Form SSA-44: Request an IRMAA Reduction After an Income Change

Form SSA-44 is the Social Security Administration’s request to reduce your Medicare Income-Related Monthly Adjustment Amount (IRMAA) after a qualifying life event has lowered your income. Because SSA sets IRMAA using a tax return from two years earlier, your current Part B and Part D premiums may reflect earnings you no longer have. Filing this form asks SSA to use a more recent, lower income figure instead, and in the top brackets that shift can be worth hundreds of dollars a month.

Who Qualifies to File

You cannot use Form SSA-44 simply because your income went down. The drop has to be tied to one of seven life-changing events recognized by federal regulation:1eCFR. 20 CFR 418.1205 – What Is a Major Life-Changing Event

  • Death of a spouse
  • Marriage
  • Divorce or annulment
  • Work stoppage or reduction, including full retirement or a move to part-time
  • Loss of income-producing property through something outside your control, such as a federally or state-declared disaster, arson, livestock disease, or investment fraud by a third party. Selling voluntarily or losing value in a market downturn does not qualify.
  • Loss of pension income because the plan was terminated, reduced, or reorganized
  • An employer settlement payment tied to the employer closing, going bankrupt, or reorganizing

The event also has to actually lower your modified adjusted gross income. If you retired but a rental-property sale kept your total MAGI high the same year, the retirement alone will not move your IRMAA, because SSA looks at total MAGI rather than the individual income stream you lost.2eCFR. 20 CFR Part 418 Subpart B – Determinations Using a More Recent Tax Years Modified Adjusted Gross Income

A common non-qualifying situation: a bad market year, a one-time capital gain that inflated the return SSA used, or voluntary early retirement from a side venture. None of these fit the seven categories, and a request built on them will be denied.

What Income to Report

For IRMAA, your MAGI is two numbers on Form 1040 added together: adjusted gross income from line 11 plus tax-exempt interest from line 2a.3Social Security Administration. POMS HI 01101.010 – Modified Adjusted Gross Income The tax-exempt interest piece catches people off guard. Municipal bond income does not show up in your regular AGI, but it counts here, and a substantial muni portfolio can push you into a higher bracket after retirement.

On the form you can report either your actual MAGI for a more recent tax year or your best estimate if that return is not yet filed. Your estimate should reflect what you expect to report when you do file.4Social Security Administration. Form SSA-44 – Medicare Income-Related Monthly Adjustment Amount – Life-Changing Event

Picking the Right Year

The year you choose must be more recent than the tax year SSA originally used. If your 2026 premiums were based on your 2024 return, you will typically report either 2025 actual income or 2026 estimated income.4Social Security Administration. Form SSA-44 – Medicare Income-Related Monthly Adjustment Amount – Life-Changing Event

The form’s own guidance: if your income was not reduced until 2026, use 2026. If income dropped in 2025 but will be even lower in 2026, use 2026. If 2025 was the lower year and 2026 will climb back up (say, you retired mid-2025 after half a year of wages, and 2026 will include a full year of pension), use 2025. Picking the year that most clearly shows the reduction gives SSA the strongest basis to lower your surcharge.

Documentation to Gather Before You File

Evidence requirements track the event you are reporting. Assembling everything up front matters, because incomplete submissions are one of the most common reasons requests stall.4Social Security Administration. Form SSA-44 – Medicare Income-Related Monthly Adjustment Amount – Life-Changing Event

  • Work stoppage or reduction: a statement from your employer, pay stubs showing the change, a retirement letter, or documentation of a business transfer. If none of those are available, SSA will accept your own signed statement under penalty of perjury on the form itself.5Social Security Administration. POMS HI 01120.030 – Life Changing Event – Work Stoppage
  • Marriage: an original or certified copy of the marriage certificate.
  • Divorce or annulment: a certified copy of the final decree.
  • Death of a spouse: a certified death certificate or certified copy of the public record of death.
  • Loss of income-producing property: an insurance adjuster’s statement of loss, or a letter from a state or federal agency. For investment fraud, you also need proof of a criminal conviction related to the theft.
  • Loss of pension income: a letter from the plan administrator explaining the reduction or termination.
  • Employer settlement: a letter from the employer describing the terms and how they affect you.

Alongside the event documents, pull your most recent filed return for reference. If you are estimating a year you have not filed, keep pay stubs, pension statements, and brokerage year-to-date summaries handy so your number is realistic.

What Happens After You File

SSA reviews your documentation and compares your reported MAGI against the IRMAA brackets for the year in question. Processing generally takes several weeks, though wait times can stretch to two or three months in busy periods.

If approved, the effective date is generally January 1 of the year you filed. In limited circumstances SSA can apply the reduction to the prior year, and if you enrolled in Part B after January of the relevant year, the effective date is the first day of your enrollment instead.8eCFR. 20 CFR 418.1230 – What Is the Effective Date of an Income-Related Monthly Adjustment Amount Initial Determination Based on a More Recent Tax Year That retroactivity means you can recover surcharges already paid for earlier months in the same year. SSA refunds the excess, typically as a separate check, and the refund usually arrives two to three months after the favorable determination.9Centers for Medicare & Medicaid Services. Refunds of Premiums and Copayments

Verification After an Estimate

If SSA used an estimate to approve you, they later verify the actual numbers with the IRS once you file. You are required to provide a copy of that return when it is ready. If your actual MAGI comes in higher than your estimate, SSA will reassess and may bill you for the difference. If it came in lower, you could receive an additional refund.4Social Security Administration. Form SSA-44 – Medicare Income-Related Monthly Adjustment Amount – Life-Changing Event If your estimated MAGI changes for any reason before you file, contact SSA to update your records rather than waiting for a correction later.

If Your Request Is Denied

An initial denial typically means SSA did not find that your evidence supported a qualifying event, or that your post-event MAGI was not low enough to change your bracket. The denial letter explains the reasoning.

The first appeal step is a reconsideration, where a different SSA reviewer examines your case fresh. If that also goes against you, the Notice of Reconsideration gives you 60 days to request a hearing before an Administrative Law Judge at the Department of Health and Human Services. The 60-day clock starts five days after the date on the notice, since SSA assumes five days for mail delivery.10Social Security Administration. POMS HI 01194.125 – IRMAA Annual Verification Reconsideration Affirmation Notice Missing that deadline can forfeit your appeal rights unless you can show good cause.

Most disputes are resolved at reconsideration when beneficiaries submit stronger documentation the second time around. If the denial letter identified specific missing documents, supplying those is often enough to win.

Common Mistakes That Delay or Sink a Request

SSA does not automatically adjust your IRMAA when you retire or experience a life change. You have to file the form. Waiting months to act means paying surcharges you do not owe, though the retroactive effective date to January 1 of the filing year does provide a safety net for earlier months in that same year.

Claiming a non-qualifying event is another frequent problem. A rough stock market year, a one-time capital gain that inflated a prior return, or voluntarily winding down a side business are not recognized events. The drop has to connect to one of the seven categories. Filing without adequate documentation is the fastest way to stall the process. SSA can accept a sworn statement for work stoppages when employer documentation is not available, but events like property loss or pension termination need third-party proof.4Social Security Administration. Underestimating your MAGI is the mistake with the longest tail. If you lowball to get a bigger reduction and your return later shows more, SSA will bill you retroactively. Rounding your estimate up slightly is far better than facing an unexpected assessment months later.
