Hong Kong Residence: Seven-Year Rule, Visas, and Permanent Residency

To get permanent residency in Hong Kong, most people need to live in the territory continuously for seven years on a qualifying visa, then apply to the Immigration Department to verify their eligibility and issue a Permanent Identity Card. The requirement comes from Article 24 of the Basic Law, which lists six categories of permanent residents.1Basic Law. Basic Law – Chapter III The exact path depends on your nationality, the visa you enter on, and whether the time you spend in Hong Kong counts as “ordinary residence.”

The Seven-Year Rule and Who It Applies To

Chinese citizens qualify for permanent residency if they were born in Hong Kong, or if they have lived there continuously for at least seven years. Children born abroad to a parent in either of those categories also qualify.

Non-Chinese nationals face a narrower route. You must have entered Hong Kong with a valid travel document, ordinarily resided there for at least seven continuous years, and formally declared Hong Kong as your only place of permanent residence. That declaration is filed on Form ROP 146, and the Director of Immigration weighs whether it holds up by looking at where your immediate family lives, whether you work for a Hong Kong employer, and whether you keep a home in the territory.2Immigration Department, the Government of the Hong Kong Special Administrative Region. Which Visas Start the Seven-Year Clock

Not every kind of stay counts. The visa you enter on determines whether your time in Hong Kong is building toward permanent residency or not.

Employment Visa

The most common route is the employment visa under the General Employment Policy. You need a job offer from a Hong Kong employer for a role that calls for skills or experience not readily available locally. The employer sponsors the visa, which is typically granted for one to two years and renewed. Each year on this visa counts.

Top Talent Pass Scheme

The Top Talent Pass Scheme lets high earners and graduates of top-ranked universities enter without a job offer. Category A is for anyone who earned HK$2.5 million or more in the year before applying and comes with a 36-month stay. Category B covers graduates of universities on the government’s approved list who have at least three years of work experience in the past five, and Category C covers recent graduates of those same universities with less than three years of experience; both get 24 months, and Category C is subject to an annual quota.4Immigration Department. Dependant Visa

If your spouse or parent holds an employment visa, an investment visa, or permanent resident status, you can apply for a dependant visa. Dependants of employed professionals and permanent residents can work without any extra permission. Dependants of students need prior approval from the Director of Immigration before taking a job.5Immigration Department. Dependants Time on a dependant visa counts toward the seven years.

Quality Migrant Admission Scheme

The Quality Migrant Admission Scheme is for skilled people who want to settle in Hong Kong without lining up a job first. You’re assessed under a points-based system that weighs age, education, work experience, and language ability, or under an achievement-based system for people with exceptional accomplishments. Successful applicants can work for any employer, which offers more flexibility than an employment visa tied to a single sponsor.

What “Ordinary Residence” Actually Requires

The seven-year clock only runs while you are ordinarily resident, and Hong Kong defines that term specifically. You qualify if you remain in the territory legally, voluntarily, and for a settled purpose such as employment, education, or family life. Short absences don’t automatically break the count.6Immigration Department. Meanings of Right of Abode and Other Terms

When the Immigration Department decides whether an absence broke your residence, it looks at how long and how often you were away, whether you kept a home in Hong Kong, whether your employer is based there, and where your spouse and minor children live. Someone posted overseas by a Hong Kong company for a few months looks very different from someone who quietly relocated abroad.

Some people are excluded from counting their time no matter how long they stay. Foreign domestic helpers, imported contract laborers under government schemes, members of the Chinese garrison, consular staff, refugees awaiting status determination, and anyone serving a prison sentence do not accumulate qualifying residence.6Immigration Department. Meanings of Right of Abode and Other Terms A domestic helper who has lived in Hong Kong for 15 years has zero qualifying years toward permanent residency. This exclusion catches more people off guard than anything else in Hong Kong immigration law.

How to Apply Once You Hit Seven Years

The Immigration Department does not upgrade your status automatically. You have to apply for verification of eligibility and, if approved, collect a Permanent Identity Card. The process is free.7Immigration Department. Fee Tables

Forms and Documents

The core of the application is Form ROP 145, which covers adults and children under 18; a parent or guardian completes it for minors.8Immigration Department, the Government of the Hong Kong Special Administrative Region. You need to prove you lived in Hong Kong continuously for seven years with a settled purpose. Gather utility bills, rental agreements, bank statements, employment contracts, and tax demand notes from the Inland Revenue Department. If part of your residency was spent studying, bring academic transcripts. Your travel document matters most: the department reviews every visa label, entry stamp, and exit stamp to calculate your time outside the territory. Make sure the dates on your form match your travel record exactly, because inconsistencies slow the review.

Timeline

You can submit the package by mail or through the government’s online portal. Verification generally takes six to eight weeks. If the preliminary result is positive, you’re called into the Immigration Department in person to present the originals of everything you submitted as copies, and the department collects biometric data, including fingerprints, at that appointment. The Permanent Identity Card is ready for collection within about two weeks after that.9GovHK. Online Application for Verification of Eligibility for Permanent Identity Card

If you’re denied, you can ask the Immigration Department to reconsider by presenting new information that wasn’t available during the original review. Beyond that, the Immigration Ordinance provides for an appeal through the Secretary for Security’s office, though the process is slow and you cannot remain in Hong Kong on a visitor visa while it plays out.

Keeping Permanent Residency After You Get It

Non-Chinese permanent residents who leave Hong Kong for a continuous stretch of 36 months or more after ceasing to ordinarily reside there lose their permanent resident status. When that happens, they automatically acquire the Right to Land, a secondary status that lets them enter, live, work, and study in Hong Kong without conditions.10Immigration Department. Loss of Hong Kong Permanent Resident Status The practical difference is that the Right of Abode gives absolute protection against deportation and the Right to Land does not, a distinction that matters mainly in edge cases involving criminal convictions or security concerns.

The loss isn’t necessarily permanent. If you return to Hong Kong and again build up seven continuous years of ordinary residence while holding a valid travel document and filing a fresh declaration, you can regain the Right of Abode.11Immigration Department. Right of Abode Chinese citizens follow different rules; their Right of Abode does not generally lapse based on absence alone.

What Permanent Residency Gets You

Beyond unrestricted living and working, permanent residents can switch employers, start a business, or freelance without notifying the Immigration Department. Temporary visa holders are typically tied to a specific employer, and changing jobs means securing a new visa before they can start.

Only permanent residents aged 18 or older who ordinarily reside in Hong Kong can register to vote in geographical constituency elections.12Voter Registration.
