Gas Standards: Sulfur Cap, Vapor Pressure, and Ethanol Rules

Gasoline sold in the United States has to clear a stack of federal fuel quality standards before it reaches a pump. The EPA caps sulfur at a 10 ppm annual average, limits summer volatility to 9.0 psi, bans heavy metals from reformulated blends, and requires every gallon to carry certified detergent additives. The FTC governs what the octane sticker on the dispenser can say. Refiners who miss these limits face civil penalties above $124,000 per violation per day, and retailers who mislabel or contaminate fuel can be shut down on the spot.

Most of these rules trace back to Section 211 of the Clean Air Act, at 42 U.S.C. § 7545, which lets the EPA designate, register, and restrict any fuel or fuel additive that endangers public health.1Office of the Law Revision Counsel. 42 USC 7545 – Regulation of Fuels The operational rules live at 40 CFR Part 1090, where the EPA consolidated its overlapping fuel programs in 2020.2US EPA. The 10 ppm Sulfur Cap

The Tier 3 gasoline sulfur program is the centerpiece of modern fuel quality regulation. Under 40 CFR § 1090.205, every gasoline manufacturer must hit a sulfur average of 10.00 ppm for each compliance period.3eCFR. 40 CFR 1090.205 – Sulfur Standards The cap took full effect in 2017, down from the 30 ppm average that Tier 2 allowed.4US EPA. Lower sulfur cuts sulfur dioxide and particulate emissions directly and protects the catalytic converters on modern vehicles, which lose effectiveness when exposed to higher-sulfur fuel.

Reid Vapor Pressure and Summer Blends

Gasoline evaporates. The vapors react with sunlight to form ground-level ozone, so the EPA caps Reid Vapor Pressure during the high-ozone months. Under Clean Air Act Section 211(h), gasoline RVP cannot exceed 9.0 psi at retail from June 1 through September 15, with a 1.0 psi allowance for fuel blended with 10 percent ethanol. Winter fuel is allowed to be more volatile because cold engines need more vapor to start. Refiners begin producing summer-grade fuel as early as February to have compliant product at terminals by May 1, and retailers must be selling the summer blend from June 1 through September 15.6U.S. Energy Information Administration. Some metro areas layer on stricter boutique blends approved into state air quality plans, with RVP limits as low as 7.0 psi or specific sulfur and aromatics restrictions. During hurricanes, pipeline failures, and similar disruptions, the EPA can issue short-term fuel waivers, often 20 days or less, that loosen these specifications to keep supply moving.7US EPA. Heavy Metals

Lead was pulled from on-road gasoline decades ago and remains prohibited. For reformulated gasoline, 40 CFR § 1090.220(d) bans all heavy metals, including lead and manganese, from the blend.8eCFR. 40 CFR Part 1090 – Regulation of Fuels, Fuel Additives, and Regulated Blendstocks The EPA can waive the prohibition for a specific heavy metal other than lead if adding it would not increase toxic air pollutant emissions on an aggregate basis, but no such waiver currently applies to conventional gasoline.

Ethanol Blending and E15

The Renewable Fuel Standard requires refiners and importers to blend a set volume of renewable fuel into gasoline each year. For 2026, the EPA set the total obligation at 25.82 billion renewable identification number credits, including 15 billion gallons of conventional renewable fuel and 10.82 billion in advanced biofuels.9US EPA. Final Renewable Fuel Standards for 2026 and 2027 For most drivers, that shows up as E10, gasoline with up to 10 percent ethanol.

E15, with up to 15 percent ethanol, comes with extra rules. Retailers selling it must post a conspicuous blue-and-white label stating the fuel contains up to 15 percent ethanol, is approved for 2001 and newer passenger vehicles and flex-fuel vehicles, and should not be used in older cars, motorcycles, boats, or small engines. Producers must file a Misfueling Mitigation Plan with the EPA and obtain approval for a Compliance Survey Plan before selling it.10US EPA. E15 Fuel Registration

E15 pushes vapor pressure above the summer 9.0 psi cap, so it generally cannot be sold between June 1 and September 15 without a waiver. There is no permanent nationwide year-round approval. The EPA issued its first nationwide summer waiver in April 2025 and has said it intends to renew it on a rolling basis. A handful of states received a permanent waiver effective April 28, 2025, under a separate rulemaking.11Congress.gov. Year-Round Sale of E15

Detergent Additives in Every Gallon

Every gallon of gasoline sold in the United States must contain EPA-certified detergent additives that control carbon deposits on fuel injectors and intake valves. The requirement covers all grades and formulations, including conventional, reformulated, and oxygenated gasoline, and fuel sold for off-road use.12eCFR. 40 CFR 80.161 – Detergent Additive Certification Program Additive manufacturers register their packages with the EPA at or above a Lowest Additive Concentration, and that LAC is the legal floor for every batch.13eCFR. 40 CFR 1090.155 – Fuel Additive Manufacturers

The federal floor is a minimum, not a target. Many automakers back the voluntary TOP TIER program, which requires higher detergent concentrations verified by independent engine testing and prohibits organometallic additives that can damage catalytic converters. Licensed TOP TIER brands must treat every grade at every station, not just premium. The program is transitioning to a TOP TIER+ standard, with most brands expected to finish the shift by January 2027. Retailers outside the program still have to meet the EPA’s baseline certification.

Octane Labels at the Pump

The FTC handles octane disclosure under the Petroleum Marketing Practices Act, codified at 16 CFR Part 306. Every gasoline dispenser must display a yellow label at least 3 inches wide and 2.5 inches tall showing the fuel’s automotive fuel rating. For gasoline, that rating is the average of the Research Octane Number and the Motor Octane Number, the (R+M)/2 figure printed on the sticker.14eCFR. 16 CFR Part 306 – Automotive Fuel Ratings, Certification and Posting

Retailers are responsible for making sure the fuel in the tank matches the number on the label. Dispensers serving multiple grades need a separate label for each grade on each face of the pump. Misrepresenting octane through a wrong sticker or contaminated tanks exposes the retailer to FTC enforcement.15Federal Trade Commission. Complying With the FTC Fuel Rating Rule

How the Standards Are Enforced

Refiners who ship non-compliant fuel face civil penalties under the Clean Air Act, adjusted for inflation each year. As of January 2025, the maximum is $124,426 per violation per day.16eCFR. 40 CFR 19.4 – Statutory Civil Monetary Penalties, as Adjusted for Inflation Because the penalty applies per violation and per day, a refinery moving off-spec fuel over a week can accumulate liability quickly.

At the retail end, state departments of agriculture or weights and measures offices run the inspections. Inspectors show up unannounced, pull samples from pump nozzles, and check tanks for water and sediment. Samples get tested for octane accuracy and chemical compliance. When fuel fails, inspectors can issue a stop-sale order that locks the affected pumps until the fuel is treated or replaced. Civil penalties vary by jurisdiction but can reach several thousand dollars per pump, with escalating consequences for repeat violations.

If You Think You Got Bad Gas

Keep the receipt. That receipt is the concrete link between your engine problem and a specific station, pump, and date. Contact your state’s weights and measures division or department of agriculture as soon as possible, because delays give the station time to sell through the batch and make testing impossible. The agency will pull a sample from the pump, and if contamination is confirmed, the fuel is tagged and pulled from sale. The state investigation is free. Private lab analysis of a gasoline sample runs roughly $350 if you want independent testing on your own.
