the order doesn’t issue until you finish a three-to-five-year repayment plan. In both chapters, the timeline runs from a specific procedural event rather than the filing date, and several missteps can stall it.
The 341 Meeting Starts the Clock
Nothing moves toward discharge until you attend the Meeting of Creditors, commonly called the 341 meeting. Federal law actually bars the bankruptcy judge from attending.1Office of the Law Revision Counsel. 11 U.S. Code 341 – Meetings of Creditors and Equity Security Holders The bankruptcy trustee assigned to your case runs it, asking you questions under oath about your petition, your property, your income, and your expenses.2United States Department of Justice. Section 341 Meeting of Creditors Creditors can attend and ask questions too, though in routine consumer cases most don’t.
The date of that meeting matters because it triggers a 60-day window for creditors and the trustee to challenge either your overall right to a discharge or the dischargeability of specific debts.3Legal Information Institute. Federal Rules of Bankruptcy Procedure Rule 4004 – Granting or Denying a Discharge If no one files an objection in that window, the path to discharge is clear.
Chapter 7 Discharge Timeline
Chapter 7 is the faster form of bankruptcy. Once the 60-day objection period after the 341 meeting expires without a challenge, the court must promptly issue the discharge order.3Legal Information Institute. Federal Rules of Bankruptcy Procedure Rule 4004 – Granting or Denying a Discharge In practice, courts take a few days to a few weeks to process the order after that deadline, so most filers see their discharge roughly 60 to 90 days after the 341 meeting.
Because the 341 meeting itself is usually scheduled 21 to 40 days after you file, the total time from filing to discharge in a typical uncontested Chapter 7 runs about three to four months.
One requirement catches people off guard: you must complete a debtor education course after filing your petition and file the certificate of completion with the court.4United States Department of Justice. Credit Counseling and Debtor Education Information This is separate from the pre-filing credit counseling course. Forget to file the certificate and the court will hold your discharge indefinitely, even if no creditor objected and every other requirement is met.3Legal Information Institute. Chapter 13 Discharge Timeline
Chapter 13 runs on a fundamentally different schedule. Instead of liquidating assets, you make monthly payments to a trustee under a court-approved repayment plan lasting three to five years.5United States Courts. Chapter 13 – Bankruptcy Basics The discharge doesn’t arrive until every payment under the plan is complete.
After your final payment, the court grants the discharge “as soon as practicable,” but only after you clear additional hurdles.6Office of the Law Revision Counsel. 11 U.S. Code 1328 – Discharge If you owe any domestic support obligations like child support or alimony, you must certify that those payments are current. You also have to complete the same debtor education course required in Chapter 7. Only after the trustee confirms everything checks out does the court enter the discharge order.
Hardship Discharge in Chapter 13
Sometimes life makes it impossible to finish the plan. A permanent disability or a lasting job loss can shut down repayment before the term ends. In that situation, you can ask the court for a hardship discharge before completing all payments. The court will grant one only if three conditions are met: your failure to finish stems from circumstances genuinely beyond your control, unsecured creditors have already received at least as much as they would have gotten in a Chapter 7 liquidation, and modifying your plan wouldn’t fix the problem.6Office of the Law Revision Counsel. 11 U.S. Code 1328 – Discharge
A hardship discharge is narrower than a standard Chapter 13 discharge. It covers nonpriority unsecured debts like credit cards and medical bills, but it does not eliminate priority debts such as tax obligations, criminal fines, or domestic support obligations.
What Can Delay or Block Your Discharge
The 60-to-90-day Chapter 7 timeline assumes the case runs smoothly. Several things can push it back or stop it entirely.
Creditor or Trustee Objections
A creditor can file a formal complaint, called an adversary proceeding, objecting to the discharge of a specific debt or to your right to receive a discharge at all.7United States Courts. Discharge in Bankruptcy – Bankruptcy Basics An adversary proceeding is essentially a lawsuit inside your bankruptcy case. The court won’t enter any discharge while the proceeding is pending, and resolving it can add months.3Legal Information Institute. Federal Rules of Bankruptcy Procedure Rule 4004 – Granting or Denying a Discharge
Missing Tax Return
You must give the trustee a copy of your most recent federal tax return at least seven days before the 341 meeting. Miss that deadline and the court must dismiss your case unless you can show the failure was beyond your control.8Office of the Law Revision Counsel. 11 U.S. Code 521 – Debtor’s Duties A dismissal means no discharge at all. You’d have to start over.
Unpaid Filing Fees
The court will not grant a discharge until you’ve fully paid your filing fee, unless the court waived it at the start of the case.3Legal Information Institute. Federal Rules of Bankruptcy Procedure Rule 4004 – Granting or Denying a Discharge Courts allow installment payments, but every dollar must be paid before the discharge order issues.
Random Audits
The U.S. Trustee’s office audits a sample of bankruptcy cases, at minimum one out of every 250 filings in each federal district. Selection is random, and cases showing income or expense figures that deviate significantly from district averages are also flagged.9GovInfo. 28 U.S. Code 586 – Duties; Supervision by Attorney General If your case is pulled, the audit can delay your discharge by weeks or months while auditors review your schedules.
Missing Debtor Education Certificate
The post-filing education certificate is one of the most common causes of delay. The court will hold the discharge indefinitely until you file it, and there’s no automatic reminder.4United States Department of Justice. Credit Counseling and Debtor Education Information
What the Discharge Order Does
The discharge order itself is a short, standardized form. It names you and states that your eligible debts are discharged, but it does not list which specific debts were discharged or which survived.7United States Courts. Discharge in Bankruptcy – Bankruptcy Basics The court mails a copy to you, your attorney, and every listed creditor.
Certain categories of debt survive both Chapter 7 and Chapter 13 discharges, including domestic support obligations, recent income taxes, most student loans, debts arising from fraud or willful injury, and criminal fines and restitution.10Office of the Law Revision Counsel. 11 U.S. Code 523 – Exceptions to Discharge The discharge order doesn’t spell that out; the statute does.
What gives the order its teeth is a permanent injunction. Federal law makes the discharge operate as a court order barring creditors from taking any action to collect a discharged debt: no phone calls, no letters, no lawsuits, no wage garnishment.11Office of the Law Revision Counsel. 11 U.S. Code 524 – Effect of Discharge A creditor who violates the injunction can be held in contempt of court and ordered to pay damages and attorney’s fees.
Even after the order is entered, a trustee, creditor, or the U.S. Trustee can ask the court to revoke your discharge on narrow grounds, such as fraud discovered after the fact or concealed property. The deadline for a fraud-based revocation is one year after discharge; for concealed property, it’s the later of one year after discharge or the date the case is closed.12Office of the Law Revision Counsel. 11 U.S. Code 727 – Discharge Courts treat these deadlines strictly, with no equitable exceptions. If no one files within the window, the discharge stands permanently.
Keep a copy of the discharge order somewhere safe. If a debt collector contacts you about a discharged account months or years later, that document is your proof.
