How Is Per Diem Prorated for Partial and First/Last Days?

On the first and last day of a business trip, federal rules pay 75% of the destination’s meals and incidental expenses (M&IE) rate, no matter what time you actually leave home or get back. Full days in the middle pay 100%. The same 75% figure also covers any trip that runs longer than 12 hours but less than 24.1eCFR. 41 CFR Part 301-11 – Subsistence Expenses Most private employers follow the same formula because staying within federal per diem limits keeps the reimbursement tax-free.

The 75 Percent Rule With a Worked Example

Federal Travel Regulation ยง 301-11.101 sets the formula. Departure day: 75% of the M&IE rate. Return day: 75% of the M&IE rate. Every full day in between: 100%. Departure time is irrelevant. A 5:00 a.m. flight and a 4:00 p.m. flight produce the same allowance for that day.

Say your destination’s M&IE rate is $80 per day. A four-day trip pays $60 on day one, $80 on day two, $80 on day three, and $60 on day four, for a total of $280. The standard continental U.S. M&IE rate is $68, and designated high-cost localities run up to $92.2U.S. General Services Administration. M&IE Breakdowns The specific rate for a city or ZIP code is on the GSA per diem rates page.

When a Meal Is Provided, Subtract It

If your employer, a conference, or the government furnishes a meal, the dollar value of that meal comes out of your M&IE for the day. The deduction still applies on first and last days when you are already at 75%.3eCFR. 41 CFR Part 301-11 – Subsistence Expenses – Section 301-11.21 Deductions can never push the reimbursement below the incidentals allowance, which is $5 per day within the continental U.S.2U.S. General Services Administration. M&IE Breakdowns

GSA publishes the meal-by-meal allocation for each M&IE tier:

  • $68 total: $16 breakfast, $19 lunch, $28 dinner, $5 incidentals
  • $74 total: $18 breakfast, $20 lunch, $31 dinner, $5 incidentals
  • $80 total: $20 breakfast, $22 lunch, $33 dinner, $5 incidentals
  • $86 total: $22 breakfast, $23 lunch, $36 dinner, $5 incidentals
  • $92 total: $23 breakfast, $26 lunch, $38 dinner, $5 incidentals

Back to the $80 example. If a conference provides lunch on your travel-in day, you get $60 (the 75% first-day amount) minus $22 (the lunch line), leaving $38 for the day. Continental breakfasts at a hotel and light snacks on a plane do not count as provided meals and do not trigger a deduction.3eCFR. 41 CFR Part 301-11 – Subsistence Expenses – Section 301-11.21

Lodging Does Not Prorate the Same Way

Lodging is not a flat percentage. It reimburses the actual room cost up to the GSA maximum for the location, and receipts are required for every night regardless of amount.4eCFR. 41 CFR Part 301-11 – Subsistence Expenses – Section 301-11.23 Overages come out of your pocket unless your agency or employer approves an actual-expense exception.

The last day of any trip pays no lodging because you are not spending that night in a hotel. Your first day usually does include a lodging night. That asymmetry makes the return day the lightest day of the trip: 75% of M&IE and nothing else.

Day Trips Do Not Qualify

Per diem is a tax-free reimbursement only when the trip requires you to sleep or rest away from your tax home. The IRS defines business travel as being away for “substantially longer than an ordinary day’s work” and needing to stop for sleep or rest to meet the demands of the work.5Internal Revenue Service. Topic No. 511, Business Travel Expenses A same-day trip fails that test no matter how long the day. A 14-hour round trip to a client in the next state, with no overnight stay, does not qualify. If an employer pays a meal allowance for that day, the IRS treats it as taxable wages subject to withholding.

The Quarter-Day Alternative Some Employers Use

A few organizations split the 24-hour day into four six-hour blocks: midnight to 6:00 a.m., 6:00 a.m. to noon, noon to 6:00 p.m., and 6:00 p.m. to midnight. You earn a quarter of the daily M&IE for each block you are in travel status. Leave at 8:00 a.m. and you capture three of the four blocks, which lands you at the same 75% the federal method would pay.

Where the methods split is at the edges. A 5:00 a.m. departure captures all four quarters and pays 100% under this method, while the federal 75% rule still caps the day at 75%. The quarter-day approach is not part of the Federal Travel Regulation and the IRS does not require it. Employers that use it need to keep the resulting payments at or below federal per diem to preserve tax-free treatment.

The High-Low Method and How Proration Still Applies

Private employers do not have to use the GSA locality tables. The IRS offers a simpler two-tier alternative called the high-low substantiation method: one rate for designated high-cost cities, one rate for everywhere else in the continental U.S. For travel on or after October 1, 2025, those combined lodging-plus-meals rates are $319 per day for high-cost localities and $225 elsewhere.6Internal Revenue Service. Notice 2025-54

When an employer reimburses lodging separately at actual cost, the meal-only portion is $86 per day in high-cost areas and $74 elsewhere.6Internal Revenue Service. Notice 2025-54 The 75% first-and-last-day rule still applies. At the $74 tier, the departure day and return day each pay $55.50. New high-low rates take effect each October 1, so a trip that straddles that date can involve two rate sets.

What Happens if the Proration Is Wrong

Any per diem amount above the applicable federal rate becomes taxable wages. The employer owes employment taxes on the excess and the employee owes income tax on it.7Internal Revenue Service. Per Diem Payments Frequently Asked Questions Paying the full daily rate on a departure or return day is one of the most common ways an overpayment slips in: 25% of that day’s M&IE is now taxable. The excess shows up on the W-2 as wages; the portion that stayed within federal limits is reported separately in Box 12 with Code L.8Internal Revenue Service. 2026 General Instructions for Forms W-2 and W-3

There is a second, quieter way per diem loses its tax-free status: filing the expense report late. The IRS treats a report submitted within 60 days of the expense as timely.9Internal Revenue Service. Revenue Ruling 2003-106 Miss that window and the whole payment gets reclassified as taxable wages under a nonaccountable plan, even if the amounts were within federal limits.7Internal Revenue Service. Per Diem Payments Frequently Asked Questions The report needs to show dates of departure and return, days on business, destination, and business purpose. Lodging receipts are required; meal receipts are not when you are claiming the standard per diem.10Internal Revenue Service. Publication 463 (2025), Travel, Gift, and Car Expenses

On the voucher itself, the prorated 75% amounts for day one and the return day should be visible as their own line items, with full rates for the days in between and any provided-meal deductions listed separately. Most digital expense platforms handle the proration automatically once you enter your travel dates, but check the output. A system paying the full rate on a return day is a payroll problem in progress.
