Health policy in Congress is not the work of one committee. It is split among roughly a half-dozen committees in each chamber, and the health committees in Congress are divided by function: some authorize programs and write the rules, some finance the entitlements and tax provisions, and some appropriate the annual dollars. Knowing which committee does which piece is the difference between following a health bill and losing it.
The Main Authorizing Committees
Two committees write most of the underlying rules for federal health programs. In the House, it is Energy and Commerce. In the Senate, it is Health, Education, Labor, and Pensions (HELP).
House Energy and Commerce
Energy and Commerce holds the broadest authorization jurisdiction of any House committee, and health sits at the center of it. Its reach covers the FDA, NIH, CDC, Indian Health Service, and much of the Department of Health and Human Services, along with private health insurance, biomedical research, mental health, substance abuse, food and drug safety, and the 340B drug discount program.1House Committee on Energy and Commerce. The committee also claims authorization jurisdiction over Medicare, Medicaid, and CHIP, which is where things get complicated. Ways and Means controls the financing side of the same programs. Energy and Commerce writes how the programs operate; Ways and Means writes how they are paid for. Major bills that touch both end up in both committees, sometimes producing competing versions of the same provision.1House Committee on Energy and Commerce. Energy and Commerce Jurisdiction
Most of the day-to-day work happens in the Health Subcommittee, which runs hearings and markups before sending bills up to the full committee.2Democrats Energy and Commerce Committee. About E&C
Senate HELP
HELP is the closest Senate counterpart. Its jurisdiction covers public health, biomedical research, aging, individuals with disabilities, and occupational safety, among other areas.3Senate Committee on Health, Education, Labor and Pensions. HELP also runs confirmation hearings for presidential nominees to senior health positions, including the Surgeon General and the NIH director.5Senate Committee on Health, Education, Labor and Pensions. Nominations Those hearings are often where policy fights get their first public airing.
The Tax-Writing Committees Control the Entitlements
The largest single category of federal health spending flows through the tax-writing committees: House Ways and Means and Senate Finance. They control the financing of Medicare, Medicaid, CHIP, and other programs funded through the Social Security Act or dedicated trust funds.6United States Senate Committee on Finance. Medicare covers people 65 and older, certain individuals with disabilities, and those with end-stage renal disease.7Social Security Administration. The tax-writing committees also handle health provisions inside the Internal Revenue Code, including tax credits and deductions tied to health insurance premiums and health care costs.9United States Committee on Ways and Means. They read like health policy, but because they sit in the tax code, they belong to Ways and Means and Finance.
Appropriations Provides the Actual Dollars
Authorization and funding are two separate steps. A program can be authorized to exist and receive nothing. Money for discretionary health programs comes from the Appropriations Committees, specifically their Labor, Health and Human Services, Education, and Related Agencies (LHHS) subcommittees.
For fiscal year 2026, the LHHS bill provided $116.8 billion in discretionary funding for HHS alone, out of $224 billion in total discretionary funding covered by the bill.10United States Senate Committee on Appropriations. Appropriations bills also carry policy riders that go well beyond dollar amounts. The FY2026 bill, for instance, blocked NIH from capping indirect cost rates at 15 percent and prevented implementation of an OMB policy on multi-year research grant funding.10United States Senate Committee on Appropriations. Health Programs That Sit Outside the Main Health Committees
Several large federal health programs are not overseen by any of the committees above, which is a common source of confusion.
- Veterans’ health care runs through the House and Senate Committees on Veterans’ Affairs. The House committee’s Health Subcommittee has jurisdiction over veterans’ medical services, medical research, prosthetics, and VA health care facilities.11House Committee on Veterans’ Affairs. Health
- The Indian Health Service falls under the Senate Committee on Indian Affairs, which has jurisdiction over all matters relating to Indian affairs including Indian health programs. In the House, jurisdiction over Indian health is shared between Energy and Commerce and the Natural Resources Committee.12Indian Affairs Committee. Jurisdiction
- Military health care, including TRICARE and the Defense Health Agency, sits with the House and Senate Armed Services Committees and is authorized through the annual National Defense Authorization Act.
How Overlapping Jurisdiction Gets Resolved
Most health bills touch more than one committee’s territory. Congress has two main ways of dealing with that.
Multiple Referrals
In the Senate, a bill is normally referred to the single committee with jurisdiction over its primary subject. Referral to more than one committee is unusual and typically requires a unanimous consent agreement between the affected committees, or a joint motion by the majority and minority leaders with advance notice in the Congressional Record. Those agreements can send a bill to two committees at once, send it sequentially, or split specific sections between committees.13Congress.gov. Committee Jurisdiction and Referral in the Senate The House process is more flexible, and the Speaker can refer different portions of a bill to different committees.
The practical effect is that major health legislation involves negotiation between committees before anything reaches the floor. The Affordable Care Act moved through both HELP and Finance in the Senate and through both Energy and Commerce and Ways and Means in the House.
Budget Reconciliation
Some of the biggest health legislation of the past several decades has passed through budget reconciliation, which lets certain spending and revenue bills clear the Senate without facing a filibuster. Reconciliation works through directives in a budget resolution that name specific committees and give each one a budgetary target. A committee not named in the directives cannot contribute to the reconciliation bill.14Congress.gov. The Reconciliation Process: Frequently Asked Questions
Only Ways and Means and Finance can receive revenue-related instructions. Any committee with jurisdiction over mandatory spending can receive spending instructions. The directives set a dollar target and a time period and leave the policy design to each committee.14Congress.gov. The Reconciliation Process: Frequently Asked Questions Reconciliation has been used to enact and modify major health programs, including parts of the Affordable Care Act and changes to Medicaid eligibility, precisely because it avoids the 60-vote threshold.
Following Committee Activity
Congress.gov is the central hub for tracking any committee’s work. It carries committee profile pages, hearing schedules for both chambers, searchable committee materials, and a legislation search that filters by committee, Congress session, or keyword. Committee reports back to 1994 and video of hearings are available on the site.15Congress.gov. Committees of the U.S. Congress
Each committee also runs its own website with hearing schedules, witness lists, and archived video. These usually post recordings and related documents faster than the formal congressional publishing process, which can take months to produce official transcripts. Committee sites are particularly useful for tracking markups, where members debate and amend bills line by line. If you want to see exactly what changed in a health bill and why, the markup record is where to look.
