An H-4 visa application comes together around a short core checklist: a passport valid at least six months beyond your intended stay, a completed DS-160 with its confirmation printout, the $205 visa application fee, the H-1B principal’s I-797 approval notice with recent employment evidence, and an official document proving your family relationship to that H-1B worker. Everything else in the H-4 visa documents checklist supports one of those five pieces. Build the file before you book the interview, because a consular officer will turn away an otherwise strong case over a single missing item.
Your Own Documents
Start with your passport. It must be valid for at least six months beyond your planned period of stay in the United States.1U.S. Customs and Border Protection. Next, the DS-160. Every H-4 applicant files this electronic nonimmigrant visa application through the Consular Electronic Application Center, entering biographical details, travel history, and educational background.2U.S. Department of State. Print the confirmation page with its barcode, because the consular officer uses that barcode to pull up your file. Save a backup copy electronically.
Photo requirements vary by post. Some consulates require one physical photo at the interview; others rely entirely on the digital photo uploaded with the DS-160.3U.S. Department of State. The photo must be in color, taken within the last six months, shot against a plain white or off-white background, and show a full-face view with both eyes open. Eyeglasses are not allowed unless you carry a signed medical statement explaining why they cannot be removed.
Documents from the H-1B Principal
Your eligibility depends on the principal H-1B holder’s status, so a large share of the file is their paperwork. The H-4 is admitted for the same period as the principal spouse or parent and cannot stay beyond that date.4eCFR. 8 CFR 214.2 – Special Requirements for Admission, Extension, and Maintenance of Status
The anchor document is Form I-797, Notice of Action. This is the USCIS approval notice for the H-1B petition, and it shows the validity dates of the principal’s authorized stay.5U.S. Citizenship and Immigration Services. Form I-797 Types and Functions If the H-1B holder has had multiple approvals or extensions, include copies of all prior I-797s to show a continuous history.
Include also:
- Three to six months of the principal’s recent pay stubs, showing active employment and a salary at or above the prevailing wage.
- An employment verification letter on company letterhead confirming job title, current salary, and ongoing employment under the H-1B terms.
- A copy of the Labor Condition Application certified by the Department of Labor, which establishes that the employer is paying at least the prevailing wage for the position and geographic area.6U.S. Department of Labor. - A photocopy of the principal’s current H-1B visa stamp and the biographical page of their passport, so the officer can cross-reference records.
If the H-1B principal is on an extension beyond the standard six-year limit under the American Competitiveness in the Twenty-first Century Act (AC21), add the principal’s prior I-94 records, all I-797 notices for I-129 petitions, and evidence of the basis for the extension. That basis is usually a pending or approved I-140 petition, or a labor certification application filed at least 365 days before the AC21 extension period began.7U.S. Citizenship and Immigration Services. Proof of the Family Relationship
The consular officer has to verify that you are actually the spouse or child of the H-1B worker. For spouses, the primary document is an official marriage certificate issued by a government registry and bearing the registering agency’s seal or stamp. USCIS also recognizes customary and common-law marriages in jurisdictions where they are legally valid, though these require supporting evidence such as joint tax returns, shared mortgage documents, or third-party affidavits.8U.S. Citizenship and Immigration Services. For dependent children, bring a birth certificate that lists both parents’ names. Hospital-issued birth records and decorative certificates generally do not satisfy the requirement; the document should come from an official government registry.
Any vital record in a language other than English needs a certified English translation. The translator provides a signed statement confirming competence in both languages and the accuracy of the translation, along with their name, address, and date of certification.
When official certificates are unavailable because a government registry does not exist or the records were destroyed, immigration authorities will consider secondary evidence such as affidavits from people with knowledge of the relationship, church records, or other documents showing the family connection.9U.S. Citizenship and Immigration Services. Financial Evidence the Officer May Ask For
The H-4 does not require a formal Affidavit of Support the way family-based immigrant visas do. Still, consular officers commonly ask how the household plans to support itself, and showing up with nothing on that front is a mistake. The principal’s pay stubs and employment letter carry most of this, and a few extras help: bank statements from the last two to three months showing household savings, recent federal tax returns filed jointly or listing the dependent, and any documentation of employer-provided housing or relocation benefits. None of these are formally mandated by regulation for H-4 applicants, but a consular officer has broad discretion to ask about public-charge concerns, and having them ready avoids a scramble.
Fees and the Interview
Before scheduling the appointment, pay the Machine Readable Visa (MRV) fee. H-4 falls under the petition-based category because it derives from the H-1B petition, and the current application fee is $205.10U.S. Department of State. Fees for Visa Services Some nationalities also owe a separate visa issuance (reciprocity) fee after approval; the amount depends on your country of citizenship and can be checked on the State Department’s reciprocity schedule.
H-4 applicants generally must attend an in-person interview. As of October 2025, interview waivers are not available for H-4. The waiver program is limited to certain diplomatic categories and narrow renewal scenarios for B-1/B-2 and H-2A visas.11U.S. Department of State. Interview Waiver Update September 18, 2025
At the consulate, staff first verify your physical documents against the DS-160 digital record. The interview itself is short, usually a few minutes, and focuses on your relationship to the H-1B worker, your living arrangements in the U.S., and your intent to return home after the authorized stay. If the officer approves the visa, your passport is typically held for three to five business days while the visa stamp is placed, then returned by courier or made available for pickup.
If You Are Already in the U.S.: The I-539 Packet
If you are inside the United States on another nonimmigrant status and want to switch to H-4, or your current H-4 is about to expire, you file Form I-539 with USCIS rather than going through a consulate.12U.S. Citizenship and Immigration Services. Application to Extend/Change Nonimmigrant Status Submit it before your current status expires. Missing that deadline starts the clock on unlawful presence, which creates serious problems for future immigration benefits.
You can file on paper by mail or electronically through the USCIS portal. Individual applicants filing alone and without legal representation can use the online option; families applying together can submit a single paper I-539 covering the principal applicant and co-applicants, with one filing fee.13U.S. Citizenship and Immigration Services. USCIS announced fee increases effective January 1, 2026, so applications postmarked on or after that date must include the updated amount.
The I-539 packet requires much of the same evidence as a consular application: the principal’s I-797 approval notice, pay stubs, employment letter, proof of the family relationship, and copies of both the applicant’s and principal’s passports and I-94 records.
If You Want to Work: The I-765 Packet
H-4 status alone does not authorize employment. Certain H-4 spouses can apply for an Employment Authorization Document by filing Form I-765. You are eligible if the H-1B spouse falls into one of two categories:7U.S. Citizenship and Immigration Services. Employment Authorization for Certain H-4 Dependent Spouses
- The H-1B spouse is the principal beneficiary of an approved Form I-140. Submit a copy of the I-140 approval notice (Form I-797); if that notice is unavailable, the I-140 receipt number can serve as secondary evidence.
- The H-1B spouse has been granted an AC21 extension beyond the six-year limit. Include copies of the H-1B holder’s passports, I-94 records, and all I-129 petition approval notices, along with proof that the underlying labor certification or I-140 was filed at least 365 days before the AC21 extension period started.
In either case, you must also show that you are currently maintaining H-4 status and that your spouse is currently in H-1B status.4eCFR. 8 CFR 214.2 – Special Requirements for Admission, Extension, and Maintenance of Status H-4 children are not eligible for employment authorization under this provision; it applies only to spouses.
