If you paid more GST than you actually owed, you can claim the money back by filing Form GST RFD-01 on the GST portal within two years of the date of payment. The claim falls under Section 54 of the CGST Act, which governs the GST refund on excess tax paid, and no refund is issued if the total amount is below ₹1,000.1Central Board of Indirect Taxes and Customs. CGST Act 2017 – Section 54 – Refund of Tax The mechanics are simple on paper. Most delays come from picking the wrong refund category or missing a single document.
Which Situation Applies to You
Excess payment claims split into three categories on the portal, and the category you select determines which validation rules the system applies.
Excess Tax Paid Through a Return
The most common case: you entered wrong figures in GSTR-3B, paid twice against the same challan, or miscalculated output tax. The overpayment appears as a gap between the tax payable on your return and the tax actually deposited. On the portal, this is filed under “Excess Payment of Tax.”
Surplus Sitting in Your Electronic Cash Ledger
Money can remain in your Electronic Cash Ledger after every liability for tax, interest, penalty, and fee has been cleared. TDS or TCS credits that exceed your liabilities, or funds deposited for a transaction later cancelled, both produce this surplus. You claim it under Section 49(6) read with the proviso to Section 54(1).2Central Board of Indirect Taxes and Customs. Circular 166/22/2021-GST – Clarification on Certain Refund Related Issues The two-year deadline does not apply here. You can file for this refund at any time.
Tax Paid Under the Wrong Head
If you treated an interstate sale as intrastate and paid CGST plus SGST instead of IGST, or the reverse, Section 77 gives you a separate path. Pay the correct tax under the right head first, then apply for a refund of the wrongly paid amount. The two-year clock for this category runs from the date you made the correct payment, not from the original mistake.3Central Board of Indirect Taxes and Customs. Circular No 162/18/2021-GST – Clarification in Respect of Refund of Tax Specified in Section 77(1) of the CGST Act It applies whether you spotted the error yourself or an officer flagged it.
The Two-Year Deadline and the ₹1,000 Floor
For excess tax paid through a return, you have two years from the “relevant date,” which for these claims is simply the date of payment.1Central Board of Indirect Taxes and Customs. CGST Act 2017 – Section 54 – Refund of Tax File later and the claim is time-barred, no matter how well documented the overpayment is. Section 54 has no condonation mechanism for late filings.
Below ₹1,000, no refund is paid. The only exception is refunds tied to goods exported with payment of tax.1Central Board of Indirect Taxes and Customs. CGST Act 2017 – Section 54 – Refund of Tax
One useful protection on timing: if the officer issues a deficiency memo (Form RFD-03) and effectively cancels your original application, the period between your first filing and the deficiency memo does not count toward the two years.4Central Board of Indirect Taxes and Customs. CGST Rules – Rule 90 Acknowledgement You do not lose time while the officer reviews a deficient submission.
What You Need Before You File
All returns for the periods covered by your claim, and every period up to it, must be filed. You cannot even submit RFD-01 if GSTR-1, GSTR-3B, or the relevant return for your filing type is pending.5Goods and Services Tax Council. Application for Refund
For excess payment claims specifically, you must prepare Statement 7 as an annexure to RFD-01. Prescribed under Rule 89(2)(k), it requires the tax period, the ARN of the return, the filing date, and a breakdown of tax payable versus tax paid across Integrated Tax, Central Tax, State/UT Tax, and Cess.6Central Board of Indirect Taxes and Customs. CGST Rules 2017 Part B – Forms Every figure has to match your filed returns exactly. Statement 7 is the primary document the officer uses to verify the overpayment.
Proving You Did Not Pass the Tax to Customers
GST law does not want you keeping a refund for tax that your buyers actually paid through their invoices. If the excess tax was passed on, the refund goes to the Consumer Welfare Fund instead of your bank account.7GST Council. Refund in GST This is the unjust enrichment test, and the proof you need depends on the claim size:
- Claims up to ₹2 lakh need only a self-declaration that the tax burden was not passed on.
- Claims above ₹2 lakh need a certificate in Annexure 2 of RFD-01 from a Chartered Accountant or Cost Accountant confirming the same.
Both requirements sit in Rule 89(2)(l) and (m).8Central Board of Indirect Taxes and Customs. CGST Rules – Rule 89 Filing a large claim without the CA certificate arranged in advance is one of the most common causes of a deficiency memo.
Filing the Application on the Portal
Log in to the GST portal and go to Services → Refunds → Application for Refund. Select the correct refund type. “Excess Payment of Tax” is for overpayment through returns; “Excess Balance in Electronic Cash Ledger” is for surplus cash ledger funds. The wrong choice triggers different validation rules and typically leads to rejection.9Goods and Services Tax. Application for Refund Manual
Enter the refund amount broken down by tax head. The portal will not let you claim more than the balance available in your ledger for each head. Upload Statement 7, the self-declaration or CA certificate for unjust enrichment, and any supporting challans or credit notes.
Sign the application using a Digital Signature Certificate (DSC) or an Electronic Verification Code (EVC), which sends an OTP to your registered mobile number.10Goods and Services Tax. Register/Update DSC Companies and LLPs must use a DSC; proprietors and partnership firms can use either. The system generates an Application Reference Number (ARN) once you sign, and that ARN is what you use to track the claim.
What Happens After You File
Within 15 days, the proper officer reviews your application for completeness. If it is in order, you receive an acknowledgment in Form RFD-02 and the claim enters formal processing.4Central Board of Indirect Taxes and Customs. CGST Rules – Rule 90 Acknowledgement
If something is missing, you get a deficiency memo in Form RFD-03. This cancels your application. The amount that was debited from your ledger at filing is automatically re-credited, and you have to file a fresh RFD-01 after fixing the problem.11Goods and Services Tax Portal. FAQs – View Notices/Orders and File Reply to the Issued Notice Fix the issue fully before refiling, because a rushed second application can produce another deficiency memo.
The officer has 60 days from receipt of a complete application to process the refund. CBIC has advised officers to issue the final sanction order in Form RFD-06 within 45 days of ARN generation.7GST Council. Refund in GST Approved refunds are followed by a payment order in Form RFD-05, and the money is credited electronically to the bank account listed in your registration.12Central Board of Indirect Taxes and Customs. CGST Rules 2017 – Rule 92 Order Sanctioning Refund
If the officer approves only part of the claim, the rejected portion is re-credited to your Electronic Credit or Cash Ledger through Form GST PMT-03.7GST Council. Refund in GST
One boundary to know: the 90% provisional refund mechanism in Section 54(6) does not apply to excess payment claims. It is reserved for zero-rated supplies and inverted duty structure claims.1Central Board of Indirect Taxes and Customs. CGST Act 2017 – Section 54 – Refund of Tax Excess payment refunds go through full verification each time.
Why Claims Get Rejected
Most rejections come from avoidable errors, not substantive legal problems:
- Selecting the wrong refund category on the portal. “Excess Balance in Electronic Cash Ledger” and “Excess Payment of Tax” have different validation rules.
- Mismatches between GSTR-1 and GSTR-3B. Officers cross-check turnover between the invoice-level return and the summary return, and gaps produce partial or full rejection.
- Missing the CA certificate on claims above ₹2 lakh. No amount of reply can substitute for the Annexure 2 certificate required by Rule 89(2)(m).8Central Board of Indirect Taxes and Customs. CGST Rules – Rule 89
- Pending returns for related periods.
- Filing after the two-year window. There is no condonation for late refund claims.
If your claim is rejected in whole or in part and you disagree with the order, you can appeal to the First Appellate Authority in Form GST APL-01 within three months of the order being communicated, with a possible one-month extension for sufficient cause. The appeal requires a pre-deposit of 10% of the disputed amount plus the full amount of any tax, interest, or penalty you accept.
Interest If the Refund Is Delayed or Withheld
If the refund is not paid within 60 days from receipt of a complete application, interest starts running on the outstanding amount. Section 56 sets the rate at up to 6% per annum, calculated from the day after the 60-day period ends until the refund is credited.13Central Board of Indirect Taxes and Customs. Central Goods and Services Tax Act 2017 – Section 56 You do not need to file a separate application for the interest, but many taxpayers have to follow up to make sure it is included with the refund payment.
The government can also withhold an approved refund. Under Section 54(10), if you have pending returns or unpaid tax, interest, or penalty that has not been stayed, the officer can hold the refund until you clear the defaults, or deduct the unpaid amounts directly from the approved refund. An outstanding demand from a different assessment period can reduce or wipe out your refund. Under Section 54(11), the Commissioner can withhold a refund tied to an appeal or pending proceedings if payment would adversely affect revenue due to suspected fraud, after giving you a hearing. If you eventually prevail, the withheld amount carries the same 6% interest for the entire period of delay.1Central Board of Indirect Taxes and Customs. CGST Act 2017 – Section 54 – Refund of Tax
