Fuel tank labeling requirements depend on what the tank holds, where it sits, and whether it’s moving. A bulk tank in a shop, a buried tank under a gas station, a five-gallon can in a garage, a tanker on the interstate, and a retail dispenser each answer to a different agency and a different set of markings. Get the wrong ones, or let the right ones fade, and the penalties start around $16,550 per violation for workplace safety issues and reach $75,000 or more for transportation violations.1Occupational Safety and Health Administration. 2026 Annual Adjustments to OSHA Civil Penalties
Here’s what each tank type actually needs.
OSHA Hazard Communication Labels on Any Workplace Tank
Every fuel container in a workplace falls under OSHA’s Hazard Communication Standard at 29 CFR 1910.1200. The standard uses the Globally Harmonized System, and it applies to fuel tanks the same way it applies to any container of a hazardous chemical an employee might encounter.2Occupational Safety and Health Administration. 29 CFR 1910.1200 – Hazard Communication

- The product identifier — the actual name of the fuel, such as gasoline, diesel, or kerosene.
- A signal word. Gasoline gets “Danger”; less severe hazards get “Warning.”
- Pictograms. The red-bordered flame is the obvious one for fuel; health hazard icons may also apply.
- Hazard statements, like “Highly flammable liquid and vapor.”
- Precautionary statements covering prevention, response, storage, and disposal.
- Supplier information — the name, address, and phone number of the manufacturer, importer, or responsible party.
The signal word, pictograms, and hazard statements have to appear together on the label rather than scattered around the tank. Labels that peel, fade, or get painted over during maintenance no longer satisfy the standard, and keeping them legible is the employer’s job.3eCFR. 29 CFR 1910.1200 – Hazard Communication
NFPA 704 Fire Diamond
The fire diamond is for the fire crew that pulls up to your facility, not for your employees. It’s a square-on-point placard divided into four color-coded quadrants, each rated 0 to 4.4National Fire Protection Association. Hazardous Materials Identification
- Blue on the left: health hazard.
- Red on top: flammability.
- Yellow on the right: instability.
- White on the bottom: special hazards like water reactivity or oxidizer properties.
Gasoline carries a flammability rating of 3, meaning it can ignite under almost all normal temperature conditions.5CAMEO Chemicals. Gasoline
One point that trips people up: NFPA 704 tells you how to display the diamond, but not when you need one. That trigger comes from local fire codes, building codes, or your authority having jurisdiction.6National Fire Protection Association. Signs and Symbols in NFPA 704 and NFPA 170 Where it’s required, the diamond goes on at least two exterior walls and at each access point to the room or storage area. The numerals have to be legible at the distance responders would stage from: at least one inch tall at 50 feet, four inches at 200 feet.
Aboveground Stationary Tanks
Permanent aboveground tanks pick up additional obligations under NFPA 30 and NFPA 30A, which focus on operational safety for anyone filling, maintaining, or working near the tank.
Each tank needs a sign identifying the product by name, visible from the fill point. Labeling a tank “Fuel” isn’t enough when it could hold gasoline, diesel, or aviation fuel, each with different handling and different fire suppression needs. Cross-contamination from misfilling a diesel tank with gasoline is exactly the preventable disaster the label exists to stop.
Tanks also need warning signage addressing ignition. “Flammable — Keep Fire and Flame Away” and “No Smoking” are the standard postings, and they need to be readable from far enough away that no one approaches with a lit cigarette. Faded or obscured signs are among the most common fire marshal citations at fueling facilities.
Underground Storage Tanks
You can’t put a label on a buried tank, so the markings go on the fill pipes, manholes, and monitoring wells at the surface. The EPA regulates underground storage tanks under 40 CFR Part 280, and groundwater monitoring wells associated with fuel USTs must be clearly marked and secured.7Environmental Protection Agency. Fill pipe identification follows API Recommended Practice 1637, the petroleum industry’s color-coding system. API 1637 assigns a specific color to each product so a delivery driver can identify the correct fill point at a glance. Many local fire codes incorporate the API markings by reference, which makes them effectively mandatory even though the standard itself comes from an industry body. Fill pipes are either painted the assigned color or fitted with an external label matching the product below.
The stakes on a busy nighttime delivery are high. A misfueled underground tank can contaminate thousands of gallons and pull the operator into environmental cleanup obligations under federal and state law.
Portable Gas Cans and Fuel Containers
Portable fuel containers of five gallons or less are consumer products. In a workplace they still answer to OSHA; on a retail shelf they answer to the Consumer Product Safety Commission.
Color and Product Name
Red for gasoline is the one color backed by a specific federal rule. OSHA’s 29 CFR 1910.144 requires red coding for containers holding flammable liquids. Yellow for diesel, blue for kerosene, and green for oils are industry conventions rather than federal mandates, but the conventions are so entrenched that departing from them in a workplace will draw questions from an inspector.
Every portable container also needs the product name permanently embossed, printed, or labeled on the body. Color fades — a sun-bleached red can and a sun-bleached yellow can look disturbingly alike — and the printed name is the backup that keeps the wrong fuel out of the wrong engine.
Flame Mitigation Devices
Since 2023, the Portable Fuel Container Safety Act requires all portable fuel containers sold in the United States to include a flame mitigation device that stops fire from propagating back into the container through the spout. Empty containers must comply with ASTM F3326-21 (or UL 30:2022 for safety cans); pre-filled containers must meet ASTM F3429. Manufacturers issue a General Certificate of Compliance citing 16 CFR Part 1461, and the compliance marking must be traceable on the product.8Consumer Product Safety Commission. Containers also carry warning labels for vapor and ingestion hazards. Unapproved containers, meaning those without a UL or FM Approved marking, shouldn’t be in a regulated workplace at all.
Fuel Tanks in Transit: DOT Placards
Once fuel moves onto public roads, the Department of Transportation takes over. Title 49 CFR Part 172 governs placards, markings, and labels for vehicles and bulk containers hauling hazardous materials.9eCFR. 49 CFR Part 172
Gasoline is a Class 3 flammable liquid, UN 1203.10CAMEO Chemicals. UN/NA 1203 Cargo tanks carrying gasoline can display either the standard “Flammable” placard or a “Gasoline” placard.11Federal Motor Carrier Safety Administration. Placards go on each side and each end of the vehicle or bulk container — four total.13eCFR. 49 CFR 172.504 They have to hold up in weather and stay attached in transit. A pre-trip check should confirm all four are clean, undamaged, and showing the right identification number.
Fuel moved by vessel or near waterways may also need a “Marine Pollutant” mark. Bulk containers of 1,000 gallons or more carry the mark on each side and each end; smaller bulk packages need it on at least two opposing sides.14eCFR. 49 CFR 172.322 – Marine Pollutants
Civil penalties for knowingly violating hazmat transportation rules run up to $75,000 per violation. If the violation results in death, serious injury, or substantial property destruction, the ceiling rises to $175,000. Retail Fuel Dispensers
Gas station pumps run on a different track entirely. The Federal Trade Commission, not OSHA or DOT, sets the labeling rules under 16 CFR Part 306.16eCFR. 16 CFR Part 306
Every retail fuel dispenser has to display a standardized octane rating label: 3 inches wide by 2½ inches tall, yellow background, black text, showing the minimum octane rating calculated by the (R+M)/2 method. Labels must survive at least a year of weather exposure and resist fuel, oil, grease, and solvents. No additional marks or information are allowed on the octane label beyond what the regulation requires.17eCFR. 16 CFR 306.12 – Labels Retailers selling biodiesel or other alternative fuels face additional disclosure rules under the same part.
What Labeling Failures Cost
Hazard communication is one of OSHA’s most frequently cited standards, and the fines compound because each unlabeled or mislabeled container can count as a separate violation. In 2026, a serious violation carries a maximum penalty of $16,550. A fire diamond is a commodity safety product. The cost of getting the labels right is trivial next to the cost of not.
