Once USCIS receives a complete Form I-907 with the correct fee, a 30-business-day clock starts. Requests for Evidence Stop the Clock
An RFE pauses the 30-business-day clock entirely. When you send your response, a fresh 30-business-day window starts from the date USCIS receives it. In practice, a case with an RFE takes considerably longer than 30 business days start to finish, because you have to gather documents, submit them, and then wait through a new adjudication window. Respond quickly and completely. Incomplete RFE responses can lead to denial.
Refund If USCIS Misses the Window

Why This Matters More in 2026

If you filed a renewal before October 30, 2025 and it is still pending, the automatic extension may still apply to you. For anyone filing a renewal in 2026, losing the automatic extension changes the math. Without premium processing, a gap between the old EAD expiring and the new one being approved is a genuine possibility, and you cannot legally work during that gap.
Traveling While the Case Is Pending
Whether you can leave the country during premium processing depends on what you filed. If you already hold valid H-4 status and filed only Form I-765, USCIS generally keeps working on the application even if you travel abroad, and the case is not treated as abandoned.
The picture changes if you filed Form I-539 to change into H-4 status at the same time as the I-765. Leaving the U.S. before USCIS decides the I-539 typically causes that change-of-status application to be treated as abandoned, and because the I-765 depends on the I-539 approval, the work permit application can fall with it. Advance parole does not fix this.
Even when travel is technically fine, practical hazards remain. USCIS can issue an RFE or schedule biometrics while you are overseas, and missing either can hurt the case. Your new I-94 on re-entry can also affect the EAD’s validity period, since H-4 EAD expiration is tied to the I-94.
If the Application Is Denied
A denial is not necessarily the end, but it calls for fast action. You can generally file a motion to reopen or reconsider with USCIS, or submit a new I-765. The bigger question is status. If the EAD is denied but you still hold valid H-4 status, you can stay in the U.S. but cannot work.
