Form I-907, Request for Premium Processing: Fees, Filing, and Timeframes

To file Form I-907, Request for Premium Processing Service, submit a signed form with the correct fee for your classification either alongside your underlying petition or as an upgrade to a case already pending with USCIS. You can file it online for certain form types or mail it to the USCIS lockbox that matches your form and location. In return, USCIS commits to taking action on your case within 15, 30, or 45 business days, or refunding the premium fee.¹

Confirm Your Form and Classification Are Eligible

Premium processing covers four underlying forms, and not every classification within each one qualifies.²

Form I-129 — most nonimmigrant worker classifications, including H-1B, L-1A and L-1B, O-1 and O-2, TN, E-1/E-2/E-3, P-1 through P-3, Q-1, H-2B, H-3, and R-1.¹
Form I-140 — all EB-1, EB-2, and EB-3 employment-based immigrant petitions.
Form I-765 — F-1 students requesting pre-completion OPT, post-completion OPT, or the 24-month STEM OPT extension.
Form I-539 — applicants changing status to F-1, F-2, M-1, M-2, J-1, or J-2.

Eligibility can change quickly. USCIS has suspended premium processing for entire categories in the past, most notably H-1B during high-volume periods. During a suspension, any Form I-907 filed for the affected classification is rejected, and a combined payment covering both the I-907 and the underlying petition sends both filings back.³ Check the USCIS alerts page before you file.

The Fee for Your Classification

USCIS raised all premium processing fees on March 1, 2026. Any Form I-907 postmarked on or after that date must carry the new amount; the old fee triggers a rejection.⁴ The premium fee is on top of the base filing fee for the underlying petition.

$2,965 — Form I-129 for H-1B, L-1, O-1, TN, E-1/E-2/E-3, P, Q-1, and H-3, and all Form I-140 petitions.
$2,075 — Form I-539 changes to F, J, or M status.
$1,780 — Form I-129 for H-2B and R-1, and Form I-765 for OPT and STEM OPT.

The amounts are codified at 8 CFR § 106.4.⁵ Sending the wrong tier is one of the fastest ways to get a rejection, so verify which one applies before you write the check.

By mail, you can pay with a personal check, cashier’s check, or money order. To use a credit, debit, or prepaid card, complete Form G-1450 (Authorization for Credit Card Transactions) and place it on top of the package.⁶ Online filers pay through their USCIS account. Always send the premium fee as a separate payment from the underlying petition’s filing fee. If they share one check and USCIS rejects one filing, both come back.

Filling Out the Form

Download the current edition from uscis.gov/i-907. Saved copies from earlier filings may be outdated, and USCIS rejects prior editions.

Part 1 asks for the requester’s information: legal name, mailing address, daytime phone, and email. If an attorney or accredited representative is filing on your behalf, they enter their own details here.

Part 2 identifies the underlying case. You will list the form type (I-129, I-140, I-765, or I-539), the specific classification code, and, if the case is already pending, the receipt number from your Form I-797 Notice of Action. That number begins with three letters (EAC, WAC, IOE, or similar) followed by ten digits. For an upgrade, every field in Part 2 must be complete or USCIS will reject the request and return the fee.⁷

Part 3 is the signature block. Sign and date. An unsigned form is an automatic rejection.

Submitting Online or by Mail

Form I-907 can be filed two ways, and which is available depends on the underlying form and whether the case is new or already pending.

Online

USCIS accepts online I-907 filings for several scenarios. You can complete the form directly online when filing concurrently with an H-1B I-129 petition, or together with Form I-765 (OPT categories) or Form I-539 (F, J, or M changes of status). You can also upload a completed PDF to upgrade a pending case, including pending I-129 (H-1B), I-140, I-765 (OPT), and I-539 (F/J/M) filings, provided the receipt number begins with “IOE.”⁸ If the receipt starts with a different prefix such as EAC or WAC, the upgrade has to go by mail.

By Mail

The correct lockbox depends on the underlying form, whether you are filing concurrently or upgrading, and the applicable state.

For Form I-129, USCIS uses four lockboxes: Dallas, Phoenix, Chicago, and Elgin. The right one turns on the petitioner’s primary office state and the visa classification. When upgrading a pending I-129, you send the standalone I-907 to the lockbox designated for that classification and location.⁹

For Form I-140 upgrades, filers in western and Pacific states generally use the Phoenix Lockbox, and filers in eastern and midwestern states use the Elgin Lockbox.¹⁰

For a standalone Form I-765 upgrade on a pending OPT application, mail to the Chicago Lockbox. For a standalone Form I-539 upgrade on a pending F/J/M change of status, mail to the Elgin Lockbox regardless of your state. When you file Form I-907 together with a new I-539, the destination depends on your state of residence: western states go to Phoenix, eastern and midwestern states to Elgin.¹¹

Mailing to the wrong lockbox will not automatically kill a filing, but USCIS warns it causes delays. When in doubt, look up your specific classification on the USCIS “Direct Filing Addresses” page for the underlying form.

Filing Concurrently or Upgrading a Pending Case

You can file Form I-907 at the same time as the underlying petition, or you can add it later at any point before USCIS issues a final decision. To upgrade, download a fresh Form I-907, complete every field in Part 2 (including the I-797 receipt number), and submit it with the correct fee to the appropriate lockbox or through your online account.⁷

The processing clock starts fresh from the date USCIS receives the upgrade. Time already spent in the regular queue does not count toward the premium window.

What the Fee Buys: Timeframes and Refund

The clock starts when USCIS receives a properly completed Form I-907 at the correct address. The windows run in business days, which adds roughly a week to each one in real time.¹

15 business days — most Form I-129 and Form I-140 classifications.
30 business days — Form I-765 (OPT and STEM OPT) and Form I-539 (F, M, or J changes of status).
45 business days — Form I-140 petitions under the E13 multinational executive/manager and E21 national interest waiver classifications.

USCIS satisfies the guarantee by taking one of four actions within the window: approving the case, denying it, issuing a Request for Evidence, or issuing a Notice of Intent to Deny. Approval or denial ends the process. A Request for Evidence or Notice of Intent to Deny stops the clock, and a new window of the same length begins only after you respond. USCIS does not owe a refund simply because it asked for more evidence, because the request itself counts as timely action.

If none of those four actions happens inside the window, USCIS must refund the premium fee. The refund is supposed to be automatic, and the case continues under normal processing timelines. If the deadline passes and no refund arrives, contact the USCIS Contact Center or submit an e-Request through your online account.
