When a federal court filing deadline falls on a legal holiday, a Saturday, or a Sunday, the deadline automatically rolls forward to the end of the next day the court is open. Getting the count wrong by a single day can cost you a claim, a defense, or the right to appeal, so federal holidays and court filing deadlines have to be read together, not separately.

Weekend Holidays and the Observed Date
Independence Day 2026 lands on a Saturday, so the observed federal holiday shifts to Friday, July 3. When a holiday falls on a Sunday, the observed date moves to the following Monday.3Office of Personnel Management. Federal Holidays The observed date is what triggers a filing extension, not the calendar date printed in the statute. A federal deadline that falls on Friday, July 3, 2026 rolls to Monday, July 6, because the courts are closed for the observed Independence Day.

Not every day next to a holiday is itself a holiday. The Friday after Thanksgiving is not on the federal list, and courts are typically open. A deadline falling on Thanksgiving Thursday rolls to that Friday, not to the following Monday. Around Christmas 2026, Christmas Day is a Friday, so a deadline on Christmas rolls to Monday, December 28. Confirm the specific 2026 dates against the list above before you calendar anything.
Counting Days Under Rule 6(a)
Start with the event that triggers the deadline, such as service of a motion or entry of an order. You do not count the trigger day itself.1Legal Information Institute. From there, count every day, including weekends and holidays, until you reach the total. Only at the end of the count do you check whether the last day is a Saturday, Sunday, or legal holiday. If it is, the deadline rolls to the next day the court is open.
This method applies whether the period is 7 days or 60. Federal appellate and criminal rules count the same way.4Legal Information Institute. Deadlines stated in hours work differently. The clock starts immediately when the triggering event occurs and runs continuously through nights, weekends, and holidays. If the period would end on a Saturday, Sunday, or legal holiday, it extends to the same time on the next business day.1Legal Information Institute. When the Courthouse Is Inaccessible
Severe weather, government shutdowns, and other emergencies sometimes close a courthouse on what would otherwise be a business day. If the clerk’s office is inaccessible on the last day of a filing period, the deadline extends to the first accessible day that is not a weekend or holiday.1Legal Information Institute. Electronic Filing Cutoffs and Time Zones
Most federal court documents are filed through the CM/ECF system, which accepts uploads at any hour.6United States Courts. Electronic Filing (CM/ECF) For electronic filings, the last day of a deadline period ends at midnight in the court’s local time zone.1Legal Information Institute. Federal Rules of Civil Procedure Rule 6 – Computing and Extending Time For paper filings delivered in person or by mail, the day ends when the clerk’s office is scheduled to close.
The court’s time zone controls, not yours. An attorney in California filing in a New York federal court loses three hours; midnight Eastern is 9:00 p.m. Pacific. Local rules can also set an earlier electronic cutoff than midnight, so check the specific court before assuming you have until 11:59 p.m.1Legal Information Institute. A document is filed when CM/ECF generates a Notice of Electronic Filing containing the timestamp and transaction number. Wait for that notice before closing the browser. If a system-wide outage prevents filing, the inaccessibility rule can apply, but document the failure with screenshots and contact the clerk immediately. Most districts have standing orders explaining how to handle technical failures, and it is far better to know them in advance than at 11:45 p.m.
The Three-Day Extension for Mail Service
When a deadline runs from the date you were served, the method of service matters. If you were served by mail, by papers left with the clerk, or by another non-electronic method you consented to, three extra calendar days are added after the normal Rule 6(a) count.1Legal Information Institute. The extension does not apply to documents served electronically through CM/ECF. A 2016 amendment removed electronic service from the list because delivery is instantaneous.7Legal Information Institute. State Holidays in Criminal and Appellate Cases
Federal civil procedure recognizes only federal holidays. Federal criminal and appellate rules go further: for deadlines measured forward from an event, the rules also treat state holidays where the court sits as legal holidays.8Legal Information Institute. Federal Rules of Appellate Procedure Rule 26 – Computing and Extending Time So if a state observes a holiday the federal government does not, and your forward-counted deadline in a criminal or appellate case lands on that day, the deadline rolls. For deadlines counted backward from an event, state holidays do not apply.
Appeal Deadlines: The Rollover Applies, Nothing Else Does
The holiday and weekend rollover works the same way for jurisdictional deadlines, but no other form of automatic relief is available. The Supreme Court has held that these appeal deadlines strip the appellate court of jurisdiction when missed, even if a district judge mistakenly gives the appellant a later date to file.11Justia. If the 30th day after a judgment falls on a Saturday, the notice of appeal is due by the end of the following Monday. That rollover is the only automatic relief available on a jurisdictional deadline. Count carefully, cross-check against the 2026 holiday list, and never rely on the court or opposing counsel to flag the date for you.
