To cancel a timeshare, send a written cancellation notice to the developer within your state’s rescission period, which runs from roughly three business days to 15 calendar days after you signed. Miss that window and your remaining options narrow to the developer’s voluntary surrender program or, if the sale involved fraud, a legal challenge under consumer protection law. Everything else — stopping payment, hiring an “exit” company that guarantees results — tends to make the problem worse.
Cancel Within the Rescission Period
Every state gives timeshare buyers an automatic cooling-off window. You do not have to prove wrongdoing or give any reason. The clock and its length are set by the state where the timeshare sits, not where you live.
Florida allows 10 calendar days, measured from the later of the contract signing date or the day you received all required disclosure documents.1Florida Senate. Florida Code Title XL 721.10 – Cancellation California allows seven calendar days on the same “later of” rule.2California Legislative Information. California Business and Professions Code BPC 11238 Nevada allows five calendar days from the signing date.3Justia Law. Nevada Revised Statutes 119A.410 – Right to Cancel Contract of Sale
Check whether your state counts calendar days or business days. Weekends can shift the real deadline by two days in either direction, and one day late generally kills the automatic right. Cancel inside the window and you are entitled to a full refund of every deposit. The developer cannot legally refuse.
What to Put in the Cancellation Notice
Pull out your purchase file before you write anything. The notice has to give the developer enough to identify the account and process the request without a technicality-based rejection. Include:
- The full legal name of every person on the deed or membership certificate.
- The contract or member number assigned at purchase.
- The date of purchase.
- The property description — unit, week, or points package — from the first page of the contract or the exhibit at the back.
- A direct cancellation sentence such as “I hereby cancel this timeshare purchase agreement effective immediately.” Skip anything that sounds like you’re still weighing options.
If more than one person is on the contract, all of them should sign. Some purchase agreements include a pre-printed cancellation form near the signature page or inside the public offering statement. Use it if it exists. If none is provided, a written letter with the elements above works, as long as it meets the notice requirements in your contract.
How to Deliver It So It Counts
Read the contract before you send anything. It may specify a delivery method and a mailing address, and if it does, follow that method exactly. If it does not, certified mail with return receipt requested is the safest default: it creates a dated paper trail of both sending and receipt.
State law also decides when the notice takes effect. In Florida, a mailed cancellation is considered given on the postmark date as long as the developer actually receives it.1Florida Senate. Florida Code Title XL 721.10 – Cancellation In California, the notice takes effect on the date it is sent.2California Legislative Information. California Business and Professions Code BPC 11238 If your state requires actual receipt, build in mailing time. FedEx or UPS can work when time is tight, but only if the contract doesn’t restrict you to a specific method.
Keep copies of everything: the letter, the certified mail receipt, and the return receipt card. Watch your account afterward. The developer should send written confirmation and refund any deposit. If charges keep appearing or confirmation doesn’t arrive in a reasonable time, follow up in writing and keep copies of that too.
If the Rescission Window Has Passed: Developer Surrender Programs
Once the statutory window closes, the automatic right is gone, but some developers run voluntary exit programs — often called deed-back or surrender programs — that let owners return the timeshare directly. These are corporate policies, not legal rights, and the developer can accept or deny at its discretion. Wyndham, Marriott Vacations, and Hilton Grand Vacations each maintain some version.
Eligibility rules are similar across programs:
- The timeshare mortgage must be paid in full.
- Maintenance fees, special assessments, and property taxes must be current.
- The property must be free of liens or other legal encumbrances.
Some programs are free; others charge a few hundred dollars in administrative and recording costs. If the developer accepts the surrender, they issue a legal release confirming the contract has ended. Before hiring anyone, call the resort and ask directly for the department that handles deed-backs or surrenders.
Cancellation Based on Fraud or Misrepresentation
A timeshare contract can still be voided after the rescission window if the sale itself was tainted. Common legal grounds include a salesperson making false claims about the timeshare’s investment value or resale potential, misleading you about fundamental deal terms, or the developer failing to provide a required public offering statement.4Nevada Legislature. Nevada Revised Statutes Chapter 119A – Time Shares These fall under state consumer protection and unfair trade practices laws.
Proof matters here. Promotional materials that contradict the contract, notes from the sales presentation, witness statements, or a pattern of complaints against the same developer all help. Courts and regulators look for evidence that the developer failed basic standards of honest dealing, not just that a buyer changed their mind. If a violation is established, a court can void the contract and order the developer to return your money.
Complaints go to the state attorney general in the state where the timeshare is located.5Federal Trade Commission. Timeshares, Vacation Clubs, and Related Scams Local consumer protection agencies in that state are another route. Filing helps your own case and feeds enforcement patterns regulators use to catch repeat offenders.
Why “Just Stop Paying” Is Not an Exit
Ignoring the bills is not cancellation. It is default, and the consequences follow you.
Once a payment is late, the resort or a collection agency pursues the balance, and the debt is typically reported to credit bureaus within 30 to 90 days. From there:
- Late payments and collections can drop your credit score sharply. A foreclosure entry can stay on your credit report for seven years.
- The developer can start foreclosure — judicial or, if the contract allows, non-judicial — to reclaim the timeshare.
- If the foreclosure sale doesn’t cover what you owe, the developer may seek a deficiency judgment, which can lead to wage garnishment, frozen accounts, or liens on other property.
- Some developers skip foreclosure and sue directly for unpaid fees and legal costs.
None of these ends the contract cleanly the way a proper cancellation does. Work through the rescission period, a surrender program, or a fraud-based legal challenge first.
Avoid Timeshare Exit Scams
The exit industry that grew up around timeshares includes many fraudulent operators. In one enforcement action, the FTC and the Wisconsin Attorney General sued a group of companies that took more than $90 million from owners with false promises to cancel their contracts.6Federal Trade Commission. FTC, Wisconsin Attorney General Take Action Against Timeshare Exit Scammers
The FTC lists these warning signs:7Federal Trade Commission. How To Avoid Timeshare Exit Scams
- Unsolicited calls, emails, or letters offering to help you exit.
- A guarantee that your contract will be canceled.
- Large upfront fees before any work is done.
- Instructions to stop paying your mortgage or maintenance fees, which only speeds up default.
Some operators falsely claim to be affiliated with the developer and use resort logos in their materials. Others pressure owners with claims that heirs will be stuck with the timeshare forever, though most states allow heirs to disclaim a timeshare interest. Call the developer directly about its own surrender program before hiring anyone, and report suspected scams to the attorney general where the timeshare is located.5Federal Trade Commission. Tax and Credit Consequences
How you exit affects taxes. If a developer forgives part of your timeshare mortgage in a deed-back — you owed more than the property was worth — the forgiven amount is generally taxable income, typically reported on IRS Form 1099-C.8Internal Revenue Service. Topic No. 431, Canceled Debt – Is It Taxable or Not? Exceptions exist, most commonly the insolvency exclusion, claimed on IRS Form 982, and debt discharged in bankruptcy. A tax professional can tell you which, if any, applies.
If you used the timeshare only for personal vacations, a loss on exit is not deductible. Federal tax law limits individual loss deductions to losses from a trade or business, transactions entered into for profit, and certain casualty or theft events, and a personal-use timeshare fits none of those.9Office of the Law Revision Counsel. 26 U.S. Code 165 – Losses
Credit is the other exposure. A foreclosure entry can stay on your report for up to seven years, though the score impact fades over time. Keep maintenance fees and loan payments current while you pursue a legitimate exit. If you’re using a developer surrender program, get written confirmation the account is closed before you stop paying anything.
