Form SSA-789: Disability Cessation Appeal and Benefit Continuation

Form SSA-789 is the Request for Reconsideration you file when Social Security decides your disability has medically improved and you want to challenge that cessation. You have 60 days from the date on the cessation notice to file it, and only 15 days if you also want your benefits to keep coming while the appeal is pending. The form itself is one page. The deadlines and the companion paperwork are what trip people up.

When Form SSA-789 Is the Right Form

Social Security uses Form SSA-789 for one specific situation: a medical cessation. That means the agency has reviewed your case through a Continuing Disability Review and concluded your health has improved enough that you can work.1Social Security Administration. It does not apply if your benefits are ending for a non-medical reason such as exceeding income limits or failing to cooperate with a review. Those use different appeal paths. Social Security’s own procedures manual tells staff not to accept the general reconsideration form (SSA-561) for a disability cessation — SSA-789 is the only correct form.1Social Security Administration. How to Fill Out the Form

You can download the PDF from ssa.gov or pick up a copy at any field office.2Social Security Administration. SSA Form 789 – Request for Reconsideration – Disability Cessation Have your cessation notice in front of you when you start. Most of what the form asks for is printed on the notice.

The top of the page asks for identifying information:

  • Claimant’s name, exactly as it appears on the cessation notice.
  • Your Social Security number, regardless of whose earnings record supports the claim.
  • The wage earner or self-employed person’s name, only if that person is different from the claimant.

Hearing or Paper Review

The biggest decision on the form is a single checkbox. Box 1 says you want to appear at a disability hearing in front of a disability hearing officer (DHO). Box 2 says you want the DHO to decide the case on the written record alone. For most people, appearing is the stronger choice because it lets you answer questions and explain your situation in your own words.

If you check Box 2, you also need to sign Form SSA-773, the Waiver of Right to Appear, and attach it to your SSA-789. The waiver only gives up your right to show up in person; the reconsideration itself still moves forward. You can also change your mind and revoke the waiver at any point before the DHO issues a written decision.3Social Security Administration. Explaining Why You Disagree

Form SSA-789 gives you space to say why the cessation decision is wrong. This is the part most people underuse. Writing “I’m still disabled” does not help the DHO see anything the original examiner missed.

The cessation decision turns on whether your condition has medically improved since the last favorable decision, and whether any improvement actually affects your ability to work. The burden is on Social Security to show that improvement, not on you to re-prove disability from scratch.4eCFR. 20 CFR 404.1594 – How We Will Determine Whether Your Disability Continues or Ends Aim your disagreement at that question. Point to symptoms, clinical findings, treatment history, or new impairments that show your condition has not improved. If you have new medical records, doctor’s letters, or test results that were not in the original file, name them in your statement and submit them with the form. Social Security’s manual specifically cautions that holding evidence until the hearing can slow your case down, because the DHO may have to send it back for development.1Social Security Administration. Technically a signature is not required for the agency to accept a reconsideration request, as long as some written statement of disagreement is on file. Sign it anyway. An unsigned form invites avoidable questions.

Keeping Your Benefits During the Appeal

Filing SSA-789 does not, by itself, keep your check coming. Benefit continuation is a separate election on Form SSA-792, the Statutory Benefit Continuation Election Statement.5Social Security Administration. SSA Form 792 – Statutory Benefit Continuation Election Statement The deadline is 15 calendar days from the date on the cessation notice, not 15 days from when you opened the envelope. That window is built as 10 days plus 5 days of assumed mailing time, so in practical terms you need to act as soon as the notice arrives.6Social Security Administration. Form SSA-792 gives you options depending on the benefit type. SSDI recipients can continue benefits for themselves and dependents, continue only their own, continue only Medicare coverage without cash payments, or decline. SSI recipients elect continuation or decline it. Dependents on your record can continue everything including Medicare, continue Medicare only, or decline. If you elect Medicare only, Social Security will bill you directly for the Supplementary Medical Insurance premium, and non-payment ends the coverage.5Social Security Administration. There is a trade-off. If your appeal ultimately loses, the benefits you received during the process generally become an overpayment that Social Security expects back. You can later ask for a waiver on Form SSA-632 if you were not at fault and cannot afford repayment or repayment would be unfair. For amounts of $2,000 or less where you were not at fault, you can request a waiver by phone at 1-800-772-1213 or at a field office without filing the full form.7Social Security Administration. SSA Form 632-BK – Request for Waiver of Overpayment Recovery For most people whose condition has not actually improved, the income during a months-long appeal is worth the exposure. Just know what you are electing.

How to Submit the Form

You have three options:

  • Online, through the SSA eSubmit portal at ssa.gov/forms, either by completing the form online or uploading a PDF. This method is fastest and gives you a confirmation.8Social Security Administration. Social Security Forms
  • In person at any Social Security field office. Ask for a date-stamped copy as your proof of filing.
  • By mail to your local field office, sent certified with return receipt requested so you have a verifiable filing date.

File Form SSA-792 at the same time if you want benefit continuation. The 60-day and 15-day clocks run independently, so filing SSA-789 on day 50 does not preserve your ability to continue benefits — that window closed on day 15. Send both forms together as soon as you can. Include your supporting medical evidence with the submission, or send it as soon after as possible.

If You Miss the Deadline

The 60-day and 15-day windows are firm, but Social Security will accept a late filing if you show “good cause.” Recognized reasons include:

  • Serious illness or hospitalization that kept you from contacting the agency in any form.
  • Death or serious illness in your immediate family.
  • Never receiving the notice, for example because Social Security had the wrong address.
  • Being given incorrect or confusing information by the agency about when or how to appeal.
  • Physical, mental, educational, or language barriers that prevented you from understanding or meeting the deadline.
  • Sending the appeal to the wrong government agency in good faith within the time limit, so that it reached Social Security late.9Social Security Administration. POMS GN 03101.020 – Good Cause for Extending the Time Limit to File an Appeal

File immediately and attach a written explanation of what happened, when it happened, and how it stopped you from filing on time. Add supporting documents where you can: hospital records, a death certificate, mail returned to Social Security. What Happens After You File

Your case moves to the Disability Hearing Unit and is assigned to a disability hearing officer who had no involvement in the original cessation decision.1Social Security Administration. POMS DI 12026.021 – Completion of the SSA-789 Request for Reconsideration – Disability Cessation Right to Appear If you asked for a hearing, the DHO contacts you to schedule it. These hearings are less formal than a courtroom; the DHO asks questions, reviews your evidence, and lets you tell your side.

You may be asked to attend a consultative examination with a doctor the agency selects and pays for, which happens when the existing medical evidence is not enough to decide. Go to it. Refusing without a good reason can produce an unfavorable decision on its own.

Expect several months between filing and a decision. If you elected benefit continuation, payments keep arriving during that time.

If the Reconsideration Is Denied

An unfavorable reconsideration is not the end. Social Security’s appeals process has four levels, and Form SSA-789 puts you at the first. If the DHO upholds the cessation, you have 60 days to request a hearing before an Administrative Law Judge. You can also elect benefit continuation again for the ALJ stage within 15 days of the reconsideration notice, using Form SSA-792 the same way.6Social Security Administration. The ALJ hearing is more formal: you can present testimony, call witnesses, and submit new medical evidence, and the judge takes a fresh look at the record. If you have been handling the reconsideration yourself, the ALJ stage is where many people decide to bring in a representative. You can formally appoint one using Form SSA-1696, filed online, by mail, by fax, or at a field office.10Social Security Administration.
