H-1B visa renewal stamping is the process of getting a new visa foil placed in your passport at a U.S. embassy or consulate abroad so you can re-enter the United States after international travel. Your Form I-797 approval notice proves your work authorization inside the country, but it will not get you back through a U.S. port of entry once the stamp in your passport has expired. In limited cases you can renew inside the United States through a State Department pilot program, but for most H-1B holders, renewal still means an appointment at a consulate overseas.
When You Actually Need a New Stamp
Not every trip abroad requires a fresh stamp. If the H-1B visa foil in your passport is still valid, you can travel and re-enter without any new stamping, even if the dates on the foil are earlier than the dates on your I-797. The two documents track different things: the I-797 governs your status inside the U.S., and the visa stamp is the entry document. An expired stamp only becomes a problem the moment you leave the country and want to come back.
There is a narrow exception known as automatic visa revalidation. H-1B holders can re-enter from Canada or Mexico with an expired visa stamp if the trip lasted fewer than 30 days, they hold a valid passport and I-94, and they did not apply for a new visa while abroad. Nationals of countries designated as state sponsors of terrorism cannot use this rule, and neither can anyone whose visa was previously cancelled. For a quick trip across either border, automatic revalidation avoids the consular process entirely.
Documents to Gather Before You Apply
The center of your application package is your Form I-797A or I-797B approval notice, which carries your petition receipt number and status validity dates. You also need a passport valid for at least six months beyond your planned stay, unless your country of citizenship has a bilateral agreement with the U.S. that waives that rule. Beyond those, you should have:
- An employment verification letter on company letterhead, signed by a supervisor or HR representative, confirming your job title, salary, and duties.
- Two or three recent pay stubs showing you are actually working in the role described in the petition.
- A copy of the approved Labor Condition Application your employer filed with the Department of Labor as part of your original petition. Carry supporting materials too: original degree certificates, transcripts, credential evaluations if applicable, prior I-797 notices, and recent tax returns. Consular officers have wide discretion to request more evidence, and having it in your bag is easier than emailing an attorney from a hotel.
Completing the DS-160
Every nonimmigrant visa applicant files the Form DS-160 through the Consular Electronic Application Center. 4U.S. Department of State. The employer information section is where mistakes cause the most problems. Enter the petitioner’s name and Employer Identification Number exactly as they appear on your I-797. A mismatch between your DS-160 and the underlying I-129 petition can prompt extra questioning at the interview window or trigger a delay. Upload your digital photo with the form, then print the confirmation page with its barcode. You’ll need it at your appointment.
Booking the Appointment and Paying Fees

Some applicants also owe a reciprocity fee if their country of citizenship charges similar fees to U.S. citizens seeking equivalent visas. The amount depends entirely on your nationality and ranges from nothing to several hundred dollars. Reciprocity fees are only charged if your visa is actually approved.
Wait times vary sharply by post. Consulates in India have historically had waits stretching into months during peak season, while less-trafficked posts sometimes have slots within days. If timing matters, compare wait times at multiple consulates before booking travel.
Dropbox Renewal vs. In-Person Interview
The scheduling system screens you against a set of questions to decide whether you qualify for an interview waiver, commonly called the “dropbox” process. The rough logic is that applicants renewing in the same visa category, without prior refusals, and whose previous visa hasn’t been expired too long can skip the interview and simply submit documents at a visa application center. If you qualify, the system issues a submission letter rather than an interview date, and the consulate reviews your file without a face-to-face meeting.
Everyone else attends an in-person interview. That means security screening, fingerprint collection, and a short conversation at a consulate window. The officer reviews your petition, asks about your job, and either approves the visa, requests more documents, or issues a refusal. Most interviews take only a few minutes.
Renewing Inside the United States: the Domestic Pilot
The State Department launched a pilot program in January 2024 allowing certain H-1B holders to renew their visa stamps without leaving the country. 7U.S. Department of State. Several applicants are excluded even if they meet the basic criteria:
- Anyone whose previous visa foil carries a “clearance received” or “accommodation” annotation, which signals prior administrative review.
- Anyone who needs a waiver of grounds of inadmissibility.
- H-4 dependents. The pilot does not cover spouses or children on H-4 visas, who still need consular processing abroad.
If your family holds H-4 visas, this creates a coordination problem. You might be eligible to renew domestically while your spouse and children need consular appointments overseas. Some families find it simpler to schedule everyone together at the same consulate during a planned trip.
After You Submit: Waiting, and the 221(g) Risk
After the interview or dropbox submission, track your case through the Consular Electronic Application Center using your DS-160 barcode. 9U.S. Department of State. Straightforward cases are usually processed and returned within one to two weeks, though this varies by consulate.
The outcome to prepare for is a refusal under Section 221(g) of the Immigration and Nationality Act. Sometimes the officer just needs one extra document, and you have one year to provide it before the application expires. 11U.S. Department of State. This is the practical risk of consular stamping. Your passport sits at the consulate, and you cannot re-enter the U.S. until processing ends and the visa is either issued or formally denied. Some holds resolve in days, others in months. There’s no reliable way to speed the process up, though your employer’s immigration attorney can sometimes make inquiries through the National Visa Center.
Reducing the Chance of Getting Stuck Abroad
- Time your appointment with a buffer. Build in at least three to four weeks after your appointment date before you must be back at work.
- Bring everything an officer could ask for: original degrees, transcripts, prior I-797s, tax returns, and credential evaluations.
- Apply in your country of nationality or residence when possible. Third-country processing at a consulate where you have no ties can raise questions and increase the chance of administrative processing.
- For short trips to Canada or Mexico under 30 days, consider automatic revalidation and skip the stamping process entirely.
Check Your I-94 and Visa Foil After Re-Entry
Once you’re back in the United States with a new stamp, verify the electronic I-94 admission record CBP creates at entry. Errors are more common than most people expect: the admission class may be wrong, or the “admit until” date may not match your I-797. If something is wrong, submit a correction request through the CBP website or email i94mil@cbp.dhs.gov with copies of your passport photo page, visa stamp, entry stamp, and a short description of the error. Corrections are typically processed within five business days. An incorrect I-94 can cause problems later with H-1B extensions, status changes, and green card filings, so don’t let it sit.
Look at the visa foil itself as well. Check your name, date of birth, passport number, and employer name. A typo won’t necessarily prevent entry, but it can cause confusion at the border and should be reported to the issuing consulate for correction.
