H-1B Visa Processing Time: Lottery, LCA, I-129, and Visa

The H-1B visa processing time runs about six months at the fastest and can stretch past a year in the slowest cases. For a cap-subject petition, the clock starts with the March registration lottery, moves through a Labor Condition Application and the I-129 petition (median adjudication around 4.7 months under regular processing, or 15 business days with premium processing), and often ends with a consular interview abroad.1U.S. Citizenship and Immigration Services. Each stage has its own timing rules and its own delays. Here is what actually consumes the months.

Stage One: The Lottery (March)

Federal law caps new H-1B visas at 65,000 per fiscal year for the general pool, plus 20,000 reserved for workers with a U.S. master’s degree or higher.3Office of the Law Revision Counsel. 8 USC 1184 – Admission of Nonimmigrants Because demand almost always exceeds those numbers, USCIS runs an electronic registration lottery each spring.

For the FY 2027 cycle, the registration window ran March 4 through March 19, 2026, and USCIS notified selected registrants by March 31.4U.S. Citizenship and Immigration Services. There is no way to speed up or appeal the lottery.

Selection triggers a filing window of at least 90 days to submit the full I-129 petition.4U.S. Citizenship and Immigration Services. FY 2027 H-1B Initial Registration Selection Process Completed

One boundary: cap-exempt employers, including U.S. institutions of higher education and certain affiliated nonprofit and government research organizations, can file year-round without waiting for the lottery.6U.S. Citizenship and Immigration Services. H-1B Cap Season For those workers, everything below starts from the day the employer decides to file.

Stage Two: The Labor Condition Application (7–10 Business Days)

Before the I-129 can go in, the Department of Labor must certify a Labor Condition Application (Form ETA-9035). The LCA confirms the employer will pay at least the prevailing wage for the occupation and location, and that hiring an H-1B worker won’t harm similarly employed U.S. workers.7U.S. Citizenship and Immigration Services. H-1B Specialty Occupations It can be filed up to six months before the intended start date.

DOL typically certifies LCAs within seven to ten business days, though processing can take longer during peak filing periods. An I-129 filed without a certified LCA gets rejected, so this step usually comes first inside the 90-day petition window.

Stage Three: I-129 Adjudication (About 4.7 Months, or 15 Business Days)

The I-129 petition, formally “Petition for a Nonimmigrant Worker,” is where USCIS reviews the specialty-occupation requirements, the worker’s qualifications, and the employer’s ability to pay.8U.S. Citizenship and Immigration Services. I-129, Petition for a Nonimmigrant Worker Under regular processing, the median adjudication time as of early 2026 sits around 4.7 months, with individual cases falling anywhere from three to eight months depending on the assigned service center’s workload.1U.S. Citizenship and Immigration Services. Premium Processing

Employers who need a faster answer file Form I-907 alongside (or after) the I-129.11U.S. Citizenship and Immigration Services. I-907, Request for Premium Processing Service USCIS then must take action within 15 business days of receiving the properly completed request. “Take action” means approving, denying, or issuing a Request for Evidence or notice of intent to deny within that window.2U.S. Citizenship and Immigration Services. How Do I Request Premium Processing

As of February 1, 2026, the premium processing fee for H-1B petitions is $2,965. If USCIS misses the 15-business-day deadline, it must refund the fee and continue processing on an expedited basis.2U.S. Citizenship and Immigration Services. How Do I Request Premium Processing

One important limit: if USCIS issues a Request for Evidence during premium processing, the 15-day clock stops and completely resets when the employer submits the response. A premium-processed case that draws an RFE will take significantly longer than 15 business days overall.

Requests for Evidence

USCIS issues RFEs when it wants more documentation before deciding. Common triggers include questions about whether the position qualifies as a specialty occupation, whether the worker’s degree matches the job, or whether a valid employer-employee relationship exists. An RFE pauses adjudication entirely. Employers typically get 60 to 87 days to respond, and USCIS then needs additional review time. A single RFE can add two to four months. Filing a thorough petition upfront is the best defense.

Stage Four: Change of Status or Consular Processing

After I-129 approval, how the worker actually starts H-1B employment depends on where they are.

Workers already in the United States on another valid visa can request a change of status directly on the I-129. If approved, status converts automatically to H-1B on October 1 for cap-subject cases, with no need to leave the country. This path is generally faster because it skips the consular stage.

Workers abroad, or those who will need a visa stamp for future travel, go through consular processing. That means scheduling and attending an interview at a U.S. Embassy or Consulate after the I-129 is approved. This adds a separate waiting period controlled by the Department of State.

Consular Interview Wait Times

Appointment availability varies enormously by post. Some consulates in Europe or East Asia schedule within a few weeks. High-demand posts in India can have backlogs stretching several months. The Department of State publishes estimated wait times by embassy, but averages shift quickly with staffing and local conditions.

A change that took effect in late 2025 matters here: the Department of State eliminated the broad interview waiver (“drop box”) option that had been available for many H-1B renewal applicants during and after the pandemic. In-person interviews are now mandatory for virtually all H-1B applicants. A separate domestic visa renewal pilot that briefly let some H-1B holders renew stamps without traveling abroad has also been suspended indefinitely. Plan for an in-person consular visit.

After a successful interview, the consulate typically returns the passport with the visa stamp within a few business days, though some posts take one to two weeks. The worker cannot enter the United States in H-1B status until the stamped visa is physically in hand.

Administrative Processing

Some applicants are placed into administrative processing after their consular interview, a status often referenced as a Section 221(g) hold under the Immigration and Nationality Act.12U.S. Department of State. Administrative Processing Information The consular officer needs additional time for background checks, security reviews, or interagency consultations before issuing the visa.

The Department of State does not guarantee any timeline, stating only that “the duration will vary based on the individual circumstances of each case.”12U.S. Department of State. Administrative Processing Information Many cases clear in a few weeks; others run for months. Applicants working in sensitive technology fields, or those from countries subject to enhanced screening, tend to experience longer holds. There is no formal appeal, and little to do besides wait and check the State Department’s case status system.

The Full Timeline for a Cap-Subject October 1 Start

Adding it up for a typical cap-subject petition:

  • March: Employer submits electronic registration. Lottery results by month’s end.
  • April through June: LCA filed and certified, then I-129 submitted within the 90-day window.
  • July through September: Adjudication. Regular processing may finish before October 1, but many cases remain pending. Premium processing typically produces a decision within three to four weeks of filing.
  • October 1: Approved change-of-status workers begin H-1B employment. Consular-processing workers still need to complete an interview abroad and receive the stamped visa before entering.

The fastest realistic path from lottery selection to employment start is roughly six months, using change of status plus premium processing. A regular-processing case that also requires consular processing, and picks up an RFE or an administrative processing hold, can stretch well past a year. Planning around the longer scenario avoids the most common surprises.

A Note for F-1 Students: The Cap-Gap Extension

F-1 students moving from Optional Practical Training to H-1B status often find that their OPT expires before October 1. The cap-gap extension bridges that period automatically when the requirements are met.13Study in the States. F-1 Cap Gap Extension

The student must be on approved OPT or STEM OPT, or within the 60-day grace period after OPT expires, and the employer must have filed a cap-subject H-1B petition requesting a change of status before that work authorization or grace period ends. Students whose OPT or STEM OPT is still active when the petition is received get a work-authorization extension through October 1. Students already in the 60-day grace period get an extension of lawful status but cannot work during the gap.13Study in the States. F-1 Cap Gap Extension Students whose employer chose consular processing rather than change of status on the I-129 do not qualify for the cap-gap extension at all.
