The H-4 EAD processing time at the Nebraska Service Center shifts constantly with filing volume and staffing, so the only reliable estimate is the one USCIS posts on its live processing times tool for Form I-765 under category C26. Historically the range has run from a few months to well over eight months during busy periods. The bigger issue for anyone renewing in 2026 is not the estimate itself but a rule change that took effect on October 30, 2025: USCIS ended automatic extensions of work authorization for EAD renewals filed on or after that date, which means whatever Nebraska’s processing time turns out to be, you cannot legally work during it.
Checking the Current Nebraska Estimate
USCIS publishes estimated processing times by form, service center, and eligibility category. For H-4 EADs, select Form I-765, the Nebraska Service Center, and category C26 on the USCIS processing times tool.1U.S. Citizenship and Immigration Services. Processing Times
Historic ranges at Nebraska have swung from a few months to over eight months. Seasonal surges in H-1B petitions ripple through to dependent filings because the Nebraska facility handles a large share of employment-based cases. Cases filed concurrently with an H-1B petition can move on a different track than standalone I-765 filings.
Treat the posted number as where most cases fall, not a promise. Individual files can land outside the window if USCIS requests additional evidence, if a background check takes longer to clear, or if the case is transferred between officers.
What the End of Automatic Extensions Means for 2026 Renewals
This is the change most H-4 EAD holders need to understand before anything else. Under an interim final rule effective October 30, 2025, USCIS eliminated automatic extensions of employment authorization for EAD renewal applications filed on or after that date.2U.S. Citizenship and Immigration Services. Interim Final Rule Published to End the Practice of Automatically Extending Certain Employment
Before the rule, a timely renewal filing kept you working for up to 540 days while USCIS processed the new card. That cushion is gone. If you file on or after October 30, 2025, your work authorization ends the day after your current EAD expires and does not resume until USCIS issues the new card. The Form I-797C receipt notice for a renewal filed under the new rule states explicitly that it is not evidence of employment authorization.
The practical result: whatever the Nebraska processing time turns out to be, that is how long you will be unable to work. File as early as USCIS permits, make the application clean enough to avoid an RFE, and know your expedite options before your card expires.
If your renewal was already pending before October 30, 2025, you may still benefit from the prior automatic extension of up to 540 days, provided you met the eligibility conditions when you filed.3U.S. Citizenship and Immigration Services. What Pushes a Case Past the Posted Time
Several things can drag a Nebraska case beyond the estimate. Some are within your control; others are not.
Requests for Evidence
An RFE pauses adjudication until USCIS receives your response. Officers usually issue one when they need more proof of the marriage, of the H-1B spouse’s qualifying status (an approved I-140 or AC21-based extension beyond six years), or of something specific in your filing. You have a maximum of 12 weeks to respond, and that maximum cannot be extended. Responding faster restarts the case sooner.4NAFSA: Association of International Educators. USCIS Standard Timeframes for RFE and NOID
Biometrics
If you haven’t previously given fingerprints and a photo to USCIS, expect a biometric appointment at a local Application Support Center. USCIS mails the notice with the date, time, and location. Missing it can stall your case indefinitely.5U.S. Citizenship and Immigration Services. Preparing for Your Biometric Services Appointment
Background Checks and Staffing
Security checks run through multiple federal databases at different speeds. Nebraska’s staffing rises and falls with federal budget cycles and internal reassignments. Neither is something you can influence, but a clean, complete filing keeps you from adding avoidable delay on top of them.
Faster Options: Premium Processing and Expedite Requests
USCIS offers premium processing on Form I-907 for certain I-765 categories, guaranteeing an adjudicative action within 30 business days.6U.S. Citizenship and Immigration Services. How Do I Request Premium Processing The eligible I-765 categories are limited. As of early 2026, the announced premium processing expansion for Form I-765 covers OPT and STEM-OPT at a fee of $1,780.7U.S. Citizenship and Immigration Services. USCIS to Increase Premium Processing Fees Check the USCIS premium processing page for the current list of eligible categories before assuming C26 is on it.
Where premium processing is not available, you can ask USCIS to expedite based on specific criteria:
- Severe financial loss, meaning job loss or an inability to work that produces real financial hardship — not simply the general need for the EAD.
- Humanitarian emergencies such as serious illness, disability, a family death, or extreme circumstances including natural disasters.
- A clear USCIS error that caused the delay.
Needing the EAD to start a job, on its own, does not qualify. You also cannot claim urgency created by your own late filing or by a slow response to an evidence request.8U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part A Chapter 5 – Expedite Requests
Tracking Your Case
Every application gets a receipt number: three letters followed by 10 digits. Nebraska cases carry the prefix LIN, for Lincoln.9U.S. Citizenship and Immigration Services. Checking Your Case Status Online The number is on Form I-797C, mailed after USCIS accepts your filing and fee.
Enter the receipt number without dashes in the Case Status Online tool at egov.uscis.gov. The system shows the latest action — for example, “Case Was Received,” “Request for Evidence Was Sent,” or “Card Is Being Produced.” A my.uscis.gov account adds email and text alerts when the status changes and a full case history.
Keeping Your Address Current
If you move while the case is pending, you have 10 days to update USCIS by filing Form AR-11 online.10U.S. Citizenship and Immigration Services. AR-11, Alien’s Change of Address Card This is a legal requirement. USCIS mails RFEs, biometric notices, and the EAD card itself to the address on file, and a returned mailing can end in denial.
When Your Case Passes the Posted Time
If your case has been pending longer than the posted processing time, you can submit a case inquiry through the USCIS e-Request portal. For forms not listed in the processing time table, USCIS asks you to wait at least six months before inquiring.11U.S. Citizenship and Immigration Services. e-Request – Check Case Processing
Before you submit, confirm USCIS has not taken any action in the past 60 days, including sending a notice, issuing an RFE, or updating the online status. Any of those within 60 days means USCIS considers the case actively in progress and will not process the inquiry. Service requests on Nebraska cases go back to that facility. They don’t guarantee faster action, but they create a formal record that you flagged the delay.
If the Card Was Mailed but Not Received
When your status shows the card mailed or delivered and it hasn’t arrived, submit a non-delivery inquiry through the USCIS e-Request system. USCIS provides a dedicated portal for reporting non-delivery.12U.S. Citizenship and Immigration Services. Employment Authorization Document Move quickly — your employer needs the physical card for I-9 verification, and a confirmed address on file lowers the chance of a second mailing going astray.
Travel While the Case Is Pending
Leaving the United States while a Form I-539 change of status to H-4 is pending generally causes that application to be treated as abandoned. The effect on a simultaneously pending I-765 is less predictable: some applicants have had the EAD approved after travel, others have seen it denied on the reasoning that the underlying H-4 status was abandoned. If H-4 status was already approved before departure, the risk to a pending EAD is lower but not zero. Talk to an immigration attorney before booking anything.
