How Do Lenders Know You Owe Taxes: Transcripts, Liens, and CAIVRS

Mortgage lenders find out you owe taxes through four separate checks that run during underwriting: they pull your official IRS transcripts using a form you sign at application, they order a title search that surfaces any federal tax lien filed against you or the property, they read your bank statements for recurring payments to the U.S. Treasury, and, on FHA, VA, and USDA loans, they run your name through a federal delinquent-debtor database called CAIVRS. Each check catches something the others miss, so assuming a tax problem will slip through is a losing bet.

IRS Transcripts Pulled With Form 4506-C

You’ll hand over copies of your tax returns with the application, but the lender verifies them against the IRS’s own records. Fannie Mae requires every borrower whose income is used to qualify to complete and sign IRS Form 4506-C at or before closing.1Fannie Mae. Requirements and Uses of IRS IVES Request for Transcript of Tax Return Form 4506-C That form authorizes the lender to request transcripts directly from the IRS through the Income Verification Express Service.2Internal Revenue Service. Income Verification Express Service The signed form has to reach the IRS within 120 days of the date you signed it.3Internal Revenue Service. Form 4506-C IVES Request for Transcript of Tax Return

Two kinds of transcripts matter here. A tax return transcript shows what was on your 1040 when you filed it. A tax account transcript shows the activity on your account after processing, which is where unpaid balances, assessed penalties, accrued interest, and enforcement activity appear.4Taxpayer Advocate Service. The account transcript uses transaction codes that flag specific problems. A filed lien, a failure-to-pay penalty, an active installment agreement, an ongoing audit, or additional tax assessed after an examination all appear as codes on the transcript. If a balance is owed, the transcript also shows the date through which penalties and interest were calculated, which the underwriter uses to figure out what you actually owe today.4Taxpayer Advocate Service. The underwriter then compares the transcript against the returns you submitted. If the income on your application is higher than the transcript reports, or if the IRS has no record of a return being filed for a year you claimed, the file gets flagged. Discrepancies read as either sloppy paperwork or deliberate misrepresentation, and neither one gets a loan through committee.

Title Searches and Federal Tax Liens

When you owe tax and don’t pay, the IRS can file a Notice of Federal Tax Lien in the public recording office designated by state law.5Internal Revenue Service. 5.12.9 Withdrawal of Notice of Federal Tax Lien Once filed, the lien attaches to everything you own, real estate included.

Here’s the part borrowers often miss: credit bureaus stopped including tax liens on consumer credit reports by April 2018.6Consumer Financial Protection Bureau. A New Retrospective on the Removal of Public Records A clean credit report is not evidence that no lien exists. Lenders know this, which is why they don’t rely on the credit file for lien discovery. The title company searches county recorder offices and court records for anything attached to the property or to you personally, and a federal tax lien surfaces there.

A title insurer won’t issue a policy on a property with an unresolved tax lien clouding the title, and virtually every mortgage lender requires a clean title policy before funding. That’s enough by itself to stop a closing.

Bank Statements Showing Treasury Payments

Underwriters read two to three months of bank statements, and one of the things they’re looking for is automated payments or checks to the United States Treasury. A recurring monthly payment to the Treasury is a strong signal that you’re on an IRS installment agreement to pay off back taxes.

These payments don’t show up on a credit report, which is exactly why manual statement review exists as its own step. When an underwriter spots Treasury payments, they’ll request the formal installment agreement paperwork from you to confirm the remaining balance, the monthly payment, and your payment history. That monthly payment then gets added to your debt-to-income ratio, and a $500 monthly obligation you didn’t disclose can push a marginal file over the lender’s threshold. Large or unusual deposits get scrutinized too, because lenders want to rule out a side loan taken to paper over a tax bill.

CAIVRS for FHA, VA, and USDA Loans

If the loan is government-backed, the lender runs one more check. The Credit Alert Interactive Verification Reporting System, or CAIVRS, is a federal database maintained by HUD that tracks people who are delinquent or in default on federal debts, pulling records from HUD, USDA, VA, SBA, and the Department of Education.7U.S. Department of Housing and Urban Development. Credit Alert Verification Reporting System For FHA loans, CAIVRS must be checked on all borrowers on every insured mortgage except streamline refinances.8HUD Archives. One boundary worth setting: CAIVRS is not how lenders discover federal income tax debt. Debts under the Internal Revenue Code are specifically exempted from the federal statute that bars delinquent federal debtors from getting federal loans.9Office of the Law Revision Counsel. 31 USC 3720B – Barring Delinquent Federal Debtors from Obtaining Federal Loans or Loan Insurance Guarantees Tax debt is caught through the transcripts and title search, not through CAIVRS. CAIVRS is what catches defaults on federal student loans, prior FHA claims, SBA loans, and similar federal obligations. A hit doesn’t automatically kill the loan; HUD doesn’t require a clear CAIVRS response as an absolute condition, but the lender has to document and justify approval when a flag appears, and in practice most lenders treat a flag as a serious obstacle.8HUD Archives. What to Do Before the Lender Finds It

If you owe back taxes, the underwriter will see it. The useful move is to make sure the picture they see is a manageable one.

Pull your own IRS account transcript before you apply so you know exactly what the lender will pull. If you don’t already have an installment agreement in place, get one before you start the mortgage process. FHA requires at least three months of timely, scheduled payments under a valid IRS repayment agreement before a borrower with delinquent federal tax debt becomes eligible, and prepaying three months in advance does not count; three months have to actually pass.10U.S. Department of Housing and Urban Development. FHA Single Family Housing Policy Handbook 4000.1 The monthly installment gets counted in your debt-to-income ratio, so budget accordingly. VA lenders generally want a longer track record, often around 12 months, though the exact requirement varies by lender. Conventional underwriters don’t work from a single bright-line rule; they weigh the installment payment in DTI and typically want liens resolved or subordinated before closing.

Disclose what you owe on the application. The transcripts, title search, and bank statements are going to find it anyway, and volunteering the installment agreement documents, payment history, and any lien paperwork at the start of the file avoids the delay and suspicion that come with an underwriter uncovering an obligation you left off.
