H-1B Premium Processing Time: 15 Business Days, Fee, and RFEs

H-1B premium processing time is 15 business days, and USCIS charges $2,965 for the service as of March 1, 2026.¹ Within that window, USCIS must take some adjudicative action on your petition, though “action” does not always mean a final approval or denial.²

How the 15 Business Day Clock Works

Business days exclude weekends and federal holidays, so 15 business days works out to roughly three weeks on the calendar. The clock starts the day USCIS receives a properly completed Form I-907 and the correct fee at the correct filing address. “Properly completed” means all required information is filled in, the form is signed, and payment is included. If any piece is missing, USCIS can reject the filing and the clock never starts at all.²

If you file by mail, use certified mail or a tracked delivery service so you have proof of the exact receipt date. That date controls when the guarantee kicks in.

What Counts as USCIS Taking Action

Within the 15 business days, USCIS will do one of five things:²

Approve the petition.
Deny the petition.
Issue a Notice of Intent to Deny, giving you a chance to respond.
Issue a Request for Evidence asking for more documentation.
Open a fraud or misrepresentation investigation.

Any one of these satisfies the guarantee. An RFE on day 14 counts, even though your case is not resolved. This is the most common misunderstanding about premium processing: paying $2,965 buys you a fast touch, not a fast approval.

What Happens if You Get an RFE

An RFE stops the clock. When you send your response, a fresh 15-business-day period begins, during which USCIS must again take one of the five actions listed above.³ A Notice of Intent to Deny works the same way. So a case with an RFE can stretch well past 15 business days in total elapsed time, but each leg still moves under the guarantee, which is faster than the regular queue.

The $2,965 Fee and Who Pays It

The $2,965 amount took effect March 1, 2026, replacing the previous premium processing fee for Form I-129. Any Form I-907 postmarked on or after that date must include the updated amount, or USCIS will reject the filing.¹ The fee is separate from the base Form I-129 filing fee, the fraud prevention fee, and the ACWIA training fee. Filing online does not reduce it.⁴

Under Department of Labor rules, the H-1B worker cannot be required to pay this fee. DOL treats premium processing as an employer business expense, and an employer cannot deduct it from the worker’s pay if doing so would push wages below the required rate.⁵ A worker who wants premium processing purely for personal reasons, such as travel flexibility, sits in a gray zone; the safe practice is for the employer to absorb the cost.

Filing Form I-907

You can file Form I-907, Request for Premium Processing Service, in two situations: at the same time as the initial H-1B petition, or as an upgrade to a case already pending with USCIS. Either way triggers the same 15-business-day guarantee once the form is accepted.⁶ When upgrading a pending case, include a copy of the receipt notice so USCIS can link your request to the right file.

USCIS accepts Form I-907 online for H-1B petitions, both cap-subject and cap-exempt. You can fill out the form through a USCIS online account, or upload a completed PDF if the underlying petition already has a receipt number beginning with “IOE.” Online payments run through Pay.gov.⁷ For paper filings, check the current Form I-129 filing address page before mailing; the correct lockbox or service center depends on the petition type and, in some cases, the state where the employer’s primary office is located.⁸

If USCIS Misses the Deadline

When USCIS fails to take any qualifying action within 15 business days, it refunds the premium processing fee and continues handling the petition on a prioritized basis.² The petition does not drop back into the regular queue.

One exception applies: USCIS can keep the fee without meeting the deadline if it opens a fraud or misrepresentation investigation on the petition.³ If the refund does not arrive automatically after the deadline passes, submit a written refund request to the USCIS office handling the case, listing the premium processing filing date, the fee payment date, and the date of any adjudicative action.

Cap-Subject Petitions

Premium processing does not affect the H-1B lottery. Cap-subject employers still go through the registration and selection process first; Form I-907 only speeds up review once a selected petition has been filed and accepted.² Cap-exempt employers, such as universities and qualifying nonprofit research organizations, can request premium processing alongside the petition at any time of year.
