CPT taxes for F-1 students hinge on one thing: whether you’re still a nonresident alien for tax purposes. If you are, your Curricular Practical Training wages are exempt from Social Security and Medicare (FICA) taxes but still subject to federal income tax withholding. That FICA exemption is worth 7.65% of your gross pay. Once you cross into resident-alien status under IRS rules, the exemption ends and your paycheck is taxed like any other American worker’s.
Are You a Nonresident or Resident Alien for Tax Purposes
Your tax residency is a separate question from your immigration status. You can hold a valid F-1 visa and still be a resident alien in the eyes of the IRS. The determination runs on the Substantial Presence Test (SPT), which normally counts you as a U.S. resident if you’re physically present for at least 31 days in the current calendar year and 183 weighted days across a three-year lookback: all days this year, one-third of last year, one-sixth of the year before.1Internal Revenue Service. F-1 students get a carve-out. You’re classified as an “exempt individual,” meaning your days in the U.S. don’t count toward the SPT for the first five calendar years you hold F-1 status.2eCFR. 26 CFR 301.7701(b)-3 Any part of a calendar year counts as a full year. Arrived in August 2022? That whole calendar year is one of your five, even though you were only here a few months.
After the fifth calendar year, the exemption expires and your days start counting. A student present for the full sixth year will almost certainly meet the 183-day threshold and become a resident alien. From that point forward, you’re taxed the same as a U.S. citizen: full FICA withholding, Form 1040 instead of Form 1040-NR, and access to the standard deduction and most credits.
The FICA Exemption While You’re a Nonresident Alien
Under Internal Revenue Code Section 3121(b)(19), wages paid to a nonresident alien temporarily present in the U.S. under an F-1 visa are excluded from FICA.3Internal Revenue Service. When the exemption applies, neither you nor your employer pays FICA on those wages. The employee share is 7.65%, made up of 6.2% for Social Security (on wages up to $184,500 in 2026) and 1.45% for Medicare.4Internal Revenue Service. The exemption isn’t optional. You can’t elect to pay FICA to start building a Social Security earnings history. And it disappears the moment you become a resident alien, at which point your employer must begin withholding the full 7.65% on every paycheck earned after the transition. If your wages exceed $200,000 in a calendar year, the 0.9% Additional Medicare Tax also applies with no carve-out for former NRAs.7Internal Revenue Service. Federal Income Tax Withholding and Your W-4
The FICA exemption doesn’t touch federal income tax. That still applies, and how much gets withheld comes down to how you complete Form W-4. - In Step 1(c), check “Single or Married filing separately” regardless of your actual marital status.
- Leave Step 3 (dependents) blank unless you’re a resident of Canada, Mexico, or South Korea, or a student or business apprentice from India.
- In the space below Step 4(c), write “nonresident alien” or “NRA” so payroll applies the correct withholding adjustments.
Don’t claim exempt status on the W-4 even if you expect to owe nothing at year-end, and don’t use the IRS Tax Withholding Estimator, which is built for resident taxpayers.9Internal Revenue Service. Federal Income Tax Reporting and Withholding on Wages Paid to Aliens
State income tax is a separate track. Most states will withhold based on the same W-4 information, but a handful apply their own residency rules rather than the federal five-year exemption. You may be a state resident for tax purposes even while you’re a federal NRA. Check your state’s revenue department for the right forms.
Tax Treaty Benefits That Can Reduce Withholding
If you’re from a country with an income tax treaty with the United States, certain articles may exempt part or all of your CPT wages from federal income tax. Treaty provisions typically apply only while you hold NRA status and often cap the exemption at a specific dollar amount per year.
To claim the benefit up front, file IRS Form 8233 with your employer before your first paycheck. The form identifies the treaty, the article, and the exemption amount you’re claiming.10Internal Revenue Service. About Form 8233 Your employer forwards a copy to the IRS within five days.11Internal Revenue Service. 21.8.6 Exemptions From US Withholding (Form 8233) Skip that step and your employer withholds at the standard NRA rates; you’d have to claim the treaty benefit on your annual return to get a refund.
One treaty worth flagging: Article 21(2) of the U.S.-India treaty lets Indian students who are NRAs claim the same deductions available to U.S. residents, including the standard deduction ($16,100 for single filers in 2026).12Internal Revenue Service. China, South Korea, and Germany also have student-specific provisions, each with its own dollar limits and conditions.
State income tax treaties are rare. Expect state tax to be withheld even if a federal treaty zeroes out your federal withholding.
Get a Social Security Number Before Payroll Starts
Your employer needs your Social Security Number to run payroll properly. If you don’t already have one, apply at a local Social Security Administration office as soon as you receive your CPT-authorized I-20.
Apply in person and bring original documents. The SSA wants proof of identity, immigration status, and work authorization.13Social Security Administration. You’ll complete Form SS-5 at the office.14Social Security Administration. Application for a Social Security Card (Form SS-5) Processing usually takes two to four weeks, so start early.
Year-End Filing: Forms 8843, W-2, and 1040-NR
Every F-1 student who claims exempt individual status has to file IRS Form 8843, even with zero income for the year.15Internal Revenue Service. There’s no monetary penalty for skipping it, but not filing can undermine your exempt individual status and affect the taxability of income or treaty benefits in later years.16Internal Revenue Service. If you earned CPT wages, your employer will send you a Form W-2 by January 31.17Social Security Administration. Deadline Dates to File W-2s Look at Boxes 3 through 6. If the FICA exemption was applied correctly, those boxes should be blank or show zero. If there are amounts there, your employer withheld FICA in error and you’ll need to pursue a refund (see below).
NRA students report CPT income on Form 1040-NR. Form 1040-NR-EZ was discontinued after 2019, so everyone uses the full 1040-NR now. Form 1040-NR can be e-filed, a change from prior years when paper filing was required for NRAs.18Internal Revenue Service. If your only U.S. income was wages with tax withheld, your federal filing deadline is April 15 of the following year. If you had other types of U.S.-source income without withholding, the deadline extends to June 15. State returns follow each state’s own deadline and use the state’s nonresident form.
If Your Employer Withheld FICA by Mistake
Payroll errors happen, particularly with employers who don’t often hire international students. Start by asking your employer for a refund. They can correct the error by filing Form 941-X and refunding the amounts directly to you.3Internal Revenue Service. Foreign Student Liability for Social Security and Medicare Taxes
If your employer won’t or can’t refund it, you file the claim yourself with two forms:
- Form 843 is the refund claim itself. Check the box for a refund of Social Security or Medicare tax withheld in error because your employer won’t adjust the overcollection.20Internal Revenue Service. Instructions for Form 843
- Form 8316 attaches to Form 843. It gives the IRS the details of why the withholding was wrong and confirms you tried the employer route first.21Internal Revenue Service. Form 8316
The claim covers only the employee portion of FICA (7.65%). The employer portion is between the employer and the IRS. Keep copies of your W-2, I-20, and passport as supporting documentation.
When Your Status Flips: The Dual-Status Year
The calendar year in which you transition from NRA to resident alien is a “dual-status” tax year. For the NRA portion, you’re taxed only on U.S.-source income. For the RA portion, worldwide income.22Internal Revenue Service. Taxation of Dual-Status Individuals
Dual-status returns come with restrictions worth knowing about in advance. You can’t claim the standard deduction, can’t file jointly with a spouse (unless your spouse is a U.S. citizen or resident and you both elect joint filing), and can’t claim the earned income credit or education credits. These limits can push your tax bill higher than either a full NRA year or a full RA year.
Your FICA exemption ends the day you become a resident alien. If your CPT spans that transition, your employer should stop the exemption on that date and begin withholding the standard 7.65% on all wages earned afterward.
