Lenders find out about unpaid taxes through five main channels: IRS tax transcripts you authorize them to pull, the declarations you sign on the loan application, a review of your bank statements, a federal delinquent-debtor database used for government-backed loans, and public records searches conducted during the title process. If you are wondering how do lenders know if you owe taxes, the short answer is that you hand them most of the information yourself when you sign the application packet, and the rest comes from records the IRS and county recorders already keep.
IRS Transcripts Pulled With Your Signature
The most direct route is your own IRS file. When you apply for a mortgage, you sign IRS Form 4506-C, which authorizes the lender to request your tax transcripts through the IRS Income Verification Express Service.1Internal Revenue Service. Federal law generally makes tax return information confidential, so without your signed authorization the lender has no legal access to your IRS data.3Office of the Law Revision Counsel. 26 U.S. Code 6103 – Confidentiality and Disclosure of Returns and Return Information Once you sign, though, the transcript that comes back covers the current year and up to three prior processing years and includes adjusted gross income, tax liability, and estimated payments.4Internal Revenue Service. If a balance due appears on the transcript and you did not disclose it, the lender treats it as hidden debt. Even small discrepancies between the returns you provided during application and what the IRS has on file can freeze approval until they are reconciled.
What You Disclose on the Loan Application
The standard Uniform Residential Loan Application (Fannie Mae Form 1003) asks directly whether you are currently delinquent or in default on any federal debt and whether any outstanding judgments exist against you.5Fannie Mae. Signing the application is a legal affirmation that your answers are complete and accurate. Knowingly providing false information on a loan application is a federal crime punishable by up to 30 years in prison and fines up to $1,000,000.7Office of the Law Revision Counsel. 18 U.S.C. 1014 – Loan and Credit Applications Generally And your declarations become the baseline against which the transcripts, bank statements, and title report are compared. Anything that surfaces later and contradicts what you wrote will compound the problem.
Bank Statement Review
Underwriters read your checking and savings statements looking for signs of undisclosed obligations. For a home purchase, Fannie Mae requires at least the most recent two full months of account activity.8Fannie Mae. Verification of Deposits and Assets Recurring electronic withdrawals or checks made payable to the U.S. Treasury or the IRS are easy to spot, and they usually signal an active installment agreement.
A large one-time payment to a tax authority draws similar attention. Expect the underwriter to ask for a written explanation and proof that the debt was fully settled.
The CAIVRS Database for Government-Backed Loans
If you are applying for an FHA, VA, USDA, or SBA-backed loan, your lender must check the Credit Alert Verification Reporting System (CAIVRS). Developed by HUD in 1987, CAIVRS is a shared repository of delinquent federal debtor records reported by HUD, the VA, USDA, SBA, and the Department of Education.9U.S. Department of Housing and Urban Development. CAIVRS is not used for conventional loans, so the transcript, application, and title checks carry more weight there.
Title Searches and Public Records

During a mortgage, the title company reviews county-level records for any recorded encumbrances. A federal tax lien appears as a defect on title and typically prevents closing until it is resolved, because once the notice is filed the IRS claim generally takes priority over security interests that arise afterward. State and local tax authorities can file liens through similar recording processes; those will not show up on an IRS transcript, which is why the title search is a separate and essential check.
For unsecured personal or business loans with no title search, lenders may use specialized databases that aggregate public judgment and lien filings.
Why Your Credit Report Will Not Show It
Before 2018, a federal tax lien appeared on your credit report and immediately signaled unresolved tax debt to any lender pulling that report. The three major credit bureaus removed all tax liens from consumer credit reports under the National Consumer Assistance Plan, and by April 2018 none remained.12Consumer Financial Protection Bureau. That gap is why the other checks matter so much. A clean credit report does not mean the lender will not find your tax debt; it means the transcript, the CAIVRS query, the application declarations, the bank statements, and the title search are doing the finding.
If They Find Tax Debt, What Happens Next
Owing back taxes does not automatically disqualify you. What matters is whether the debt is being actively repaid and what type of loan you want.
For a conventional loan, Fannie Mae lets you qualify with an active IRS installment agreement as long as you have made at least one payment before closing and can document the schedule. The monthly payment gets added to your debt obligations when the lender calculates your debt-to-income ratio.13Fannie Mae. B3-6-05, Monthly Debt Obligations
For an FHA loan, you must have entered a valid repayment agreement and made at least three consecutive months of on-time, scheduled payments. Prepaying installments to meet the three-month threshold is not allowed, and the repayment amount is included in your debt-to-income calculation.14U.S. Department of Housing and Urban Development. In either case, the lender needs documentation showing the last payment date and amount, the next payment due, and the terms of the agreement. A tax balance with no repayment plan is far more likely to draw a denial.
If a federal tax lien is already recorded and blocking the loan, you have options beyond paying the full balance. The IRS can subordinate the lien, placing its claim behind the new mortgage. You generally must show either that the IRS will receive a payment equal to its lien interest, or that subordination will ultimately increase what the government can collect. The IRS can also withdraw the public notice entirely, as if it were never filed. Withdrawal is available when the notice was filed prematurely, when you have entered an installment agreement that did not call for a lien filing, when withdrawal would help the IRS collect the debt, or when the National Taxpayer Advocate determines withdrawal is in both your and the government’s best interest. Both processes can take weeks or months. If you know a lien exists and you plan to apply for a loan, starting the subordination or withdrawal process well before closing is the best way to avoid a delayed or blocked approval.
