H-4 Work Permit: Who Qualifies, How to Apply, and Renewals

An H-4 work permit is available to the spouse of an H-1B visa holder once the H-1B worker has reached a specific point in the green card process. You apply by filing Form I-765 with USCIS, currently $520 by paper or $470 online, and if approved you receive an Employment Authorization Document (EAD) that lets you take any job, freelance, or run your own business in the United States.

Who Qualifies

Only spouses. Children under 21 who hold H-4 status cannot apply, no matter how far along the H-1B parent is in the green card process.

For a spouse to qualify, the H-1B worker has to meet one of two conditions:

  • The H-1B worker’s employer has filed and received approval of Form I-140, Immigrant Petition for Alien Worker. USCIS has, at that point, confirmed the employer’s need for the worker and the worker’s qualifications for a green card category.
  • The H-1B worker has been granted an extension of stay beyond the normal six-year H-1B limit under sections 106(a) and (b) of the American Competitiveness in the Twenty-first Century Act. Workers stuck in green card backlogs often qualify for these AC21 extensions.

You also need to be maintaining valid H-4 status when you file. That status rides entirely on the H-1B worker’s continued employment and legal standing, so if the primary worker’s status lapses, your eligibility disappears with it.1U.S. Citizenship and Immigration Services. What to File

The core of the application is Form I-765, Application for Employment Authorization. On the form, select eligibility category (c)(26), which tells USCIS you’re applying as the spouse of an H-1B worker.2U.S. Citizenship and Immigration Services. Form I-765 Instructions

Assemble the supporting documents:

  • A government-issued marriage certificate proving your legal relationship to the H-1B worker. If it’s not in English, include a complete certified translation with the original.
  • Proof of the H-1B worker’s qualifying status: a copy of the approved I-140 receipt notice (Form I-797) or documentation showing an AC21 extension was granted.
  • Biographical passport pages for you and your spouse, plus copies of any previous U.S. visas.
  • The most recent Form I-94 arrival/departure records for both of you, showing current valid status.
  • Two passport-style photographs meeting USCIS specifications. Photos older than six months will be rejected.

Fees and Where to Send It

As of 2026, Form I-765 costs $520 by paper or $470 online. A fee increase took effect on January 1, 2026, so confirm the current amount on the USCIS fee schedule before mailing.4U.S. Citizenship and Immigration Services. The correct USCIS Lockbox address depends on where you live, so check the I-765 filing instructions. After USCIS receives the package, you’ll get Form I-797C, Notice of Action, which is your receipt and includes the number you’ll use to track the case online.5U.S. Citizenship and Immigration Services. Missing that appointment can lead to a denial.

How Long It Takes

H-4 EAD applications typically take several months. Reported timeframes run roughly 3 to 9 months depending on whether you’re filing an initial application or a renewal and which service center handles the case. USCIS publishes estimated processing times on its website; checking them before you file helps you plan around any employment gap.

Premium processing is not available for H-4 EAD applications. USCIS currently allows premium processing on Form I-765 only for certain other categories, such as F-1 students applying for OPT.6U.S. Citizenship and Immigration Services. Validity and the New Renewal Rules

As of December 2025, USCIS reduced the maximum validity period for newly issued EADs from five years to 18 months. That applies to both initial and renewal cards, so expect to file renewals more often than before.7U.S. Citizenship and Immigration Services. The bigger change is the loss of the automatic extension. Before October 30, 2025, filing a renewal before the card expired gave you up to 540 additional days of work authorization while USCIS processed it. That cushion is gone for any renewal filed on or after October 30, 2025. Your work authorization now ends the day after the date printed on your EAD, and you cannot work again until USCIS approves and issues your new card.8Federal Register. The regulation says plainly that the validity period of an expired EAD “will not be automatically extended by a request for renewal” for applications filed on or after October 30, 2025. With processing times running several months and no bridge in place, file your renewal as early as your current EAD allows, and plan financially for the possibility of a gap between cards.

If you filed a renewal before October 30, 2025, the old rule still applies to that filing: up to 540 days of automatic extension from the EAD’s expiration date, or until USCIS decides the case, whichever comes first. What the Permit Lets You Do

Once the EAD is approved, it’s unrestricted. You can work for any employer in any industry, take a part-time or full-time job, freelance on 1099 contracts, or start a business. There’s no requirement that the work match your education or field, no cap on hours, and no restriction on forming a corporation or LLC. Compared to most other employment-based immigration categories, the scope is genuinely broad.

Getting a Social Security Number

You need a Social Security number to work, and the easiest way to get one is to check the SSA box on Form I-765. USCIS then sends your information to the Social Security Administration, and SSA mails your card separately within about 14 days of your EAD arriving. If it doesn’t show up in that window, contact your local Social Security field office.11Social Security Administration. If you didn’t request the SSN on the I-765, you’ll need to visit a Social Security office in person once your EAD arrives. Bring the original card, not a photocopy, and your birth certificate. The card usually arrives within two to four weeks after SSA verifies your documents with USCIS.

If the H-1B Worker Loses Their Job

H-4 status depends entirely on the H-1B worker’s status, so a job loss by the primary worker puts the whole family at risk. Federal regulations provide a grace period of up to 60 days after the H-1B employment ends, during which the worker and dependents keep their status. Sixty days is a hard ceiling. Within it, the H-1B worker needs to find a new sponsoring employer, change to a different nonimmigrant status, or the family needs to prepare to leave. If the H-1B worker’s status ends without a resolution, your H-4 status and work authorization end with it.

Traveling While the Application Is Pending

International travel is risky if your paperwork is still with USCIS. A pending Form I-539 (used to extend or change H-4 status) is generally considered abandoned if you leave the country before a decision.13U.S. Citizenship and Immigration Services. Travel Documents If it’s abandoned, you’d need a new H-4 visa from a U.S. consulate abroad before you could come back.

The rule for a pending I-765 by itself is less clear. USCIS hasn’t published the same explicit abandonment language for the EAD form, and practitioners report inconsistent outcomes: some applicants have had EADs approved after they traveled, others have not. The safest move is to wait until both the H-4 extension and the EAD are approved before leaving the country.
