How Does Back Child Support Affect Your Taxes?

Owing back child support does not change what you owe the IRS or what deductions you can claim, but it can cost you your entire federal tax refund. Through the Treasury Offset Program, the Bureau of the Fiscal Service matches delinquent child support debts against incoming tax refunds and redirects the money to the state child support agency before it ever reaches you. Arrears as low as $150 are enough to put your refund in reach, and the same debt can also block your passport and pull in a spouse who files jointly with you.

Child Support Does Not Change Your Tax Return

Child support sits outside the tax system. If you pay it, you cannot deduct it. If you receive it, you do not report it as income.1Internal Revenue Service. Alimony, Child Support, Court Awards, Damages 1 The IRS treats these payments as a personal obligation to your child, not a tax event for either parent.

A refund intercept does not reduce your tax bill or create a deduction either. Your return still shows the same refund you calculated. The Bureau of the Fiscal Service simply redirects part or all of that money before it reaches your bank account and sends you a separate notice explaining what happened.2Internal Revenue Service. How the Refund Intercept Works

The Treasury Offset Program, run by the Bureau of the Fiscal Service, is the mechanism that connects a child support debt to your refund. State child support agencies submit qualifying arrears to TOP, and when the IRS processes a refund for someone on that list, the system withholds enough to cover the debt and routes it to the state.3Bureau of the Fiscal Service. How Much You Have to Owe

Not every overdue balance qualifies. The state will submit your case only if the arrears meet one of two thresholds. If the custodial parent receives Temporary Assistance for Needy Families (TANF) benefits, the floor is $150. If the custodial parent does not receive TANF, the floor is $500.4Administration for Children & Families. When Is a Case Eligible for the Federal Tax Refund Offset Program These apply whether or not you are current on this month’s payment.

The Pre-Offset Notice

Before an intercept happens, the state sends you a written Pre-Offset Notice showing the past-due amount and explaining your right to challenge it through an administrative review.5Administration for Children & Families. How Does a Federal Tax Refund Offset Work Federal regulations require the notice to go out at least 30 days before the case is submitted.6Administration for Children and Families. PIQ-18-03 Federal Tax Refund Offset, Administrative Offset, and Passport Denial for Tribes The state updates the balance regularly, so the amount actually taken from your refund may differ from the figure on the notice.

If you think the debt itself is wrong, request an administrative review from the state child support agency before the offset occurs. Common grounds include payments made but not credited, a modified support order, or an identity error.7eCFR. 45 CFR 303.72 Once a refund has been intercepted and sent to the state, undoing the collection is much harder.

What the IRS Takes

The offset reaches your full federal refund, including refundable credits. The Earned Income Tax Credit is not shielded from child support intercepts the way it is from some other kinds of collection.8Office of the Law Revision Counsel. 26 USC 6402 After the offset, the Bureau of the Fiscal Service mails you a Notice of Offset confirming the amount taken and the agency that received it.5Administration for Children & Families. Checking Before You File

To find out whether an offset has posted against you, call the Bureau of the Fiscal Service’s TOP Interactive Voice Response line at 800-304-3107 and select option 1. The automated system reports whether an offset occurred, the amount, and which agency submitted the debt.9Bureau of the Fiscal Service. Only contact the IRS if the original refund figure on the notice does not match what your return shows.2Internal Revenue Service. Reduced Refund

When You Owe Back Taxes and Child Support

If you owe the IRS and also owe child support arrears, your refund is not split evenly between them. Federal law sets a strict priority. Past-due federal income tax comes out first, and only the remainder moves into the Treasury Offset Program for non-tax debts.8Office of the Law Revision Counsel. 26 USC 6402

Within TOP, child support holds the top position; the statute requires that past-due support be applied before any other non-tax offset.8Office of the Law Revision Counsel. 26 USC 6402 The full order is:

  • Past-due federal income taxes, penalties, and related IRS liabilities
  • Child support arrears, with the oldest certified debt paid first
  • Federal agency non-tax debts, such as defaulted student loans and overpaid federal benefits
  • State income tax debts
  • Unemployment compensation overpayments

If the refund runs out before all the debts are satisfied, nothing reaches you.10Internal Revenue Service. 21.4.6 Refund Offset Research, Reversals, and Injured Spouse Processing

Protecting a Spouse Who Does Not Owe the Debt

When a married couple files jointly and only one spouse owes back child support, the entire joint refund is still subject to offset. The spouse who does not owe is called an “injured spouse” in IRS terminology and can recover their share.

Filing Form 8379

To get that share back, file IRS Form 8379, Injured Spouse Allocation. The form splits income, withholding, and tax credits between the two spouses so the IRS can calculate how much of the refund belongs to the non-obligated spouse.11Internal Revenue Service. Instructions for Form 8379 (Rev. November 2024) You have two options for timing:

  • File Form 8379 with your joint return if you know an offset is coming. Processing runs about 14 weeks on paper or 11 weeks electronically.
  • File Form 8379 by itself after the offset has occurred. This takes about 8 weeks, and you need to include copies of all W-2s and any 1099s showing federal withholding for both spouses, or processing will stall.

The deadline is three years from the due date of the original return (including extensions) or two years from the date you paid the tax that was later offset, whichever is later.11Internal Revenue Service. Instructions for Form 8379 (Rev. November 2024)

Community Property States

In Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin, the math changes. Joint overpayments are generally treated as community property, and the IRS typically applies 50 percent of the joint refund (excluding the Earned Income Tax Credit) toward the non-tax debt. The EITC portion is allocated based on each spouse’s individual earned income.11Internal Revenue Service. Instructions for Form 8379 (Rev. November 2024) An injured spouse in one of these states often recovers less than one in a non-community-property state with identical finances.

What About Filing Separately

Filing married filing separately avoids the offset problem for the non-obligated spouse entirely, since each spouse’s refund belongs only to them. The tax cost is steep, though. Separate filers lose the Earned Income Tax Credit, see the standard deduction cut in half compared with a joint return, and lose eligibility for several education credits. For many couples the tax penalty of filing separately is larger than the amount they would lose to the offset, and Form 8379 produces a better outcome. Run the numbers both ways before deciding.

Passport Denial Once Arrears Reach $2,500

The refund intercept is not the only federal consequence. If your child support arrears hit $2,500, the State Department will deny a new passport application and refuse to renew an existing one.12U.S. Department of State. Pay Child Support Before Applying for a Passport The state child support agency reports the debt to the U.S. Department of Health and Human Services, which passes it to the State Department.

To clear the hold, pay the outstanding balance through your state’s child support enforcement agency. The state then notifies HHS, which removes you from the denial list and relays the change to the State Department. The full process takes two to three weeks after payment.12U.S. Department of State. Pay Child Support Before Applying for a Passport Contacting the State Department directly does not speed things up, because they have no information about your child support payments.

State Tax Refunds Are at Risk Too

Federal refunds are not the only ones in play. Most states also intercept state income tax refunds to collect past-due child support, and state-level thresholds are generally lower than the federal minimums. The process is handled entirely within your state’s tax and child support systems, so contact your state child support enforcement agency for the specific rules that apply where you live.
