H-1B Amendment Status: How to Check, Timing, and Travel

To check your H-1B amendment status, enter the 13-character receipt number from your Form I-797C, Notice of Action, into the USCIS Case Status Online tool at egov.uscis.gov. No login is needed, and the page returns the most recent action on your case in seconds.1U.S. Citizenship and Immigration Services. Case Status Online Standard processing runs around five months, so knowing how to read each update, and understanding that you can generally keep working while the case is pending, matters as much as the check itself.

How to Look Up Your Case

The receipt number is three letters followed by ten digits. It’s printed on the I-797C that USCIS mails to the petitioner, which is your employer or their attorney, shortly after the filing is accepted.2U.S. Citizenship and Immigration Services. Form I-797C, Notice of Action If you don’t have a copy, ask HR or the immigration attorney handling the filing.

The three-letter prefix tells you which service center is processing the case. WAC is the California Service Center, LIN is Nebraska, SRC is Texas, EAC is Vermont, and IOE indicates a filing made through a USCIS online account. The prefix doesn’t affect the outcome, but it lets you look up processing estimates for the specific service center.

Enter the number exactly as it appears, click “Check Status,” and read the result. The tool works on a phone, tablet, or computer.3U.S. Citizenship and Immigration Services. One account can track multiple receipt numbers, useful when dependents have filings moving in parallel.

What Each Status Message Means

USCIS uses standardized phrases. During an amendment, these are the ones you’re most likely to see:

  • Case Was Received. USCIS accepted the filing and cashed the fee. Your filing date is locked in and your receipt number is active. Review has not necessarily started.
  • Request for Additional Evidence Was Sent. The officer needs more documentation before deciding. RFEs on amendments commonly ask about the employer-employee relationship, the specialty occupation requirements, or evidence supporting the new worksite. Your employer has a set deadline to respond.
  • Notice of Intent to Deny Was Sent. More serious than an RFE. The officer has preliminarily decided against the petition but is giving the employer a chance to respond, typically within 30 days. Missing that deadline almost guarantees a denial. A well-prepared NOID response can still lead to approval, so treat this status as a signal to work closely with counsel immediately.4U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 7, Part A, Chapter 11 – Decision Procedures
  • Case Was Approved. The amendment is granted, and the changed terms of employment are officially authorized.
  • Decision Notice Mailed. The physical Form I-797 approval is on its way. If it doesn’t arrive within roughly 30 days, your employer may need to contact USCIS about the missing notice.

Keep a copy of the I-797 approval with your immigration records once it arrives. It’s the document that formally proves your amended employment terms.

Can You Work While the Amendment Is Pending?

Yes. Once the amendment is properly filed, you can begin working under the new terms right away. You don’t have to wait for approval.5U.S. Citizenship and Immigration Services. USCIS Draft Guidance on When to File an Amended H-1B Petition After the Simeio Solutions Decision This comes from the H-1B portability provision, which lets eligible H-1B workers start new or changed employment as soon as a qualifying petition is filed on their behalf.6U.S. Citizenship and Immigration Services. Portability covers you for the entire pendency of the amendment. You are not accruing unlawful presence while USCIS reviews the case. Your I-797C receipt notice is your temporary evidence of that continuing authorization, so keep it accessible for HR verification or any other check.

One boundary worth noting: the 240-day rule that lets some workers keep going past their prior expiration applies to straightforward extensions of the same job with the same employer, not to material changes. Amendments involve material changes by definition, so portability is what protects your right to work, not the 240-day rule.6U.S. Citizenship and Immigration Services. What a Denial Does to Your Work Authorization

A denial ends your authorization to work under the amended terms the moment USCIS notifies your employer.6U.S. Citizenship and Immigration Services. FAQs for Individuals in H-1B Nonimmigrant Status What happens next depends on whether the underlying H-1B from the original petition is still valid.

If your original approval hasn’t expired, you may be able to continue working under the pre-amendment terms, meaning the original job location and duties. If the original status has also expired, you would be out of status as of that earlier expiration date. A separate 60-day grace period may then apply: H-1B workers are allowed up to 60 consecutive days in the country after a cessation of employment, during which they cannot work but can look for a new sponsoring employer.7eCFR. 8 CFR 214.1 – Requirements for Admission, Extension, and Maintenance of Status

How Long the Review Takes

The median processing time for a standard Form I-129 petition is roughly 4.7 months as of early 2026. Premium-filed cases have a median of about two weeks.8U.S. Citizenship and Immigration Services. Historic Processing Times These are medians. Some standard cases resolve in two months; others run past eight, depending on the service center’s backlog. Current estimates by service center are available on the USCIS Processing Times page.

When an Amendment Is Actually Required

If you’re not sure a filing was even needed, the regulation requires an amended petition before any “material change” in your employment terms takes effect.11eCFR. 8 CFR 214.2 – Special Requirements for Admission, Extension, and Maintenance of Status The most common trigger is a worksite move to a geographic area outside the metropolitan statistical area listed on your current Labor Condition Application. Significant changes in duties, a shift from full-time to part-time, or a major salary reduction can also qualify.

Several situations do not require an amendment:

  • A move within the same metropolitan statistical area, where the employer only needs to post the existing LCA at the new location.
  • Short-term placements at a worksite outside your usual area lasting up to 30 days, and in some cases 60 days.
  • Non-worksite travel such as conferences, staff seminars, or occasional short trips to other locations.

These exceptions come from USCIS guidance interpreting the regulation.5U.S. Citizenship and Immigration Services. USCIS Draft Guidance on When to File an Amended H-1B Petition After the Simeio Solutions Decision

Traveling Abroad While the Case Is Pending

International travel during a pending amendment is possible but carries real risk. If you hold an unexpired H-1B visa stamp and your current H-1B approval period hasn’t expired, Customs and Border Protection will generally admit you based on your existing documentation.

The complication is when you’ve already started working under the amended terms before the amendment is approved. Your visa stamp reflects the old terms, and you cannot get a new stamp until the amendment is approved. If a question arises at the border, you may be admitted only under the prior approval, with a shorter authorized stay. Many immigration attorneys advise against non-essential international travel while an amendment is pending for exactly this reason.

If the amendment is approved while you’re abroad, you can present the new I-797 approval alongside your valid visa stamp to enter under the full validity of the newly approved petition. Canadian citizens, who are visa-exempt for H-1B purposes, face fewer complications but should still confirm their petition validity dates before traveling.
