To get an H-1B visa stamped in India, you file the DS-160 online application, pay the $205 visa fee, book a biometrics appointment and a consular interview at one of five U.S. posts, and appear with a document package that proves your petition, your employment, and your relationship with the employer who sponsored you. When Stamping Is Actually Required

An I-797 approval notice lets you work in H-1B status inside the United States, but it is not a travel document. If you got your H-1B through a change of status without ever leaving the country, you have no visa foil in your passport. The moment you fly out, you need a stamp to fly back in. The same is true if your previous stamp has expired, even when the underlying petition is still valid.

Workers who switched employers face a related situation. An old valid stamp tied to a former employer can often get you back in when paired with the new approved petition, but many people prefer to get a fresh stamp tied to their current employer to avoid questions at the port of entry. A trip home to India is the usual moment to handle it.

Interview Waiver (Dropbox) Rules for 2025 and 2026

The dropbox process used to let returning H-1B holders skip the consular interview if their prior visa had expired within the last 48 months. That eligibility window was cut sharply in 2025. Under Department of State guidance effective October 1, 2025, the standard interview waiver for renewals applies only to B-1/B-2 visitor visas and H-2A agricultural worker visas.2U.S. Department of State. The underlying statute still allows consular officers to waive interviews for applicants renewing within 12 months in the same visa class, provided the applicant is in their country of usual residence and has no prior refusals, and the Secretary of State can grant waivers in the national interest or during unusual circumstances.3Office of the Law Revision Counsel. 8 USC 1202 – Application for Visas In practice, plan on a full interview. Documents to Bring

Assemble everything before you leave the United States. Rebuilding a document package from India while your appointment is a week away is a bad position to be in.

Application and Fee

Start with the DS-160 Online Nonimmigrant Visa Application on the Consular Electronic Application Center site. It takes around 90 minutes to complete, and every answer needs to line up with your petition, since the officer will read it before your interview.4U.S. Department of State. Petition and Employment Papers

The single most important document is your Form I-797 Notice of Action for the approved H-1B petition.6U.S. Citizenship and Immigration Services. Add the certified Labor Condition Application your employer filed with the Department of Labor, an employment verification letter on company letterhead showing your job title, duties, salary, and work location, and recent pay stubs. Passports and Photographs

Bring every passport you have held, current and expired. Officers look at your full travel history and prior visa stamps. Your current passport must be valid for at least six months beyond your intended U.S. entry date.

Extra Evidence for Client-Site Workers

If you work at a client site rather than at your employer’s own office, this section matters more than any other. Consular officers scrutinize the employer-employee relationship closely, and IT consulting placements draw the most pointed questioning.

Get a letter from the end client, on client letterhead, describing your duties at the client location, stating how long the project is expected to run, and confirming that you remain an employee of your sponsoring company rather than of the client. Include a signed contract or statement of work between your employer and the client. Recent performance reviews, project emails, and an organizational chart showing that you report back to your sponsoring employer all help. The point is to show that your employer, not the client, controls your work, pay, and terms of employment. Officers who are not satisfied on this point refuse the visa or push the case into administrative processing.

Gather this before you fly. Asking a client for a customized letter while you are sitting in India waiting for an interview rarely works on the timeline you need.

Booking and Attending the Appointment

Once your DS-160 is submitted and the fee is paid, log into the U.S. visa scheduling portal. You need two appointments: biometrics at a Visa Application Center first, then the interview at an Embassy or Consulate.8U.S. Embassy & Consulates in India. Wait times swing by post and by season. Hyderabad and Chennai often move faster than Mumbai and New Delhi, though this shifts through the year. Compare all five before committing. Summer is the busiest stretch, when workers combine home leave with stamping.

If a genuine emergency prevents waiting for a regular slot, you can request an expedited appointment through the portal. Qualifying reasons include urgent medical treatment, the death of an immediate family member, and unplanned business travel, all with supporting documentation such as a doctor’s letter or death certificate. Slots are limited and approval is not guaranteed, so this is not a route around normal backlogs.

Electronic devices, large bags, and food are not allowed inside the consulate. Arrive about 15 minutes early. After security, wait for your window number to be called. The officer will review your documents, ask about your job duties and employer, and verify petition details. For client-site cases, expect direct questions about who supervises your daily work and what happens when the current project ends. Most interviews finish in under five minutes when the paperwork is clean and answers match the petition. The officer will either approve, issue a 221(g) refusal for more information, or deny.

H-4 Dependents Applying With You

Spouses and children usually apply for H-4 dependent visas at the same time. Each dependent files a separate DS-160 and pays the $205 fee, and they can interview alongside the H-1B applicant or on their own schedule.

Relationship proof is what makes H-4 cases distinct. A spouse needs the original marriage certificate. If you married in India but never registered the marriage, register it before your appointment. Wedding photos, invitation cards, and joint financial documents like bank statements naming both spouses help. For children, bring the original birth certificate listing the H-1B parent, and be ready to explain any name difference between the birth certificate and the passport with supporting documents. Dependents should also bring a copy of the primary applicant’s I-797, the employer verification letter, recent pay stubs, and tax returns, since the strength of the H-1B case directly supports the H-4.

If the Officer Issues a 221(g)

A 221(g) refusal is not necessarily permanent. It means the officer decided you had not established eligibility at the time of the interview, but the case can move forward with more information or further review.9U.S. Department of State. Administrative Processing Information

Two scenarios are common. In the first, the officer hands you a letter listing specific documents, such as a stronger client letter or additional proof of your qualifications. You submit them, and the case moves once they are reviewed. Document-based 221(g) cases often resolve within a few weeks. In the second, the case goes into security-related administrative processing. You do nothing, and the timeline is unpredictable, sometimes running from weeks to several months. The State Department says only that processing times “vary based on individual circumstances.”

Your passport stays with the consulate during this period, so you cannot travel. There is no reliable way to expedite. Contacting the consulate or a Congressional office rarely speeds things up. Budget extra time in India and consider arranging remote work if you can, because a 221(g) is the biggest scheduling risk of the entire process.

Why Cases Get Refused

  • Weak employer-employee evidence. The top reason for refusals among IT consulting workers. If the officer is not convinced your sponsor controls your work rather than the client, the visa gets denied. Vague job descriptions or duties that do not match the petition raise immediate flags.
  • Specialty occupation doubts. The officer may question whether your role actually requires a bachelor’s degree in a specific field. Broad titles like “business analyst” or “systems administrator” face heavier scrutiny than narrowly defined engineering roles.
  • Wage discrepancies. Actual pay that does not align with the prevailing wage on the LCA, or tax returns showing significantly less income than the petition promised, will draw pointed questions.
  • Missing or inconsistent documents. A missing pay stub or a DS-160 answer that contradicts the petition can derail an interview.
  • Prior immigration issues. Overstays, unauthorized employment, previous refusals, and earlier 221(g) cases all add scrutiny.

Review your petition before the interview so you can describe your duties, salary, and employer relationship in your own words. Officers can tell when an applicant understands their case versus reciting a script.

Passport Return and Timing

After approval, track your case status on the Consular Electronic Application Center site using your DS-160 barcode. Status moves from “Approved” to “Issued” once the visa foil is printed and placed in the passport. Straightforward approvals typically come back within 7 to 14 business days of the interview. Anything that requires additional review takes longer, and security-related 221(g) holds have no reliable timeline. Domestic Renewal as an Alternative

The State Department launched a limited pilot in early 2024 letting some H-1B holders renew their stamps without leaving the United States by filing the DS-160, paying the $205 fee, and mailing in their passport. Processing ran six to eight weeks with no expedited option. The pilot was narrow, restricted to H-1B holders whose prior visas were issued at specific consulates during specific windows.
