H4 EAD Cover Letter: What to Include, Enclosures, and Filing

An H-4 EAD cover letter is a one-page routing summary you place on top of your Form I-765 packet. It is not required by USCIS, but it tells the intake officer who you are, that you are filing under eligibility category (c)(26) as the H-4 spouse of an H-1B worker, which pathway makes you eligible, and exactly what documents are enclosed. Written well, it works as a table of contents for the packet and helps prevent misrouting at the lockbox.

Identify Your Eligibility Basis Before You Write

The letter has to name the basis for your eligibility, so settle that first. H-4 spouses qualify for an EAD through one of two routes tied to the H-1B spouse’s immigration history.

The first route is that your H-1B spouse is the primary beneficiary of an approved Form I-140, Immigrant Petition for Alien Workers. The second route applies when your H-1B spouse has been granted status beyond the six-year H-1B limit under the American Competitiveness in the Twenty-First Century Act (AC21), sections 106(a) and (b). This generally requires that a labor certification application or I-140 petition was filed at least 365 days before the extended H-1B period began. On this route, your evidence includes the H-1B spouse’s passports, prior I-94 records, current and prior I-797 notices for Form I-129, and documents establishing the AC21 basis.1U.S. Citizenship and Immigration Services. Information To Gather First

Before drafting, pull the details you will name in the letter. Your full legal name as it appears on your passport, date of birth, and your 11-character I-94 number from the CBP website.3U.S. Customs and Border Protection. I-94/I-95 Website From your H-1B spouse’s records, get the I-140 approval notice or the AC21 evidence described above, plus the receipt number from the most recent I-129 extension. That I-129 receipt number matters twice: your letter cites it, and its three-letter prefix determines which USCIS lockbox you mail to.

What To Put in the Cover Letter

Keep it to one page.

Header and Subject Line

Put your name, mailing address, phone number, email, and the date at the top. Below that, add a subject line beginning with “Re:” that names the filing. For example: Re: Initial Application for Employment Authorization (Form I-765), Category (c)(26). Swap “Initial” for “Renewal” if that is what you are filing. This one line tells the intake clerk what they are holding.

Body

The first paragraph states that you hold valid H-4 nonimmigrant status as the spouse of an H-1B visa holder and are applying for employment authorization under category (c)(26). Name your H-1B spouse and reference either the I-140 receipt number or the AC21 evidence, depending on your pathway. This gives the officer a direct verification trail without digging through exhibits.

The second paragraph is a brief bridge, one or two sentences, noting the enclosed Form I-765, supporting evidence, and filing fee. Do not re-summarize the evidence here. The enclosure list does that job.

Enclosure List

Close the letter with a numbered list of everything in the packet. A typical initial-application list:

  • Form I-765, signed and dated
  • Copy of your marriage certificate
  • Copy of your passport biographical page
  • Copy of your most recent I-94 record
  • Copy of the H-1B spouse’s I-140 approval notice (Form I-797) or AC21 supporting evidence
  • Copy of the H-1B spouse’s most recent I-129 approval or receipt notice
  • Two identical passport-style color photographs
  • Filing fee payment
  • Form G-1145 (optional, for electronic notification of receipt)

Form G-1145 is a one-page form you can clip to the front of the packet to get a text or email when USCIS accepts the filing. Assembling and Mailing the Packet

Packet Order

Cover letter on top, then Form I-765, then supporting evidence in the same order as your enclosure list. Use a binder clip or ACCO fastener, not staples, so USCIS staff can separate pages for scanning. If you are using Form G-1145, clip it to the very front.

Choose the Correct Lockbox

The mailing address depends on the three-letter receipt-number prefix on your H-1B spouse’s most recent I-797 for Form I-129, not your state of residence. Prefixes EAC, LIN, and MCT go to the USCIS Dallas lockbox. Prefixes WAC, SRC, and IOE go to the USCIS Phoenix lockbox. Filing Fee

USCIS updated its fee schedule in 2026 for statutory inflation adjustments. The I-765 filing fee changes periodically, so confirm the current amount on the USCIS fee page immediately before mailing. Tracking and Receipt

Use a trackable method, whether USPS Priority Mail, FedEx, or UPS, and keep the tracking number. Within a few weeks of delivery, USCIS issues Form I-797C, Notice of Action, as your formal receipt. That notice carries your unique case receipt number for status checks.

Renewal Letters: The Automatic Extension Is Gone

If you are writing a renewal cover letter, one change dominates everything else. An interim final rule effective October 30, 2025, eliminated the automatic extension of EADs for renewal applicants. Renewals filed on or after that date do not automatically extend your existing EAD while USCIS processes the new one.7U.S. Citizenship and Immigration Services. In practice, if your current EAD expires before USCIS approves the renewal, you must stop working. There is no grace period. For a renewal, change the subject line to Re: Renewal Application for Employment Authorization, add a copy of your expiring EAD (Form I-766) to the enclosure list, and reference your previous EAD receipt number in the body alongside the same eligibility information.

Filing the EAD With an H-4 Extension

USCIS recommends filing Form I-539 at least 45 days before your authorized stay expires.8U.S. Citizenship and Immigration Services. Application to Extend/Change Nonimmigrant Status When bundling, list all three forms in your cover letter and note the separate filing fees for each so the lockbox staff can split and route the forms correctly.

Mistakes That Trigger Rejection

Lockbox staff reject applications for clerical errors before an officer looks at the merits. The frequent ones:

  • Wrong filing fee, including being a few dollars off from using last year’s schedule.
  • Missing signature on Form I-765.
  • Wrong lockbox address, because the filer used their home state instead of the I-129 receipt prefix.

  • An old address on file. If you move after filing, update both USCIS and the U.S. Postal Service, because a lost notice can mean a missed appointment and, in some cases, refiling and paying the fee again.

The cover letter will not fix any of these on its own, but writing the enclosure list forces you to inventory the packet before it goes in the envelope. If your list says “filing fee” and there is no check inside, you catch it before USCIS does.
