A Form I-797 Notice of Action is the letter USCIS mails whenever it needs to communicate about an immigration filing. It might confirm that your application was received, schedule a biometrics appointment, approve a petition, ask for more evidence, or announce a denial. The form itself does not grant status, authorize work, or permit travel. But paired with the right supporting document, specific versions of the I-797 can extend an expiring green card, satisfy an employer’s I-9 check, or help you board a flight back to the United States.
What you should do next depends on which version you received and what it says on the face of the notice.
The Seven Versions of Form I-797

- The plain I-797, with no letter suffix, is the standard receipt or approval notice.
- The I-797A is an approval notice that includes a replacement Form I-94. If you’re already in the United States and your status was extended or changed, this documents your new authorized stay without your having to leave and re-enter.
- The I-797B approves a worker petition. It is not a visa. If you’re abroad, you’ll still need a consular interview and a visa stamp before entering the country.
- The I-797C is the version most applicants see first. USCIS uses it for receipts, rejections, transfers between service centers, biometrics and interview appointments, and case reopenings. It’s also the version that carries green card extensions and often shows up in I-9 and boarding situations.
- The I-797D arrives with a physical benefit card, such as a green card or Employment Authorization Document, and explains how to use it.
- The I-797E is a Request for Evidence.
- The I-797F is a transportation letter for someone overseas who needs documentation to board a flight to the United States. It is not an advance parole document.
What to Check on the Notice
Read the notice as soon as it arrives and verify each field. The receipt number is a 13-character code beginning with three letters (such as EAC, WAC, LIN, SRC, NBC, MSC, or IOE) followed by 10 digits.2U.S. Citizenship and Immigration Services. The notice date starts the clock on any deadline. The case type field names the underlying form (I-130, I-485, and so on). For visa categories with annual caps, the priority date marks your place in line and generally matches the day USCIS received the original petition. The petitioner and beneficiary fields list names, dates of birth, and classification. Errors in those fields can create problems at biometrics, at an interview, or when a card is produced, so contact USCIS promptly if anything is wrong.
When the Notice Extends Your Green Card
An I-797C receipt notice can keep you in valid status while a renewal or removal-of-conditions case is pending. The extension length depends on the form you filed.
Form I-90 Renewals
A lawful permanent resident who files Form I-90 to renew a green card gets a receipt notice that extends the card’s validity for 36 months beyond the expiration date printed on the card.3U.S. Citizenship and Immigration Services. Form I-751 and Form I-829 Filings
Conditional permanent residents who file Form I-751 (marriage-based) or Form I-829 (investor-based) receive a 48-month extension from the card’s expiration date.5U.S. Citizenship and Immigration Services. Keep the most recent one as your primary proof of status.
Responding to a Request for Evidence or Notice of Intent to Deny
When USCIS needs more before deciding, it sends either an RFE or a NOID. The two are not the same.
Request for Evidence (I-797E)
An RFE typically gives you up to 84 days (12 weeks) to submit the missing documents.6U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part E Chapter 6 – Evidence Two form types get less time: Form I-539 (to extend or change nonimmigrant status) and Form I-601A (provisional unlawful presence waiver) each carry a 30-day deadline. When the notice is sent by regular mail, add three calendar days. If the last day falls on a weekend or federal holiday, the deadline moves to the next business day.
Place a copy of the RFE notice on top of your evidence packet before mailing it. That is how the USCIS mailroom routes your response to the right officer.
Notice of Intent to Deny
A NOID is more serious. The officer has reviewed your case, is leaning toward denial, and is giving you a chance to respond first. The maximum response time is 30 days, plus three days for mailing when sent by regular mail.6U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part E Chapter 6 – Evidence USCIS can also deny outright without any RFE or NOID if the officer finds no legal basis for approval and no additional evidence could change that.
Missing the Deadline
If you don’t respond by the required date, USCIS can deny your case as abandoned, deny it based on the existing record, or both.7eCFR. 8 CFR 103.2 A denial for abandonment is often harder to reopen than a denial on the merits, so if you can’t gather everything in time, submitting whatever you have before the date passes is almost always better than submitting nothing.
Employment Verification With an I-797
Certain I-797C notices count as valid employment documents for I-9 purposes. The most common example is the green card renewal case above: an expired Permanent Resident Card paired with an I-797C receipt for Form I-90 is a List A document for 36 months from the card’s expiration date.4U.S. Citizenship and Immigration Services. EAD holders should note a change: the automatic EAD extension program, which had allowed continued work for up to 180 or 540 days while a renewal was pending, no longer applies to renewal applications filed on or after October 30, 2025.8U.S. Citizenship and Immigration Services. New EAD renewal applicants cannot rely on the receipt notice to bridge a gap in work authorization.
Traveling Internationally With the Notice
The I-797 is not a travel document, but it can matter at the boarding gate. A lawful permanent resident traveling with an expired 10-year green card should carry the I-797C receipt notice alongside the expired card. Conditional residents whose two-year cards have expired face a stricter rule. Airlines can board them only if they present the expired card together with a Form I-797 receipt notice; without the I-797, carriers will not board them. Even with the right documents, CBP recommends contacting USCIS before you leave, because a temporary I-551 stamp in your passport is the most reliable way to avoid trouble at the gate or the port of entry.
Keeping Your Address Current So Notices Arrive
Every I-797 goes to the address USCIS has on file, and the agency does not use USPS mail forwarding. Federal law requires most noncitizens to report an address change to USCIS within 10 days of moving. The online Change of Address tool inside your USCIS account satisfies that requirement. You can also file a paper Form AR-11 by mail. If you previously signed an affidavit of support (Form I-864) as a sponsor, you have a separate 30-day deadline to file Form I-865 after a move.
Checking Case Status and Replacing a Lost Notice
USCIS offers free case tracking at egov.uscis.gov. Enter your 13-character receipt number to see the latest update.11U.S. Citizenship and Immigration Services. Case Status Online Status updates can lag behind actual processing by days or weeks. A USCIS online account adds electronic notifications, digital copies of many notices, and the ability to submit some evidence or inquiries without calling.
If a notice was lost, damaged, or never arrived, the replacement path depends on which notice you need. If you never received a receipt notice for a recently filed application, you may not need a separate form. Submit an inquiry through your USCIS online account or call the USCIS Contact Center. The agency can confirm whether the notice was mailed and resend it if the error was theirs. Applications filed online also generate electronic copies of most notices inside your account, which is a useful backup even when the paper version arrives normally.
