H-1B visa stamping and consular processing is the step where a U.S. embassy or consulate abroad places a physical visa foil in your passport after USCIS has already approved your H-1B petition. The approval notice alone does not let you board a flight or enter the country; you need the stamp for that. The process runs in a set sequence: complete the DS-160 online application, pay the visa fee, book an interview at a U.S. consulate, appear in person with your documents, and wait for your passport to come back with the foil affixed.1U.S. Department of State Foreign Affairs Manual. 9 FAM 402.10 – Temporary Workers and Trainees – H Visas Most applicants finish it without incident. A minority run into holds or denials that could have been avoided with better preparation.
Who Actually Needs a Stamp
If you are outside the United States, you need a valid H-1B visa stamp before traveling. If USCIS approved a change of status for you inside the U.S., you can work without ever getting a stamp, but the moment you leave the country you’ll need one to come back.
There is a narrow exception. If your stamp has expired and you take a trip of 30 days or fewer to Canada, Mexico, or certain adjacent islands, you may re-enter on the expired stamp under automatic visa revalidation, provided you have a valid I-94.2U.S. Department of State. Automatic Revalidation Nationals of countries designated as state sponsors of terrorism (including Iran, Syria, and Sudan) cannot use it. Neither can anyone who applied for a new visa that hasn’t been issued, or who was denied a new visa. Outside those situations, plan on getting a fresh stamp before you travel back.
Documents to Bring
The consular officer independently verifies that your petition is legitimate and that you qualify for the role. A clean, organized packet reduces the odds of a 221(g) hold.

- Passport valid for at least six months beyond your intended stay. Citizens of certain countries are exempt from the six-month rule under bilateral agreements and only need validity through the stay itself. - Copy of the I-129 petition and the certified Labor Condition Application (Form ETA-9035). Officers look closely at the prevailing wage and worksite listed on the LCA.
- Employment verification letter on company letterhead confirming title, salary, duties, and that the position is still available. If you’re currently working in the U.S., add a recent pay stub showing you’re paid the LCA wage.
- Degree certificates and transcripts. If your degree is foreign, a credential evaluation from a recognized agency helps establish the specialty-occupation match.
- DS-160 confirmation page with the barcode.
If your employer places you at a third-party client site, bring the client letter, the statement of work, and the master services agreement. Third-party placements get extra scrutiny because the officer wants to see that your petitioning employer, not the client, controls your day-to-day work.
Filing the DS-160
Every applicant completes the DS-160 through the Consular Electronic Application Center.4U.S. Department of State. DS-160 – Online Nonimmigrant Visa Application The form asks for personal history, travel records, employment details, your sponsoring employer’s tax ID and address, education back to high school, and biographical information about parents and spouse.
Enter your name exactly as it appears in your passport. Even small discrepancies cause problems at the interview window. You’ll also upload a digital photo meeting State Department specifications; the system rejects anything off-spec, so use the free cropping tool before submitting.5U.S. Department of State. Digital Image Requirements Save your application ID often. The form times out after 20 minutes of inactivity. When you finish, print the confirmation barcode and keep it with your documents.
Fees, Scheduling, and Timing
After submitting the DS-160, register on your country’s visa appointment website (typically the CGI Federal or AIS portal), select the H-1B category, and pay the Machine Readable Visa (MRV) fee of $205.6U.S. Department of State. Some applicants also owe a reciprocity issuance fee, charged only after approval, based on what your home country charges Americans for equivalent visas. Wait Times
Appointment backlogs vary dramatically by post. As of early 2026, H-1B interview wait times at major Indian consulates ranged from under two weeks in New Delhi to three months in Hyderabad.8U.S. Department of State. Global Visa Wait Times Check the global wait times page before making travel plans and consider alternate consulates within the same country.
If you face a real emergency, such as a death in the family or a medical crisis, some consulates will consider an expedite. You must first complete the DS-160, pay the fee, and book the earliest regular slot before requesting one.9U.S. Department of State. Don’t Rush the Appointment After Approval
The consulate cannot issue your visa until your petition appears in PIMS. After USCIS approves the I-129, the case goes to the Kentucky Consular Center, which enters the data into PIMS. If the officer can’t find your petition at the interview, the case is held for a manual lookup that can add days or weeks. Scheduling at least two to three weeks after approval gives the system time to catch up.
The Interview
Arrive about 15 minutes early. Consulates enforce strict security. No phones, laptops, large bags, or food beyond the checkpoint. Bring only documents in a clear folder.

The interview is usually short. The officer reviews your I-797, LCA, and supporting documents and asks about your role, your qualifications, and your employer’s business. The questioning targets three things: whether the job qualifies as a specialty occupation requiring at least a bachelor’s degree, whether your credentials match the role, and whether the employer is a real, operating business that can pay the stated wage.
What Officers Focus On
H-1B applicants get the benefit of the dual intent doctrine. You are exempt from the presumption of immigrant intent under INA section 214(b), so the officer won’t press you to prove you’ll return home.11U.S. Department of State. Visa Denials
Attention instead lands on the employment arrangement. If you work at a client site, expect detailed questions about who supervises you, who sets your schedule, and who conducts your reviews. Officers also compare your salary to the LCA prevailing wage and may ask about the employer’s size, revenue, or headcount if the company is small or unfamiliar.
Approval, 221(g), or Denial
At the end of the interview, the officer tells you the outcome. If approved, the consulate keeps your passport, prints and affixes the foil, and returns the passport through a designated courier within a few business days, though timing varies by post.9U.S. Department of State. Section 221(g) Holds
A 221(g) notice is technically a visa refusal, but in practice it often functions as a hold. Two common scenarios. In the first, the officer requests specific additional documents such as detailed project descriptions, employer tax returns, or client contracts. You have one year from the refusal date to submit them; miss it and you must start over with a new application and fee.12U.S. Department of State. Administrative Processing Information
In the second, the officer decides additional review from other government sources is needed. This is what most people call “administrative processing.” There’s no fixed timeline, and there’s usually nothing you can do to speed it up. When the review concludes, the consulate either issues the visa or notifies you that the refusal stands.
Denials
A denial means the officer concluded you don’t qualify. Common reasons include the job failing the specialty occupation test, credentials that don’t match the role, an employer-employee relationship the officer finds insufficiently established (common in staffing arrangements), or prior immigration violations. You can reapply, but you’ll pay the MRV fee again and need to show what has changed.
Security Screenings and the Technology Alert List
Applicants whose work or education touches sensitive fields are more likely to be flagged for extended administrative processing. The Technology Alert List covers areas including nuclear technology, rocket systems, advanced computing, cryptography, chemical and biomedical engineering, robotics, laser systems, and materials science. Urban planning also appears as a special interest category. If your degree or job description overlaps, budget extra time. TAL-triggered processing can take weeks or months.
You cannot pre-clear yourself. Screening happens during or after the interview based on what you provide. Where possible, ask your employer to describe the non-sensitive nature of your specific duties in the support letter, and be ready to explain your work in plain terms.
Stamp Validity Is Not Petition Validity
The dates on your visa foil are not always the dates on your I-797. Validity depends on the reciprocity agreement with your country of citizenship. Some nationalities get stamps valid for the full petition period. Others get stamps as short as three months even when the petition runs three years.13U.S. Department of State. A valid stamp also does not guarantee admission. At the port of entry, a CBP officer makes the final call on whether to admit you and for how long. Carry your I-797, LCA, employment letter, and recent pay stubs when you travel, not just the stamped passport.
Stamping in a Third Country
You can apply for an H-1B stamp at a consulate outside your country of nationality or residence, but the State Department discourages it. Official guidance warns that applying outside your home country may make it “more difficult to qualify for the visa,” and that appointment wait times are usually longer.14U.S. Department of State. Some applicants still choose Canada or Mexico to skip long home-country waits. It can work. It can also strand you outside the U.S. with a refused or delayed application and no valid stamp to return. Only consider this if you understand the downside and have no time-sensitive obligations at home.
H-4 Dependents
Your spouse and unmarried children under 21 need their own H-4 stamps. They go through the same DS-160, MRV fee, and interview process. Each dependent needs proof of the family relationship: a marriage certificate for a spouse, a birth certificate for a child. Non-English documents need translation. Bring copies of your I-797 approval notice and employment letter for their appointments too.

Interview Waivers and Domestic Renewal
The pandemic-era dropbox process that waived interviews for many H-1B renewals has ended. As of October 1, 2025, H-1B applicants are not eligible for interview waivers. Current policy requires an in-person interview for nearly all nonimmigrant visa applicants, with narrow exceptions for certain diplomatic visas, B-1/B-2 renewals, and H-2A agricultural worker renewals.15U.S. Department of State. In January 2024, the State Department launched a limited pilot allowing certain H-1B holders to renew stamps without leaving the United States. The pilot was capped at roughly 20,000 participants with eligibility criteria published in the Federal Register.16U.S. Department of State.
