H-1B Cap Gap Extension: Work, STEM OPT, and Travel Rules

The H-1B cap gap extension is an automatic bridge that keeps eligible F-1 students in valid status, and sometimes in authorized employment, from the moment their OPT or program ends until their H-1B start date. Under a final rule that took effect January 17, 2025, that bridge now runs as late as April 1 of the fiscal year for which H-1B status is requested, instead of ending on October 1 as it did before.1Study in the States. Who Qualifies

The regulation at 8 CFR 214.2(f)(5)(vi) sets four conditions, and all of them have to be true at the moment the H-1B petition is filed.

  • You are in a valid period of F-1 status. That means you are still in your academic program, on active OPT or STEM OPT, or inside your 60-day grace period.2Study in the States. F-1 Cap Gap Extension
  • The H-1B petition is filed on time, during the applicable filing window and within your authorized period of stay.3eCFR. Title 8 CFR 214.2
  • The petition requests a change of status to H-1B rather than consular processing. If your employer checks the consular processing box, no cap gap applies, because you are expected to leave the country for a visa interview.1Study in the States. Recent H-1B Rule Extends F-1 Cap-Gap Extension
  • Your sponsoring employer is subject to the annual H-1B cap of 85,000 (65,000 regular plus 20,000 for U.S. master’s degree holders).4U.S. Citizenship and Immigration Services. H-1B Cap Season

If your employer is cap-exempt (universities, nonprofit research institutions, and certain government research organizations), the cap gap doesn’t apply to you, but you also don’t need it: the H-1B can start on any date rather than waiting for October 1.4U.S. Citizenship and Immigration Services. Compliance matters right through adjudication. If USCIS later finds that you violated F-1 status, committed fraud, or made a misrepresentation, you lose both the cap gap and the 60-day grace period that would otherwise follow a denial.5U.S. Citizenship and Immigration Services. How Long the Extension Lasts

Coverage begins automatically when your F-1 status or OPT work authorization would otherwise expire. It runs until the start date of your approved H-1B petition or until April 1 of the fiscal year for which the H-1B status is requested, whichever comes later.3eCFR. Title 8 CFR 214.2

An example makes this concrete. Say your OPT expires in July 2026 and your employer files a cap-subject H-1B petition requesting a change of status for FY 2027. Your F-1 status extends automatically. If USCIS approves the petition and your H-1B begins October 1, 2026, you transition then. If the petition is still pending on October 1, cap gap coverage continues to April 1, 2027, keeping you in valid status and, if you had OPT work authorization, authorized to work the entire time.1Study in the States. You don’t file a separate application for the extension, and you won’t receive a new Employment Authorization Document covering the extra time. Can You Work During the Cap Gap

Work authorization during the cap gap turns on one question: what were you doing when the H-1B petition was filed? The regulation draws a sharp line, and confusing these two situations is the most common serious mistake in the process.

If you had active OPT or STEM OPT work authorization at the time the petition was filed, employment authorization extends along with your status. You can keep working for the same employer in the same role without interruption.2Study in the States. If you were in your 60-day grace period when the petition was filed, meaning your OPT had already expired, you get lawful presence but not work authorization.2Study in the States. Working without authorization during this window can result in denial of the H-1B petition and long-term immigration consequences.

STEM OPT and the Cap Gap

STEM OPT interacts with the cap gap in two ways worth knowing.

First, if your STEM OPT expires while a qualifying H-1B petition is pending, cap gap coverage bridges the period from your STEM OPT end date through your H-1B start date, or through April 1 if the petition is still pending. Work authorization continues.

Second, you can file for the 24-month STEM OPT extension while you are already in a cap gap period, provided your standard 12-month OPT is expiring and you’re eligible. What you cannot do is apply for STEM OPT after the cap gap has been terminated by a denial, withdrawal, or rejection. STEM OPT reporting doesn’t pause during the cap gap. Keep submitting your six-month and final I-983 evaluations on schedule to stay in F-1 compliance.

Traveling Abroad During the Cap Gap

Travel is where the most costly mistakes happen, and the rule changes depending on whether your H-1B change of status has been approved.

Before Approval

If you leave the United States while the change-of-status petition is still pending, USCIS treats the petition as abandoned for change-of-status purposes. Your F-1 status reverts to the original program end date on your I-20, and you cannot re-enter under the cap gap.6Study in the States. H-1B Status and the Cap Gap Extension Your departure effectively converts the case to consular processing, so you’d have to attend a visa interview abroad before returning. Don’t travel while the petition is pending unless you’re prepared to lose cap gap protection.

After Approval

Once USCIS approves the H-1B petition with a change of status, you can travel and seek readmission, provided you return before your H-1B employment begins (normally October 1), you carry valid documents including a signed I-20 and a valid F-1 visa stamp, and you are otherwise admissible.6Study in the States. If any of your travel documents have expired, you may be stuck abroad renewing them, so check everything before booking.

Getting an Updated I-20 From Your DSO

Your cap gap extension should appear in SEVIS automatically. When USCIS receipts the H-1B petition, data flows to SEVIS and your record updates to reflect the extension. If the automatic update fails, your Designated School Official can request a manual data fix through the SEVP Response Center.2Study in the States. F-1 Cap Gap Extension

To start the process, bring your Form I-797C, the USCIS receipt notice confirming the petition was filed and accepted, to your international student office. The I-797C needs a valid receipt number.5U.S. Citizenship and Immigration Services. Extension of Post Completion Optional Practical Training and F-1 Status for Eligible Students under the H-1B Cap-Gap Regulations If the receipt hasn’t arrived yet but the petition was sent by courier, proof of delivery combined with your lottery selection notice can sometimes get things moving.

Names, dates of birth, and other biographical data on the H-1B filing must match your F-1 records exactly. Small spelling discrepancies can block the automatic SEVIS update and cause delays. When you receive the updated I-20, check that it reflects the cap gap notation and, if you were on OPT, the extended work authorization.

If the Petition Is Denied or Not Selected

Cap gap coverage terminates automatically if USCIS rejects, denies, revokes, or withdraws the H-1B petition, or if the registration is not selected in the lottery.3eCFR. Title 8 CFR 214.2 Extended status and any extended work authorization end immediately.

You usually get the standard 60-day grace period to prepare to leave, transfer to another school, or change to another eligible status. The clock starts from the date of the denial or rejection notice, or your original program end date, whichever is later.5U.S. Citizenship and Immigration Services. One exception is harsh. If the denial or revocation was based on a status violation, fraud, or misrepresentation, the 60-day grace period does not apply, and you are expected to leave the United States immediately.5U.S. Citizenship and Immigration Services. FY 2027 Registration and Weighted Selection

For the FY 2027 cap season, initial electronic registration runs from noon Eastern on March 4 through 5:00 p.m. Eastern on March 19, 2026. The registration fee is $215 per beneficiary.7U.S. Citizenship and Immigration Services. H-1B Electronic Registration Process

Starting with FY 2027, USCIS is implementing a weighted selection process to replace the previous random lottery. The new system generally favors higher-paid workers, allocating a greater share of H-1B visas to positions at higher prevailing wage levels while still allowing employers at all wage levels to participate.8U.S. Citizenship and Immigration Services. For cap gap timing, nothing changes: selected employers have a 90-day window after notification to file the actual H-1B petition.2Study in the States. F-1 Cap Gap Extension Coordinate with your employer so the petition is filed before your OPT expires if you want work authorization preserved, or at a minimum before your 60-day grace period runs out so that your legal status can be extended.
