H-4 Visa Documents Required: Passport, DS-160, and Relationship Proof

The documents required for an H-4 visa fall into four groups: your own identity and photo documents, proof of your family relationship to the H-1B worker, evidence that the H-1B worker holds valid status and is actively employed, and the completed DS-160 application with fee receipts. Missing or thin paperwork in any of these groups is the usual reason applications stall, so the details are worth getting right the first time.

Your Passport and Photograph

Your passport must be valid for at least six months beyond your planned arrival in the United States. This is standard State Department policy. You also need a recent photograph that meets Department of State specifications: 2 inches by 2 inches, taken against a plain white or off-white background within the last six months. Eyeglasses are not allowed unless you have a signed medical statement explaining why they cannot be removed. Documents Proving Your Relationship to the H-1B Worker

Everything about the H-4 turns on the family connection, so consular officers look closely at relationship evidence. Spouses need an original government-issued marriage certificate. A religious ceremony certificate alone is not sufficient. Children need an original birth certificate that names both parents.

If a document is in any language other than English, include a certified English translation. The translator must sign a statement certifying the translation is complete and accurate and that they are competent to translate from the foreign language into English. The certification should include the translator’s name, signature, address, and date.3U.S. Department of State. Evidence the H-1B Worker Is in Valid Status

Your H-4 stay is tied directly to the principal H-1B holder. Federal regulations state that an H-4 dependent is admitted for the same period as the principal spouse or parent, and if the underlying status lapses, the H-4 lapses with it.4eCFR. 8 CFR 214.2 – Special Requirements for Admission, Extension, and Maintenance of Status Consular officers want current proof the H-1B worker is employed and in good standing. Bring:

  • A copy of the H-1B worker’s passport biographical page and current visa stamp.
  • The three most recent pay stubs from the H-1B employer.
  • A current employment verification letter on company letterhead.
  • The H-1B worker’s Form I-94. For entries by air or sea, the I-94 is generated electronically and can be retrieved at i94.cbp.dhs.gov using the traveler’s name, date of birth, and passport number exactly as they appear on the travel document. Land port entries may still have a paper I-94.

The employment letter is where most applicants underperform. A vague one-liner is not enough. The letter should state the H-1B worker’s full name, job title, annual salary, start date, and a sentence confirming current and ongoing employment. Officers use it to verify that the H-1B job still exists and matches what was approved in the petition.

The DS-160 Confirmation and Fee Receipts

Every H-4 applicant completes the DS-160, the Department of State’s online nonimmigrant visa application. Before you start, have your passport, travel itinerary, the H-1B worker’s I-129 petition information, and your last five U.S. travel dates ready. The nonimmigrant visa application fee (the MRV fee) for H-category visas is $205, paid through an approved bank or online payment system before you schedule your interview.7U.S. Department of State. Nonimmigrant Visa Fee Increases to Take Effect June 17, 2023 It is nonrefundable regardless of the outcome. Payment generates a receipt number you will need to book the appointment; bring the receipt to the interview.

Some applicants also owe a visa issuance reciprocity fee based on country of citizenship. The amount mirrors what that country charges U.S. citizens for a comparable visa, and it applies only if the visa is approved. Assembling the Packet for Your Interview

After the DS-160 is submitted and the MRV fee is paid, you schedule an appointment at a U.S. embassy or consulate. Some posts require a separate visit to a biometric collection center beforehand for fingerprints and a digital photograph; others handle biometrics at the interview itself.9U.S. Citizenship and Immigration Services. Bring the full packet organized and accessible:

  • Your passport, valid at least six months past your planned entry.
  • The DS-160 confirmation page with barcode.
  • The MRV fee receipt.
  • The interview appointment confirmation.
  • Your 2×2 photograph, printed.
  • Your marriage certificate or your birth certificate, with certified English translations if needed.
  • The H-1B worker’s I-797 approval notice, passport bio page and visa stamp, three recent pay stubs, current employment verification letter, and I-94.

The officer may ask about your relationship to the H-1B holder, your intended activities in the U.S., and your ties home. H-4 interviews are generally shorter than H-1B interviews, but incomplete documentation will delay or defeat the application either way.

If You Are Changing to H-4 Status Inside the U.S.

Applicants already in the United States on a different nonimmigrant visa can apply to change to H-4 status without leaving the country by filing Form I-539, Application to Extend/Change Nonimmigrant Status, with USCIS.10U.S. Citizenship and Immigration Services. The relationship and H-1B status evidence described above still applies, and you’ll add your own current passport and I-94.

USCIS eliminated the $85 biometric services fee for all Form I-539 applications filed on or after October 1, 2023, and applicants are generally no longer scheduled for a biometric appointment unless USCIS specifically determines one is needed. Premium processing is not available for H-4 change-of-status requests. Additional Documents if You Are Also Applying for a Work Permit

H-4 status by itself does not authorize employment, but certain H-4 spouses can apply for an Employment Authorization Document (EAD) by filing Form I-765. You are eligible if the H-1B worker is the principal beneficiary of an approved Form I-140, or if the H-1B worker has an extension of stay beyond the six-year limit under the American Competitiveness in the Twenty-first Century Act (AC21).12U.S. Citizenship and Immigration Services. The EAD packet requires documentary proof of the spousal relationship, evidence that the principal holds H-1B status, evidence that you hold H-4 status, and proof of the H-1B worker’s I-140 approval or AC21 eligibility. For the I-140 route, a copy of the I-140 approval notice is the simplest evidence.
